I know that you will know the right place to forward my questions, however. Regarding the tract of .land on University :Drive known as "University Park, Section II, Block Y," I have a question about the utilities that were installed to serve the Marriott Hotel being constructed across the street. These utilities were run across the Karbrooke property outside of the utility easement. It is my understanding that the City of College Station did not make this error; but rather a private contractor. I am not sure what the appropriate action is to take. I would appreciate some insight as to how the City .handles these types of issues. Also, I feel that this should be resolved before final approval by the city of the new hotel. Bryan, Texas 77803 ItE: .Utility Permit for Marriott Townplace Suites located at the corner of University Drive and Lincoln Avenue Dear Mr. Williams: Please find .enclosed the utility permit to install a storm sewer headwall and two sanitary sewer manholes within the FM 60 right-0f--way for the above referenced project. The total discharge from the developed site will. be less than the current existing conditions discharge due to their detention facilities proposed. There is a restricting 9" diameter orifice in their on-site storm sewer that will restrict the outflow from the headwall to the pre-developed flowrate. The TxDOT structure should not receive any additional water than it currently receives. There will be some offsite sanitary sewer improvements required with this development: These offsite improvements .will include a bore and casing under University Drive, however those improvements will be submitted for your review under a separate permit application. There are a few comments regarding this report that need to be addressed. They are: • Include a revised grading plan in the report (currently the old plan showing a connection to University Drive is included). • It appears that the .existing runoff shown on the site hydrographs for the various storm events is the 1.00 year existing runoff. Please reflect existing and proposed runoff for each storm event. ® We could not find any .discussion or calculations showing that the proposed grate and curb inlets provide enough free area to pass. the various storm events without causing the ponding in the. parking lot to exceed 0.83 feet in depth as required by our Drainage Ordinance. • On the "100. year runoff post development hydrograph at outfall with constant WSEL" the'flowrate begins as a .Negative 9.65 cfs and then oscillates between -0:5 and 0.5 cfs. Please provide explanation of these results. • We also wanted to point out o Carter & Burgess the 11 vertical feet of detention. storage provided in the pond never is utilized. According to the Hydraulic Gradelines provided in this report, only 2.5 feet of vertical storage is used during the 100 year event. Does this over-design serve a purpose? Please submit a TxDOT Utility Permit .application packet to our office for review and submittal to TxDOT for review. This .permit will be for the discharge of storm water through a new utility (outfall structure) proposed with this development and any other work to be done withirs their right-of--way. Also submit to our office the construction plans for the sanitary sewer improvements to be constructed downstream of this property. This project must be completed prior to any Certificate of Occupancy being issued. Keep in mind that TxDOT permits with all .supporting information for the work done in their right-of-way will need to be submitted to us as well. Home of Texas A&M University ~. It appears that there will be some fill and parking lot improvements placed within the 100 year floodplain as determined by Kling Engineering. As a reminder, according to FEMA regulations, the developer will have 6 months from the date of completing such work to submit a LOMB-F to FEMA. That submittal must be reviewed by the City of College Station prior to sending to FEMA. Please allow for our review time in the scheduling of that submittal. Thank you for your cooperation. The Contractor's signature on the development permit. We have the completed application and will issue the development permit once the $400 fee is paid. ($100 application fee + $300 infrastructure inspection fee = $400 total.) We are still working with the ..project engineer at Carter-Burgess on the outstanding drainage issues.. I've included a copy of a letter to Jason Eiken that explains some of these- issues in more detail. Please be aware that no work is allowed in .the University Drive right-of-way until the Texas Department of Transportation. (TxDOT) issues the necessary permit. Suite 300 Houston, Texas 77007-5833 .Dear Mr. Iken: We have received comments back from TxDOT on the Utility Permit to construct 2 manholes and a Type B headwall in TxDOT's right-of-way. I have listed below the concerns expressed by TxDOT that need to be addressed by Cater & Burgess as soon as possible. The permit submitted .references noY only 2 new sanitary sewer manholes but a new sewer line and manhole. TxDOT does not have, nor do we have, construction plans for the off-site sanitary sewer improvements. that must be completed prior to issuing a certificate of occupancy for Marriott Townplace Suites. When the construction plans for those improvements are submitted, a separate TxDOT permit should be submitted with those construction plans.. Also, the permit application submitted previously will need to be modified, or a new application submitted that does not include the. off-site improvements. Headwalls should not be used. A sloped. end treatment (SET) is the proper method, according to TxDOT Design Manual, page 4-43. Please submit changed plans reflecting an SET rather than the Type B headwall. The widening of FM 60 will require minor lengthening of the TxDOT pipe crossing FM 60, therefore the outfall pipe from thee. Mamott Townplace Suites should be placed at an elevation that will allow a future connection to TxDOT's pipe to work well. The location and elevation, as can-entry shown on the plans, is not desirable to TxDOT. Several :options exist to remedy the situation such. as relocating the outfall closer to the ROW line, lowering the outfall elevation, or a combination of both. Keep in mind that several utility conflicts exist in this area such as: ,sanitary sewer fine, water main, water valves, and a fire hydrant. Another concern"is the velocities at the outfall'into TxDOT's ROW. It appears from the SWMM print outs that the velocity will. be between 3 and 4 feet/sec. TxDOT would .like verification of that velocity to assure that no riprap is needed for erosion protection. . The Applicant is the HAMM Corporation, developers of the property. Their letter of request is attached. The applicant is requesting that access on Lincoln to his site be located 123 feet from University Drive. Under the City's Driveway Ordinance, the proposed driveway is required to be a minimum of 185 feet from the intersection. However, the ordinance also allows engineering. judgement to override this spacing criteria if warranted by specific traffic conditions. Staff believes that the proposed 123 feet distance as well as the ordinances 185 feet minimum distance are both too .close to .the University Drive intersection. The location of the driveway as proposed would .likely: impact traffic flow on Lincoln and could potentially queue vehicles back into. the University Drive intersection, During peak traffic times, vehicles. on Lincoln attempting to turn left into the proposed driveway could be blocked by vehicles on Lincoln waiting for the signal at University Drive. A vehicle stopped. on Lincoln waiting for traffic to clear so it can tum left. into the proposed .Marriott driveway would stop all westbound traffic on Lincoln since this street is not wide enough for other vehicles. to go around. on the right. Staff recommends that access on Lincoln to their site be :located no closer than 300 feet to University Drive. Staff also recommends that the applicant re- i i I, PRC Memo, Page 2 establish cross access between his site and the proposed Microage site to the east. This cross access .would allow improved accessibility to both sites, particularly in light of the future widening of University Drive which will include medians. The applicant has previously entered into a Development Agreement with the City of College Station which states. that only one driveway to the site would be allow on Lincoln Avenue. The City Engineer is authorized to order and effect the removal or reconstruction of any driveway approach which is constructed in conflict with street structures. The cost of reconstructing or relocating such driveway approaches shall be at the expense of the abutting property owner. (8) Permits (a) Any plans submitted for building. approval which include or involve driveway approaches shall be referred to the City Engineer or his ,designee for approval before a building permit is issued. (b) A written driveway ,permit for a new development shall be not issued or required. Approval of driveway location and design for new properties and other developments on a building plan or site plan shall be considered the permit for driveway installation. (c) Any property owner desiring a new driveway approach or an improvement to an existing driveway at an existing residential or other property shall _make application for a driveway permit, in writing, and designating the contractor who. will_do the work, to the City Engineeror the building supervisor, accom- panied by a sketch or drawing showing clearly the driveway, parking area, or doorway to be connectedand the location of the nearest existngdriveways on the same and opposite sides of the roadway. The City Engineer. will prescribe the construction procedure to be .followed. (See the. Building Code for contractor's bond and permit requirement, for work on public property.) _ (d) A permit or building/site plan approval as per the procedure of either 8(b) or 8(c) shall be required for the location. of all driveways which Provide for access to property. Dear Jonathan, Per our meeting on-site last week, I have researched the issue regarding the easement dedication for the off-site sanitary sewer fine. As discussed I've looked into whether a temporary certificate of occupancy could be issued prior to having, these easements in place. It is preferable for all parties that the easement dedication occurs prior to issuance of any C.O. If this is unattainable, we will entertain a temporary C.O. with the following conditions: • A financial security is posted in the amount of $50,000 to cover the necessary title reports, appraisals and easement purchase by the City. (This security can be posted. in any form. outlined in the Subdivision Regulations for public infrastructure.. It will be returned to you once the necessary easement is dedicated to the City of College Station.) • Amend the development agreement to include. provisions and time frame for obtaining the easement along with. reference to the financial security mentioned above; It will be your responsibility to reimburse the .City for all costs associated with amending the development agreement. including staff time, etc. A draft .development :agreement must be submitted within 15 days of issuance of the Temporary C.O.' for the City to review and schedule for an upcoming City Council meeting. • The one year warranty period for the off-site sewer line will not begin until the acceptance date of the line by the City. Again, we will not .accept the line as public infrastructure. until the .easement is granted. HAMM's insurance coverage shall be primary insurance with respect to CITY, its officials, employees and: volunteers. Any insurance or self-insurance maintained. by CITY, .its officials, employees or volunteers, shall be considered in excess of .the HAMM's insurance and shall not contribute to it. Certificates of Insurance and endorsements shall be furnished to the CITY and approved by CITY before CITY issues a Certificate of Occupancy. A Property Insurance Policy shall be required. The following general requirements shall be applicable to the policy: A. Property insurance shall be written by a carrier with an A: VIII or better rating in accordance with the current Best Key Rating Guide.. B. Only .insurance carriers licensed and admitted to do business in the State of Texas will be accepted.. C. Deductibles shall be listed on the Certificate of Insurance and are acceptable only on a .per occurrence basis for property damage .only. 'The deductible limits shall not exceed Ten Thousand Dollars ($10,000.00). D. Claims Made Policies will not be accepted. E. The coverage shall contain no special limitations on the scope of protection afforded to the City, its officials, employees, or volunteers.. F.
