Can we get approval for the Final Plat prior to FEMA approval? Yes, according to FEMA even though.. this is an unnumbered "A" zone and their regulations require, because of the size: of the platting, that this area be studied and submitted to them, we can approve and file the final plat for record prior to their approval of the study. They did say that the floodplain line and floodway . lines will be subject to their approval. Because of our discussions, I would suggest that such wording be placed on the plat. 2. Can we get a building permit prior to FEMA approval? Yes, due to the topography on the .site and the fact that the location of the building is well .beyond the approximate graphical floodplain line and the proposed studied line FEMA has said that with that information and the height of the proposed building finished floor (+1 D) we could issue. building permits. 3. Is this building permit. in :any way conditional to FEMA approval? If we were to start construction on our site and FEMA were to reject the report submitted by Kling; does this have any impacf on our site? Could grades change (finish floor, parking lot, etc.)? Could FEMAS response create additional construction cost to our site? Perhaps to all questions. The one item that FEMA said that we must disclose to you is that if for some reason your finished floor ends up being less that one foot above the 100 year base flood elevation, as approved by .FEMA, then you would be required to floodproof your structure to .the one foot plus elevation. This is pretty far. fetched with the fact that your finished floor is now set at ten feet above the proposed 100 year flood elevation, but if is a risk that FEMA said we must disclose. 1 /.:. ./ r° .,..r~ - _... -. -. __ _,_-. __ __ __.-__ _..... -...... - _._ __ __ _.. _. __-_.._. _.... -. :r 4. We have been informed by Stewart that the drainage report for FEMA has been returned to you and that the remarks you had made on his previous report wereminimal. Has this report. beenreturifed o you? When do you feel that it will be ready to submit to FEMA? It is true that we have reviewed the report to FEMA some time ago and that our comments were minimal. No, the report has not been returned. to the City as pf this writing.. In my latest conversation with Kling Engineering their estimated time frame. for resubmittal at presenf is unknown.. I have asked for a time fr•anle but as yet have not received any further information. 5. The .40 acre detention area. between .our site and the proposed floodway as defined by Kling on the Final Plat has been agreed to be purchased by our company. We were intending to have this platted at a later date. This date to be determined when Wheeler .develops the remaining tracts. Is this okay with the' city? We will allow a separate instrument easement to cover .the detention area with a maintenance entity to be named. The City will need to .receive some sort of documentation to assure that someone is responsible for the maintenance and what level of maintenance that will include. So, yes we will allow you to plat it at a later date but it will fzeed to have a separate instrument easement on it now. 6. Assuming. that we can. get Final Plat approval prior to FEMA approval (asked in question 1). Can. we amend the Final Plat at a later date to include the detention area so that we get Final Plat approval for the overall acreage? Yes, you can amend the final plat at a later date to add the detention area and if the,floodplain and floodway lines have changed from the original filed copy those could be amended as well. 7. If we cannot get .Final Plat approval. prior to FEMA approval can we amend the Preliminary Plat at a later date to include the Detention Area so that we can .get Final Plat .approval for the overall acreage? Not applicable. There is one more bit of information that I will pass onto .you: In discussions with FEMA, it appears that we will need to make a condition of the certificate of occupancy that the LOMB is a roved b FEMA. Sinc PP Y e ilus channel work will most likely be done prior to the building or at least concurrently with, this should not pose a problem unless it is not submitted to FEMA in a timely manner. Staff reviewed the above. mentioned site plan for a hotel to be located on lot 1, block 1 of the Wheeler Phase II Subdivision on University Drive. The subject prdperty is located within the "OV" Corridor Overlay District which requires a building aesthetics. review by the Project Review Committee (PRC). The. ordinance requires all building colors to be harmonious with the existing man-made or natural .environment, and only .compatible. accent colors shall be used. Submit :elevation drawings and color samples so that a future PRC meeting can be scheduled. All colors must be approved prior to issuance of a building permit. The landscape,plan submitted .appears to meet the intent of the ordinance; however, a legend must be provided that calculates and tabulates the landscape and streetscape points required and proposed. Submit one. copy of the landscape plan with the legend. attached. to be reviewed by staff prior to issuance of a building permit. In :summary, please address all of the staff comments/concerns on the attached site plan and submit the following. information for further review: _ Three complete sets of construction documents with the revised. site, landscape and dranage/grading plans attached. One set of elevation drawings and color samples for review by the PRC. _ Two copies of the drainage report. s Development permit application with the $100 application and $300 inspection fee. This is fine. However, I will need to see a proposed large container location with pad and screening fence noted on the site for growth andlor future use. This is consistent with the direction we have taken in the past on similar sites. ~, Baymont Inn and Suites (98-442):. I recommend turning the container a few degrees to the right to allow for astraight-in approach. There are no impact fees. in this area. (I will verify this with Development Engineering) 2. Drainage. Development Permit fee is $100. 3, Inspection Fees are $300. 4. Site Plan review fee is $100. ~~ 5. Building permit fees are based on the value of the building and are calculated as follows: The first $100,000.00 is $460.00; then $3.00 per $1,000,00 up to $500,000.00; j then $2.00 per $1,000 up to $1 million. { 6. Sewer Tap fees `are as follows: i ~ 4" - $350 6" - $100 (Inspection fee only. Developer makes the tap according to City specs and is subject to City inspection.) 7. Water Tap fees: are as follows: 3/4" - $400. ~ 1" - $500 1.5" - $800: 2. --$1,500 *3" - $1,300 *4" - $2,000 * Covers only purchase of meter and inspection fee. Meters must be purchased from City. Developer is responsible -for making the tap according to City specs, subject to City inspection. ~ The City determines the size of taps based on demands furnished by developer. 8. .Irrigation tap fees are the same as those listed above, and size is based on demands (gallons per minute-maximum) 9. Can we get approval for the Final Plat prior to FEMA approval? Yes, according to FFMA even though this is an unnumbered "A"zone and their regzrlations require, because of the size of the platting, that this area be studied and submitted to them, we can approve and file the final plat for record prior to their approval of he study. They did say. that the jloodplain line and jloodway lines will be subject to their approval. Because of our discussions, I would suggest that such wording be placed on the plat. 2. Can we get a building permit prior to FEMA approval? Yes, due to the topography on the site and the fact that the location of the building is well beyond the approximate graphical jloodplain line and the proposed studied line FEMA has said that with that information and the height of the proposed building finished floor (+1 D') we could issue building permits. 3. Is this building permit in any way conditional to FEMA approval? If we were to start construction. on our site and FEMA were to reject the report submitted by Kling; does this have any impact on our site? Could grades change (finish floor, parking lot, etc.)? Could FEMAS response create additional construction cost to our site? Perhaps to all .questions. The one .item that FEMA said that we must disclose to you is that if for some reason your finished floor ends up being less that one foot above the IOO year base flood elevation, as approved by FEMA, then you would be required to jloodproof your structure to the one. foot plus elevation. This is pretty far fetched with the fact that your finished floor is now set at ten feet above .the proposed 100 year flood elevation, but it is a risk that FEMA said we must disclose. Home of Texas A&M University 4. We have. been informed by Stewart that the drainage report for FEMA has been returned to you and that the remarks you had made on his previous report were minimal. Has this report been returned to you? When do you feel that it will be ready to submit to FEMA? It is true that we have reviewed -the report to FEMA some time ago and that our. comments were minimal. No, the report has not been returned to the City as of this writing. In my latest conversation with Kling Engineering their .estimated time frame for resubmittal at present is unknown. I have asked for a time frame but as yet have not received any further information. 5. The .40 acre detention area. between our site and the proposed floodway as defined by Kling on the Final. Plat has been agreed to be purchased by our company. We were intending to have this platted at a later date. This. date to be determined when Wheeler develops: the remaining tracts. Is this okay with the city? We will allow a separate instrument easement to cover the detention area with a maintenance entity to be named. The City will need to receive some sort of documentation. to .assure that someone is responsible for the .maintenance `and what level of maintenance that will include. So, yes we will allow you to plat it at a later date but it will need to have a separate instrument easement on'it now. 6. Assuming that we can get Final Plat approval prior to FEMA approval (asked in question 1). Can we amend the Final Plat at a later date to include the detention area so that we get Final Plat approval for the overall acreage? Yes, you can amend the~nal plat at a later date to add the detention area and if the f loodplain and, f Zoodway lines have changed from the original faled copy those could be amended as well. 7. If we cannot get Final Plat approval prior to FEMA approval can we nmend' the Preliminary Plat at a later date to include the Detention Area so that we can get' Final Plat approval for the overall acreage? Not applicable. There is one more bit of information that I will pass onto -you. In discussions with FEMA, it appears that we will need to make a condition of the certificate of occupancy that the LONIR is approved by FEMA. Since this channel work will most likely be done prior to the building or at least concurrently with, this should not pose a problem unless it is not submitted to FEMA in a timely manner. I hope. that these answers help. I apologize. for the delay but FEMA has most all of their mitigation officers in -San Antonio helping with. the disaster. and it took quite a while'.. to get in touch with them.
