Item: Public hearing and consideration of a Conditional Use Permit for a proposed
RestaurantlSports Bar to be located at 310 College Main. Previously Twin City Mission Resale
Shop. (Planning Case 98-700)
Item Summary: The subject property has housed the Twin City Mission resale shop for several
years, and has been used as retail in the .past. It is located in the center of the NG-1 Historic
Northgate area, which lists both residential and commercial uses as permitted uses within the same
district. Existing uses within the area include churches, restaurants/nightclubs, retail, and
occasional residential. Theuses represent the type of use mix that is supported by the Northgate
Plan as well as the zoning for the area.
As has been and will be the case with other nightclubs. within the. Northgate area, the. additional
parking .demanded will have. an impact. In some previous- cases, the Commission'has approved
nightclub uses. in the Northgate area without additional parking: -however, additional parking was
required for the conversion of the Campus Theater to a nightclub use. Applicants in recent cases
have argued that the total impact to the Northgate .area will not be affected because customers
move between: all of the restaurant and nightclub uses within the area.
The. subject building is roughly 6000 square feet in area, :and. its conversion will not include any
site changes.
.Policy Issue Statement:
Civic Pride Citizens benefit from well-planned, attractive residential and
commercial areas, and from preserving historic areas.
The Land Use Plan reflects this part of the City as a redevelopment area and it is further detailed in
the Northgate Redevelopment Plan.
Item Background: The Northgate area was rezoned. several years ago in an effort to encourage
further development as an urban node where a mix of residential, church, retail, restaurant, .and
nightclub uses. would coexist. The City. also is currently working on public rehabilitation projects
to support development and redevelopment of the area. These. projects include the addition of both
surface parking and a parking garage.
Facade improvement grants. are available and wilhbe sought by the applicant as well.
Budgetary & Financial Summary: NA
Staff Recommendations: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses.. The Commission. may permit a conditional use subject to appropriate conditions
and safeguards, when after public notice and hearing the Commission finds that: (Staff comments
are in italics)
1. "The proposed use meets alt the minimum standards established in the ordinance four the
type of use proposed." .The site was .constructed before the City had its current. development
requirements, therefore it is legally nonconforming. Due to the fact that no site changes are
proposed, a site plan was not required.

2. "Than the proposed use .meets the purpose and intent: of the ordinance .and is in harmony
with the development policies and goals;and objectives as embodied in he Comprehensive Plan for
Development of the City." The Land Use Plan. reflects the area as Northgate, which would
provide for a mix of inner-urban uses.
3. "That .the proposed use will not be .detrimental to the health, welfare, and safety of the
surrounding neighborhood or its occupants, nor be substantially or permanently injurious to
neighboring property." The public hearing is an opportunity for-the Commission to measure, the
potential impact on surrounding land uses.
"The Commission may impose additional reasonable restrictions or conditions to carry oui; the
spirit and intent of the ordinance and to mitigate adverse .effects of the proposed use. These
requirements may include, but are not limited to, increased open -space, loading and parking
requirements, additional landscaping, and additional improvements such as curbing, sidewalks and
screening."
Unless the public :hearing .brings to light any. new information indicating potential negative
impacts, Staff recommends approval.
Related Advisory Board Recommendations: N/A (the Facade Improvement Program Advisory
Committee will need to review any request for grant moneys).
City Attorney Recommendation/Comments: No concerns. expressed.
Commission Action Options: .Approval, :approval. with conditions as provided in the .above
section, ordenial of request.
