Scarmardo that the City Engineer has approved and accepted the required drainage. facilities and detention pond which has been placed upon the Ashford Square property as well as on THE HERITAGE AT DARTMOUTH, LTD. property and certain part of Swoboda property, all in accordance with the specifications and instructions which you gave them in orderto get final approval on both properties as to detention pond and drainage facilities. Attached hereto is a copy of the letter of completion. As you know, a portion of the detention pond is on our property, being a 7.89 acre tract, known as Lot 2, Block 1 of the Subdivision. Subject to certain conditions, I am to participate in the payment of the cost of these improvements which Mr. Scarmardo was to construct. However, I need some type of written approval that these facilities will be sufficient for the City's requirements forme to build my project on the 7.89 acres without having to construct or fulfill any additional requirements for additional drainage and detention pond on my property. I have submitted to the City for approval plans for a detention pond on my property, but that was solely and alternative plan in the event Mr. Scarmardo did not obtain a final approval of the existing drainage .facility improvements and detention pond as was our agreement. I have drafted a letter agreement which I am attaching hereto for you and/or the appropriate City official to execute which in essence, tells me that all drainage and detention pond requirements of the City of College Station as to my tract of land have been satisfied with the completion of Mr. Scarmardo's work per the attached letter and approved and completed to the satisfaction of the City and that I may proceed.: with my project and obtain whatever permits. that I need to complete my project and that no certificate of occupancies shall be denied me because of drainage facilities. and/or a detention pond has not been completed. Special attention is directed to item #8 related to the cleaning of accumulated silt from the Ashford Square Detention Pond. Efforts by the City inspector to call attention to deficiencies with the silt fence during the construction were. largely ignored.. This detention facility is a public facility and was adversely impacted by the large amount of silt during the construction of the Heritage development. Because of .the wet conditions encountered when completing the Ashford Square development the contractor was unable to remove the accumulated silt resulting from. that project and is now committed. to removal. of that silt west (Ashford Square side) of the center flume of the detention facility. Our expectation related to item #8 of the preliminary punchlist is that you will remove the accumulated silt east (Heritage side) of the center flume of the detention facility. I am attaching a copy of the bottom contours of the detention facility to provide information. for the appropriate removal level. The reestablishment of Bermuda vegetation is necessary following .removal of the silt. As we are in a relatively dry period at the current time, you are encouraged to .initiate this as soon as possible and avoid the problems that were incurred previously. Landscaping has been installed as they go; however, it has not been checked against the approved landscape plan. The main. driveway entrance was not built according to plans and .did not :line up with Teal Drive across the street. Ed .and Scott determined that'it did not create a traffic problem. It was left up to Jerry-Jones & Bob Mosley to determine if the driveway needed to be removed and installed as per the plans. This was recognized as a subdivision. We have not had a project called Dartmouth Addition. Emanual Glockzin is :involved with the Heritage at Dartmouth .apartments being constructed west of Dartmouth. As, part of this projectthere is a 6 inch water line loop connected to the 12 inch that was part of the Dartmouth Grossing project. The water line has been installed and tested; however, this project is 'not recognised as a subdivision and I could .not find any requirement that called for a letter of completion in our ordinances on such a project. The entrance of question has been designed to facilitate both phases of construction. Throat length for the Access Drive exceeds that required by ordinance. The original reason for providing the joint Access Easement at the present .location was to allow the proposed access drive (Boulevard) to align with the center line of Teal Drive which lies opposite subject driveway on the northeast side of Proposed Dartmouth Drive. As afore stated, Mr. Glockzin Does own "Both" portions of the "J©int Access Easement" and has incorporated this same Joint Access Easement into his Future Development Design. As per Exhibit "A" please note that each drive within the Access Drive (Boulevard) is 24' Back to Back. This allows for Two (2) Lanes "in" and Two (2) Lanes 'but" of the subject project for traffic flow. The Two (2) lanes into the subject project would allow for backup movement from spaces 1-12 while still allowing adequate passage of incoming traffic movements. Please review this matter regarding the significance and the necessity of removing said parking spaces 1-12 and advise us of your and/or staffs final decision regarding said spaces.
