I do -not have astraight-in approach. to this container location due to the curb and island at the drive.
However, if the container is slanted toward the. drive,. I can get it. It should not be a problem to angle the
container because of the 20 foot wide conatiner pad that. is shown on the plan. Let me know if you have
any questions. Thanks.

We got in "preliminary building plans" forfihis project which the applicant has that we review and make
comments on. He knows. they are incomplete, in that Kling Engr. is doing the site grading & drainate and
overall utility design plan and it's not finished yet. He requests that we go ahead and review the building
plans and give him comments. The letter he sent is attached.
The colors, etc, have already been thru the PRC but the. site plan has not. There is a site plan in this set
of plans which can be reviewed. Do we have to go back thru PRC with the actual site plan or can we
review that at staff level? I can't find that we've actually begun. a file with an application, etc. Perhaps
Nat will be able to answer that when she comes in. She's :been the main contact for this project so far.
Anyway, the. building plans have been distributed to Carlin building, the plans check room, the Fire Dept
and Tony M. in electrical. Make your review as usual and we'll determine the next. step later. Thanks.

^ 15. Fire hydrants must be operable .and accepted by the City and drives must. have an all weather surface
before combustibles can be brought on any site.
.~ 16. A twenty four foot setback from R.U.W. to curb of parking lot is required. Parking may be allowed in
this area up to a maximum of 7 contiguous spaces.
^ 17. All. plans must include irrigation systems for landscaping. Irrigation meters are separate from the regular water
systems for buildings and must be sized accordingly and include backflow prevention protection.

Enclosed are four copies of the current plans for the Joe's Crab Shack Restaurant at University Drive.
These drawings are submitted for building review and are incomplete due to timing difficulties with our
civil engineer and Stewart Kling. As you know Stewart is working on the overall site drainage and utility
design and is not quite complete with his work. Consequently our engineer, Ranney McDonough has not
been able to finish the site design for the restaurant. Since the drawings package is complete except for the
site package we would like to get the city's comments for this part of the work as quickly as possible so we
are ready to begin construction as'soon as the civil design is finalized. I realize that this is out of sequence
with your normal process but in light of our previous discussions I believe the site is understood
conceptually. We are interested in proceeding with the construction of this project as quickly as possible.
The building is fully sprinklered and drawings will be submitted by the selected sprinkler subcontractor at a
future date. The pre-engineered. metal building structure will be submitted by the building manufacturer at
the time of award of the building subcontract. I will contact you Monday July 06, 1998 to confirm permit
fees and forward the appropriate payments to your office immediately.
I appreciate your assistance in allowing us to proceed with this project as quickly as possible. Please feel
free to contact me if I can be of any help. Landry's Seafood Restaurants is looking forward to becoming a
part of the College Station community.

RE: Joe's Crab Shack development on University Drive in College Station.
On Friday, July 2~1, 1998, I returned the following information to you by Federal Express:
A .redlined site, grading and landscape plan with staff comments. Make the
® necessary changes and submit 10 revised copies .including the original
redlined plans for further review.
Site Plan application and checklist. Submit the completed application with the
$100 application fee. Also submit the site plan checklist with each item
checked off or a note as to why an item is not checked off. During the staff's
review of the site plan, several items on the checklist were missing, Please
make sure that all items are addressed .before the next submittal.
Building Permit application. Submit the completed application. Once the
T application is received, staff will determine the total amount of building
permit fees.
_ Development Permit. application. Submit the completed application with the
$100 application fee. 71iis permit can be issued in phases. Initially, we can
issue the permit for clearing and grubbing only. Once the site and grading
plans are approved, including the drainage report, we can issue a "Slab
.Only"permit that will allow you to begin some site worl~ Once all plans are
approved, we will issue a full Development Permit. .
0 Electrical request -form. Submit the completed form to allow staff to begin the
electrical layout.
Construction sheet SEA 1 with staff comments. Make the necessary changes
® and submit 3 revised .copies along with the original redlined sheet to be
reviewed by sta, ff and included in the construction documents.

_ Easement information sheet, Submit the completed form to allow for a blanket
easement on the property. This blanket easement wild be released once the
individual easements are dedicated by separate instrument or an as built final
.plat. Thee property owner will be invoiced for the necessary title work
associated with the preparation of easements.
- Application:. for a Contractor's License. Your contractor will be required to
submit the completed application along with the $54 application and
.processing fee prior to issuance of a building permit.
On July 22, 1998, I faxed .you a copy of the Plans Examination Report from our Building
Inspections Department. No additional construction plans are required to address the seven
comments listed in the report. You may submit a letter .outlining and.. addressing all comments.
This letter will be attached. to the building plans. as an addendum in lieu of additional plans.
The next available deadline. for site plan review is at noon on Wednesday, July 29, 1998. If at all
possible, please submit the. revised site plan by this deadline so that staff may review .the plan in
conjunction with the utility and grading information being submitted by Kling Engineering. If you
are not able to :make the July 29th date, the next deadline is Wednesday, August 5, 1998 or any
future Wednesday at noon.

A RESOLUTION PRESCRIBING FEES FOR. DEVELOPMENT REVIEW AND OTHER
SERVICES PROVIDED. BY THE ECONOMIC AND DEVELOPMENT SERVICES
DEPARTMENT OF THE CITY OF COLLEGE STATION, AND PROVIDING FOR AN'
EFFECTIVE DATE. -
WHEREAS, the Economic and Development Services Department of the City of College.
Station provides various services as required by the codes and ordinances of the City;
and
WHEREAS, these services are required and requested to allow development activities
and other specific activities and transactions to occur, and
WHEREAS, it is the intent of the Gollege Station City Council to establish fees that
reflect the cost of services provided;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of College
Station that:
The following service fees tie established for certain services provided within the
Economic and Development Services Department:

Preliminary plat and master plan review $200.00

F. WATER AND SEWER CONNECTIONS
(1) Fee for Water Tap
(a) For customers, whether single-family, multi-family, or commercial and/or
industrial,. connecting to the water system within or outside the corporate
limits of the City will have a service charge based on water tap size.

{c) For those taps- which require .boring beneath a street or thoroughfare or
requiring the street to be cut, an additiona! $15 per foot of boring or cut
charge will also be assessed.
(2) .Fee for .Sewer Tap
(a) for customers, whether single-family, mufti-family, or commercial and/or
industrial, connecting to the wastewater system within or outside the
corporate limits of the City will have a service charge based on sewer'tap
size.

Answer to first question: No we haven't seen a site plan.
#2: No we don't ever issue a b.p. without site plan review -except for IJCSI!J
#3: The timing is the issue. They will be ready to bring in site plans,. building plans, etc. for review
before Kling will be ready to bring in a replat and construction does for the new infrastructure which will
be required..
#4: The review of the replat and construction does will probably take place before Joe's gets a building
permit, but it could not be constructed before then. Stewart & David S. offered to post the financial
guarantee for it, but as long as they know they can't do anything else on those encumbered lots, there's
no need for that, IF the instructure is already to those subject lots. But before David cuts a deal with
Marriott people to begin construction by .....(whatever), the replat will have to be processed: and the
infrastructure in orsome other kind of deal must be struck. with the City (unless it goes on a different
already platted lot).

I had a call from Stewart. Kling. this a.m. talking .about the possibility of issuing a building permit. for Joes
before he turns in a replat for the property, and. also. having David guarantee infrastructure. I called him
back for clarification and it seems that the property Joes is going on is already platted -the majority of
the project will be on Lot 2 (1 think) One Lincoln Place, and some will be orr a Jot in the Henton
subdivision. (I didn't look anything up to see that he was correct and that both are filed plats).
Anyway,. this is what I told himt If both lots are platted lots,. I see. no reason why Joes can't pull a building
permit as it stands RIGHT NOW, with the understanding that both lots are encumbered, and no
additionalbuilding permits can be issued on the remaining. portions of each lot until a plat is filed and
additional infrastructure is installed and accepted.
Does this make sense to you? If you. see a problem with this reasoning, please Jetme know fast and I
will let Stewart know today - of if after today, I'II have #o talk to David because Stewart is going out of
town.

following is a list of items that need to be .addressed prior to building permit issuance:

® Remove the fire lanes in theparking lot. Boulevard "A" and Street "B" as shown will
be designated fire lanes; therefore, interior fire lanes are not required.
_ Modify the Utility Demands legend to include the maximum and average demands for
the domestic water and irrigation in gallons perminute. (Staff will size both meters
based on this information.)

Label the 6" sanitary sewer that runs through the parking lot as "private".
e Label the proposed manhole as "private".
® Place the fire department connection on the east side of the building (closest to the

Just to let you know, our Sanitation department has agreed to order two four-yard .dumpsters
with casters so that the we will be able to service your site. Since you plan is to completely
enclose the containers within the building, our trucks cannot access the dumpsters as shown.
However, after talking with Robert Burnham, he informed me that the employees of the
restaurant will be responsible for rolling the containers out for .collection and rolling them back
inside the building. We agree that this is a great alternative to having the dumpsters in the parking
lot and are willing to special order the dumpsters with. casters so that the restaurant employees
will be able to move them in and out of the building easily.
As per our conversation yesterday, we will not be able to issue a Certificate of Occupancy for the
building until several off-site improvements are completed. I understand that David Scarmardo is
responsible for the construction for the two access drives, a water line extension, a sewer line
extension, storm sewer installation,.. a fire hydrant and a detention pond. All of these
improvements must be completed and accepted by the City prior to issuance of a Certificate of
Occupancy.. We are currently reviewing these construction documents and working with David
Scarmardo and Kling Engineering on obtaining the necessary easements.
All of the fees listed above may be .paid at one location with one check for your convenience. If

Therefore, any shrubs or trees planted for landscaping should be'lacated a distance at least equal
to one-half of their anticipated mature height away from the buildings.

The suri"icia! clays are subject to strength loss with the increases in moisture content that normally
occur beneath .paving. These soils are generally: considered to provide poor subgrade support.

lime should be thoroughly mixed and blended with. the top 6 inches of subgrade and compacted to
at least 95 percent of its maximum standard Proctor dry density. The moisture. content of the lime
.modified material at the time of compaction should be within a range'of -2 Percent to +4 percent of
its optimum value. Mixing, curing and compaction of lime modified Payer is described in item 260 of
the previously mentioned Standard Specifications.
Lime modification is recommended for ail subgrade areas to support asphaltic concrete paving and
beneath port}and cement concrete paving subject to heavy .truck traffic. `Modification of the
subgrade will also improve the performance of light to medium duty portland cement concrete

If asphaltic concrete pavement is used, we recommend a full depth asphaltic .concrete section
having a minimum totaF thickness of 5 inches far automobile parking areas and 7 inches far drive
lanes receiving light to medium size trucks.. A minimum surface course. thickness of 2 inches is
recommended far asphaltic concrete. pavements. The asphaltic .concrete surface course should
conform to Type "D" and the base course should conform to Type A or 6 in Item 340 of the
TxDOT Standard Specifications.

Staff has completed the final round of plans review and the few remaining comments were faxed
to Robert Burnham on Tuesday, August 25; 1998.- I've attached a copy of the comments for your
review as well.
The following is a list. of items and/or fees that must also be taken care of prior to permit issuance:
Three complete sets of revised, sealed construction documents.
Completed site plan application and $100 processing fee. (This application was sent
to you by Federal Express on July 24, 1998.)
_ Water and sewer tap fees:
Domestic and Irrigation water tap fees. (These fees are based on the meter size.
Staff will size the meters once the revised utility demands are received from Robert
Burnham at KSA A+DL)
_ 6" Sanitary Sewer Tap inspection fee - $100 (The contractor makes the tap.)
_ Temporary electrical pole fee in the amount of $45
_ Building permit fees in the amount of $2,660. (This figure is based on the $1,000,000
valuation provided on the building pernut application.)

Just. to let you know, our Sanitation ..department has agreed. to order two four-yard dumpsters
with casters so that the we will be able to service your site. Since you plan is to completely
enclose the containers within the-building, our trucks cannot access the dumpsters as shown.
However, after talking with Robert Burnham, he informed me that the employees of the
restaurant will be responsible for rolling the containers out for collection and rolling them back
inside the building. We agree. that this is a great alternative to having the dumpsters in the parking
lot and are willing to special.. order the dumpsters with casters so that the restaurant employees
will be able to move them in and out of the building easily.
As per our conversation yesterday, we will not be able to issue a Certificate of Occupancy for the
building until several off-site. improvements are completed. I understand. that David Scarmardo is
responsible for the construction for the two access drives, a water line extension, a sewer line
extension, storm sewer installation, afire hydrant and a detention pond. .All of these
improvements must be completed .and accepted by the City prior to issuance of a Certificate of
Occupancy. We are currently reviewing these construction documents and working with David
Scarmardo and. Kling Engineering on obtaining the necessary easements.
All of the fees listed above may be paid at one location with one check for your convenience. If

Thank you for the time you spenf with me and Stuart on the phone today.
.Can you tell me if the City required Landry's to change its site plan to reduce the number of parking
spaces from 9 to 7.5 on Lot 2R (the southern boundary of the Joe's lot)? It seems that we just got the
new site plan and it reflects the reduction, which may require us to change the plat again. It may be that
Landry's made the changes on their own.
Following our discussion today, we will :proceed to vacate the plat up to, but not including the Quality
Suites property or the Heritage tract. Jn that way, we will not have to join them in the replat process.
Finally, as we discussed, when we final plat the remainder of David's tract for future users, we will not
include Landry's in the process as they will have no interest in the tracts being. replated.

No one on development services staff has given David the indication that "the city" would be installing
the traffic signal. If a signal is warranted there, per our ordinance, David could be required to help pay for
it. We need to make that clear to David. Also., since they are requesting $'s, they'll need to do a traffic
impact analysis which shows if a signal would be warranted. Before they can do anything though, they
have to wait on TXDOT to decide where the median opening will be. My guess is is that a signal would
not be warranted until the road is widened, the medians are in, and more of David's development other
than just Joe's is in.
I am currnetly working on agreements with TAMU and the Callaway Corp for the signal at Olsen. A&M
has agreed to pay 1/3rd. and Callaway about 26K. These agreements will be going to Council so they
sibl have this in mind when David comes requesting $'s. Given our ordinace language and the

Callaway precedent, I don't think staff should recommend that the. City purchase a signal We didn t
recommend paying for the Lone Star signal and if Council vrants to do the same for David that's there
perogative.

david wants those committments and shuck told him the only way to get those is a development
agreement. soooo, chuck is now asking how. do we get one put together and taken to council for this
project??.because of the joss deal and davids time line of course chuck would like to hear from us on
Monday as to can we do it or not.
