Development -Driveway Access Location MDG Job No. 000129-2987 To Whom It May Concern: The Q.A.B. proposed development is located along Brentwood Drive on a 0.603-acre tract adjacent to the Dairy Queen. Below is a time line illustrating the dates and comments received by Development Services and the discussions and design of the projects driveway entrance: August 19, 1998- Initial submission. - Au,~,ust 24. 1998 -Received comments from Development Services. The comment on the location of the driveway entrance was noted on this set of plans. In general, the requested change involved moving the driveway from in line with the front of the .office center to the east approximately 65'. This new location would make. the driveway closer in compliance with the driveway ordinance, but neither location fully complies. As discussed below in more detail this requested change compromises customer safety. Therefore, we began working with John Kiltz and Natalie Ruiz to come up with an alternative design that would allow the driveway to stay located as originally planned. - .September 1, 1998 -Sent fax (see attachment) to both parties with the new parking lot design. Included in the design was the original driveway location. with a 20' access lane on the east property line. The access lane would provide for cross access to adjacent landowners and future connection to Discount Tire and through street. Per my phone conversation with Natalie on August 28, 1998, she believed the site plan would be acceptable with the original driveway location so long as the access lane was added, but the ultimate decision would be made by staff review. This access lane is not required by any of the COCS development ordinances, but we integrated it into our desigr>`to meet Development Services. preferences and as a aid to our original driveway location. - September 14, 1998 -Second submission to Development Services with above changes. 000129-c.OS.doc MDG- 1 - September 22. 1998 -Received comments from Development Services. Comments on the construction plans still required the location of the driveway entrance to change regardless of the access lane. Our concern with the driveway at the location directed by Development Services is a matter of safety. As customers enter. the parking lot it would be best. if they can walk directly to the service center without crossing in front of the parking/service bays. Due to vehicles frequently entering and backing out of these bays,. pedestrian traffic's safety would be highly compromised if made to cross in front of this area From my discussions with Mr. Kiltz, we are both in agreement that changing the driveway location is not the right thing to do. From the owner's viewpoint, an insurer would certainly cover potential liability still customer safety would be compromised. Q.A.B. takes pride in its safety record and do not want to compromise it based on what really amounts to a "preference" of driveway location by the City. Q.A.B. can assure customer safety with the original design, but can not assure it if we accommodate the City's preference. I appreciate your attention to this matter. Rabon Metcalf, E.I. I am assuming the City feels that commercial businesses have a tendency of allow areas located in front of their property or in locations highly visible to the public and their customers to become unruly, degraded and non- maintained. Therefore, the site was redesigned so that the parking area and useable land located west of the existing easement would do for storage of runoff. The ordinance calls for .driveways on collector streets (ie Brentwood) to be spaced 185 feet apart. The applicant is requesting that the driveway be located 75 feet away from an existing adjacent driveway, In applying the ordinance, staff indicated that the location of the driveway should be shifted approximately 75 feet to line up with the parking aisle nearer the sites east side. The reasoning behind this is two-fold. First, in order to uphold the driveway ordinance. the driveway needs to be shifted as far east as practicable. Moving the driveway to line up with the sites east parking aisle increases the spacing distance to approximately 150 feet. The QAB site can not meet the full 185 feet spacing requirement due to its lack of frontage. Second, a driveway located at the east parking aisle would. better align with the cross. access driveway which will connect the QAB site to the private roadwau {contained within a private. access, drainage, and utility easement). which serves the Discount Tire and the Epicures Catering sites. The Texas Department of Transportation '(TXDOT) is currently developing the plans for the .Phase II Texas Avenue widening from about Dominik Drive south to FM 2818. The preliminary design for this phase does not include a median opening for the private roadway which serves the Discount: Tire and Epicures sites. It is important to note that the City did not require the cross access, but much to the developers credit, he voluntarily included it on the QAB site: However, with the driveway location as proposed. it will make. "cross" traffic zigzag through the. site. The applicant has. indicated that if the driveway were moved east to meet the intent of the driveway ordinance, pedestrian safety would be compromised since customers would have to walk in front of the parking service bays; However, a similar point about pedestrian safety could also be made about a west driveway location since it would introduce cross traffic more internally through the site. In summary, the..applicants desired location for the QAB driveway andwhat is needed to meet the intent of the driveway. ordinance differs by 75 feet.. Given that the QAB site is located on a collector, staff does not consider this variance request. a-major public safety.. issue, particularly when compared to most other driveway variance .cases that have. been brought forth to PRC (and'formerly P&Z and Council).. Due to this, the parking requirements have increased to a total of 36 parking spaces. This number takes into consideration the square-footage of the new working bays. Attached are two revised sets of plans that reflect the above changes. Please note the following two items. - The area of impervious cover has decreased from the original site plan. Therefore, detention requirements have also decreased. This will give the site's detention area more buffer and also decrease the rate of discharge from the pond due to a lower head on the grate inlet. - Per the PRC meeting in December the 20' access alley east of the building has been opted to be removed. First. I have limited access to the container location as noted. I can get in, but can not get. out. This could be eliminated with a second drive access. Secondly, the container enclosure is not 12 x 12: I measure it at 10 x 13. Plus it has gates. If the sputhern most container screening wall in increased to 20 feet,. gates will not be required. and, if a second. access drive is installed,l will have complete access.
