It is located adjacent and to the south of Silk Stockings. Of course, zoning, platting, building process, etc. came up. After the meeting, Nat & I were talking, and we wonder if there is some way people. can. develop in that. area and get some relief from some of the. requirements for a certain. period of time -- until development takes place on either one side or the other side of them. The extension of utilities to this particular tract will be so very expensive there is no .way Steve can use his property. We realize that it's "buyer beware" allover, but that entire triangle has signs along the highway that indicates it's zoned for commercial use. Steve wanted to finish out the pole building that has a roof only so he can store boats & RV's - probably about l0 of them, He wouldn't need sewer for this use, and he would have to ask for a variance to the fire hydrant requirement since he wouldn't need water for anything else. He bought 6+ acres, and as long as he didn't want to do anything with the property, it is a legal subdivision of property since it's .zoned A-O. Now he's decided he would like to do something commercial with it to help pay for it. He, of course, would have to rezone it to commercial. RE: platting, now that I've put this in writing, I guess he wouldn't have to plat any more than his own property - but therein comes the problem. To do what he wants to do he would have to extend water, sewer, electricity, drainage, etc. with the subdivision plat! Does anyone have any good suggestions regarding this. I'm sure we're going to have a bunch of these questions in this area before too long. Also, he has a real problem with the proposed land use plan showing all single family residential along SH6 south', and Sabine said she was going to talk to Jane about this before the meeting; tomorrow and get back with him, so he can attend any future public hearings to make his opinion known. We mustn't forget to follow through with this. During my research, I found the following: - The property was annexed on October 13, 1983. Aerial photographs taken in January 1982 showed no buildings or storage on site. - On October 14, 1983, a photograph was taken of the site (see attached copy). The photo and the accompanying documentation (see memo dated November 21, 1983) provide evidence that no building existed on the property prior to annexation. - During the following 30 day period, two wooden buildings and three stalls were constructed in preparation for a flea market. These activities were carried out without authorization. Violationsduring this time included failure to obtain building permits, failure. to obtain site plan approval (including all applicable parking and landscaping provisions), and failure to comply with the zoning use restrictions of the A-O Agricultural/Open zoning district. - The owner of the property at the time requested a rezoning of the. property from A-O'to C-1 General Commercial. Council passed Ordinance No. 1497, which rezoned the property with the conditions that 1) the zoning remain on the property for a period of ten years only, and 2) if building permits are required, the zoning must come back before Council for review. - No other steps to obtain site plan review approval or building permits were pursued by the owner. - Currently, the property is occupied by one of the three stalls that were constructed for the flea market. Some outside storage of pallets, dirt, and vehicles is also present. As a resralt of this review, we have come to several conclusions regarding your property. 1. The property has no legal nonconforming status, nor any authorization from the City for any use other than pastureland. The property is therefore not entitled to City services unless a building and an electrical permit are sought and issued. Home of Texas A&M University ~. " ,., . 2. As a part of the building permit process, we must receive a site plan; ir~.ude the dimensions of the structure, the distances from all property lines, and a description of the use of the structure. 3. Ordinance No. 1497 is void due to the fact that is was passed with the intention that it be tied to a single use (the flea market).. Such an action constituted "contract zoning", which is illegal in this state: Therefore, the entire action is void, and the property has reverted to its original A-O classification. 4. Only limited storage within the structure would be permitted, provided a building permit is sought and issued. The A-O zoning district does not list storage as a permitted use. Storage that is accessory in use to the principal use of the property (in this case that use is pastureland) would be acceptable. In other words, storage for your own personal. use (such as hay and cars that are not considered junk vehicles under City Ordinances)may be permitted. Storage related to a business would. not be permitted. Renting storage space requires a change of zone to at least a C-1 class, and would require complete site plan review. 5. Outside storage of items related to an agricultural use (see the list of A-O uses) that are not related to' other commercial uses would be permitted. Please note that any outside storage: that would constitute a "nuisance" under our City Codes (see attached) is not permitted. Regular Item Consent`Item Statutory Item Item Submitted By: Council Meeting Date: Director Approval: City Manager Approval: Jeff Tondre, Graduate Civil Engineer December 10, 1998 ~~ , Item: Request for oversize and. additional participation, in the amount of $20.8,322.00, for extensions of an 18 inch water line and an 8 inch sanitary sewer .line along the east side of State Highway 6 to be constructed with tharley-Davidson Site; and a variance to the City Subdivision Regulations, Section 9-D.1` ~ao~ersize participation in a sanitary sewerline of 8 inches. Also a variance request to t1S.e Chty Subdivision Regulations, Section 9-C.5 and 9-D.5 regarding the timing. of 1Sayment of oversize participation. Item Summary:. This request for oversize participation is being made after the preliminary plat ,was approved by the Council on'August 27, 199$. The site requires that water be extended 2,460 feet and sanitary sewer be extended 1,456 feet to service the development. This proposed water extension will cross along 1,028 feet of the Luther Jones Tract (the farmer landfill site), 1,082 feet of the Barker Tract, and extend 296 feet across the site. The applicant's engineer has determined that the Harley Davidson's site wonld require an 8 inch. water' line,. to service the development. The estimated cost difference between an 8 and 18' inch line is $112,197.00. However, the applicant is requesting. that the City fund 100% of the construction cost of the line along the Luther Jones Tract. It is unlikely that the developer will be able to be reimbursed.. by subsequent development on the Jones tract, the City's closed landfill site. They are also requesting 100% participation for the line crossing the'..Barker Tract rather than utilizing the city's water and sewer main. reimbursement ordinance, because they "do not want to get involved with. placing liens on the properties, and possibly waiting years to recoup the costs." This results in a total request of $172,033 for the water line. The proposed sanitary sewer extension will cross 78 feet of the Luther Jones Tract (the former landfill site), 1,028 feet of the Barker Tract, and extend 296 feet across the site. Under Section 9-D.1 of the Subdivision Regulations, the 8 inch sanitary sewer would not be eligible for oversized participation.. However, the applicant wishes the City to participate in 100% of the construction cost for the Luther Jones Tract and Barker tract ___ for the reasons stated above. The-total request is for $36,286 for the sanitary sewer extension. The following table summarizes the construction costs, normal oversize participation costs, and the amount requested by tract. This would require a variance from City Subdivision Regulations, Section 9-C.5 and 9-D.S. Item Background: The preliminary,plat for HHarley Subdivision was approved by Council on August 27, 1998. The applicant is proposing a 14,000 square foot retail store _ to be located in Block One, Lot One of the Harley Subdivision. There is currently an 18 inch water line along the east side of State Highway 6 south of this project proposed to be extended to and through this site. The 1995 city water system masterplan indicates the need for a major water trunk line. on the east side of Highway 6 to loop the water system. The line was originally proposed to be extended along Rock Prairie.. Road'. 'However, due to the timing of the growth along Highway 6 in comparison to Rock Prairie Road, this line is now proposed to be extended along Highway 6 from Greens Prairie Road to Sebesta Road. This extension would include 2,406 feet of the total 13,600 feet needed to complete the loop. The extension of this water line at this time will precede the availability of sanitary sewer service for the service area by approximately 3 years, which will under utilize the line for that time. A cost analysis was performed by staff which showed the cost savings. of .approximately $80,000 between oversize participation now versus replacement of the line at the time sanitary sewer service became available for the service area (assuming within 5 years). Cost for utility installation. is generally born by the land developer which utilizes the line. When a utility crosses an undeveloped property to be extended to a developing tract, the current site developing shall bear the cost and be eligible for reimbursement from the undeveloped property at the time that property is developed (Section 11-3.A of the City Code of Ordinances). This is an option available to the developer-for cost .recovery from the Barker Tract. However, this alignment also passes through the Luther Jones Tract, -• __- _ which is the site of the former landfill: Development v~n11 be limited on .this property by Texas Natural Resource Conservation Commission (TNRCC) regulations.. Because of this, it is unlikely that the developer would be able to re-coup utility :installation cost from Luther Jones Tract. __ -~.. Budgetary and FinanciaLSummary: Funds are available in the Water Capital Projects Fund. Staff Recommendation: Staff recommends approval of oversize participation not to exceed'the amount of $140,841.00 for the construction of the 18" water line. This will cover I00% of the construction cost of the waterline through the Luther Jones Tract {former city landfill site) and normal oversize participation for the cost difference between the line. sizes for the Barker Tract and Harley Subdivision. Staff does not recommend' approval of requested participation in the sanitary sewer line, nor the request for full participation in the waterline through the Barker Tract. Pursuant to Chapter. 9, Section 9-C.8 of the Code of Ordinances, the proposed request exceeds30% o of the engineer's cost estimate, and thus the project must be placed out to public bid and must comply with the competitive sealed bidding procedure contained in Chapter'; 252 of the Local Government Code. Exceeding 30% does not require the project to be considered. a capital improvement project (i.e. the City does not have to build it). Neither is the City prohibited from handling the protect as a CIP. Council Action. Options: 1. Approve. 2. Modify. 3. Deny the request. 4. In order to process your request, the following additional information is required: • An impact .analysis to justify the .adequacy of an 8" waterline to serve the site. • A construction cost. estimate for an ~" waterline through the Barker Tract. • A construction cost estimate for an 8" waterline through the Luther Jones Tract. • Reasons why the Harley-Davidson site does not desire to pursue water and sewer reimbursement for the Barker Tract via the Reimbursement for the Extension of Water and Sewer Mains criteria (Chapter 11, Section 3A of the Code of Ordinances). After placing the cross section elevations on the .plat, it is evident that the flood plain has changed from 276 to 275 at the point where the 276 contour intersects with the approximate floodplain. I feel that showing the floodplain along these contours does not correctly represent the approximate floodplain line, as the floodplain is based on a sloped water shed model instead of a flat model. After reviewing this letter, if you feel the changes are still necessary, I will be happy to discuss this matter, and if necessary make any valid changes to comply with the. City's request.
