Greg noted on the revised plat that the floodplain boundary was determined by a NDM study that the
owner performed in 1994. MDG just superimposed the floodplain on the plat. I think we should ask fora
copy of that study. Paul Clarke had copies of his bills to NDM with him, but not the study.
Just thought I'd let you know in case it wasn't clear on the plat.

Thank you for your assistance in this matter. Both you and Butch Willis have been a big help in
getting this sorted out. Based on our conversations, I understand the following:
1) The line roughly parallel to Harvey Road and approximately 150' south of it, across
proposed Lots 2 and 3, is abandoned. This is the old ductile iron line, denoted Line A on
the sketch.
2) The line that runs about a 60° angle away from Harvey Road, across proposed Lot 3, is
also abandoned. This is the old VCT line, denoted Line B on the sketch.

Dear Mr. Clarke.
This brief letter report describes the procedures used and the results of a floodplain analysis for the subject 9.77 -acre
net.
PROCEDURES
The revised existing condition Federal Emergency Management Agency (FEMA) HEC -2 models for Wolf Pen
Creek and Tributary "A" to Wolf Pen Creek were rerun on the newest version of the HEC -2 progrDm. No
differences in water surface elevations for the 100 -year flood were detected in either model.
A topographic map of the 9 ,77 -acre tract was provided to NDMCE based on a field survey in December 1993. The
left overbank of two cross sections on Wolf Pen Creek was modified to reflect the new topography on the 9.77 -acre
tract, In addition, the model was modified to include the now existing amphitheater, weir overflow and lake.
Although the 100 -year water surface was reduced by 2.50' upstream of the lake, essentially no redaction in water.
surface elevations occurred at the 9.77 - acre tract. Since no change in water surface elevations occurred in this
reach, the floodway limits were maintained as per the FEMA model.
Based on the new topographic mapping on the 9.77 - acre tract, the cross sections on Tributary "A" downstream of
Harvey Road were modified to reflect existing conditions. The starting water surface elevation was determined by
interpolation of the water surface elevations on Wolf Pen Creek. This resulted in an approximate reduction in the
starting water surface elevation of one -foot. A combination of the new topography and a lower starting elevation
resulted in a narrower floodplain and floodway width than the revised FEMA Model for Tributary "A ".
The floodway for Wolf Pen Creek has the greatest effect upon the 9.77 -acre tract, An adjustment was made to the
floodway based on interpolation of floodway width between cross sections on Wolf Pen Creek. The same floodway
width was maintained between cross sections so as not to increase water surface elevations upstream, Because of
the meandering nature of Wolf Pen Creek, the floodway in this area could be located closer to the creek In
addition, it was assumed that clearing of the left overbank would be done to reduce the "n" value. Only the brush
and under story should be cleared, not trees.

Exhibit A is a work map for the 9.77 -acre tract. In addition to the topography, the revised floodplain and floodway
limits are shown for the tract. The results of this analysis are as follows;

1. 1.39 aces are out of the revised 100 -year floodplain.
2. 2,84 acres are out of the revised 100 -year fioodway.
3. If the 20 -foot strip is dedicated, the usable acreage is reduced to 2,50 acres.
4. If the tract is filled to the base flood elevation (existing 108 - year), the usable acreage is rcduced to
2.33 acres, This assumes that the toe of the fill slope is at the dedication line and extends to the
top of fill at a 4:1 slope.
The acreage in 4, above can be increased by utilizing a retaining wall at the dedication line or a combination of a
low wall (say 3) and fill on slope. The ordinance prohibits placing fill within the 20 -foot strip.
The Stormwater Management Ordinance that I have, dated April 1987, indicates the lowest floor shall be elevated
one -foot above the crown of the nearest street or above the depth specified on the community's Flood Insurf,nce
Rate Map (FIRM. I have indicated the existing 100 -year water surface elevations on the work map at different
locations for developing a grading plan,
No attempt was made to determine the amount of fill required to remove the developable portion of the site from the
floodplain. This amount could vary considerably depending on the site layout and grading plan developed.
Just for your information, if all of the proposed lakes were built and the corridor developed according to the Master
Plan, a reduction in the 100 -year water surface of 2.5 feet would occur at this site.

This is in reference to a letter dated December 5, 1990, from Mrs. Deborah
Leslie Keating, P.E., Project Engineer for the City of College Station, to the
Federal Emergency Management Agency (FEMA), requesting a conditional Letter of
Map Revision (LOMR) for the proposed Wolf Pen Creek Corridor Master Plan in
the City of College Station. This proposed project consists of a series of
eight lakes, channel modifications, and the clearing of the overbank areas
along Wolf Pen Creek from State Route 6 Bypass to Texas Avenue. Transmitted
with the aforementioned letter, was a technical report prepared by Nathan D.
Maier Consulting Engineers, Inc. (NDM) entitled Floodplain Evaluation.
Proposed Conditions Wolf Pen Creek, College Station. Texas dated May 1990.
This report included the following:
• A letter from Mr. Ery A. Meyer, P.E., of NDM, to Mr. David Pullen,
P.E., College Station City Engineer, dated June 6, 1990, transmit -
ting the report.
• A written description of the scope of the proposed project and the
methodology used to analyze the project's effects.
• Copies of the HEC -2 backwater computer model, dated May 4, 1990,
for the 10 -, 50 -, 100 -, and 500 -year floods for Wolf Pen Creek,
Wolf Pen Creek Tributary A, Wolf Pen Creek Tributary B, and Wolf
Pen Creek Tributary C, used to prepare the preliminary Brazos
County, Texas, and Incorporated Areas Flood Insurance Rate Map
(FIRM), dated July 23, 1990.
• Copies of the HEC -2 model for the proposed floodway conditions for
the four streams mentioned above.
FEMA requested additional information from Mr. Meyer in letters dated
January 9, 1991 and February 12, 1991, and received the following items: a
copy of the July 23, 1990 preliminary FIRM for Brazos County, Texas, and
Incorporated Areas with the project area indicated; and copies of the HEC -2
model, dated February 22, 1991, for the proposed 100 -year flood natural and
floodway conditions model for Wolf 'Pen Greek and Wolf Pen Creek Tributaries A,
B, and C.

In response to phone inquiries for additional information, we received a
letter from Mr. Meyer dated May 13, 1990, that completed all of the necessary
requirements to process this conditional L.OMR. Fees necessary to process this
conditional L.OMR (a total of $1,700.00) have been received.
Please note that our review of this project was based on the data used to
prepare the July 23, 1990 preliminary Brazos County and Incorporated Areas
Flood Insurance Study (FIS) and Flood Insurance Rate Map (FIRM) , which
included revised flood hazard information for Wolf Pen Creek and its tribu-
taries. This preliminary FIS and FIRM is expected to be finalized later this
year.
Based on our review of the submitted information, we have determined that the
proposed project meets the minimum floodplain management requirements of the
National Flood Insurance Program (NFIP). If the project is completed as
proposed, a revision to the Brazos County, Texas, and Incorporated Areas FIS
and FIRM would be warranted. As reflected by the aforementioned technical
data, this revision would show a realigned floodway for Wolf Pen Creek and
Wolf Pen Creek Tributaries A, B, and C that would be coincident with the
proposed lake boundaries and the areas to be used as a "greenbelt parkway" in
the park setting proposed by the Wolf Pen Creek Corridor Master Plan. In
addition, the Base (100 -year) Flood Elevations (BFEs) for Wolf Pen Creek, and
Wolf Pen Creek Tributaries A, B, and C would be reduced by a maximum of 3.80
feet. Please note that future revisions to the FIS and FIRM, or restudies of
the flood hazards in this area, could modify this determination.
This determination is based on the 100 -year flood discharges computed in the
preliminary Brazos County, Texas, and Incorporated Areas FIS and does not
consider subsequent changes in watershed characteristics that would tend to
increase flood discharges. The development of this project and other projects
upstream could result in increased flood discharges, which, in turn, could
result in increased 100 -year flood elevations,. Future restudies of your
community's flood hazards would take into account the cumulative effects of
development on flood discharges and could therefore establish higher 100 -year
flood elevations in this area.
This conditional L.OMR is based on minimum floodplain management criteria
established under the NFIP. Your community is responsible for approving all
proposed floodplain development, including the project upon which this request
is based, and for ensuring that permits required by Federal or State law have
been received. State and community officials, based on knowledge of local
conditions and in the interest of safety, may set higher standards for
construction or may limit development in floodplain areas. If the State of
Texas, Brazos County, or the City of College Station has adopted more
restrictive or comprehensive floodplain management criteria, those criteria
take precedence over the minimum NFIP requirements.

NFIP regulations Subparagraph 60.3(b)(7) requires communities participating in
the program to "assure that the flood carrying capacity within the altered or
relocated portion of any watercourse is maintained." Without proper mainte-
nance, such as the regular clearing of a channelized stream, channel modifica-
tion projects will, in time, fail to function as designed, thereby recreating
the flood hazard that they were intended to mitigate. Therefore, upon
completion of the project, your community must uphold its responsibility for
assuring that the modified channel is maintained in order to preserve its
design function. Please be aware that FE4A may request that your community
submit a description and schedule of channel maintenance activities.
Also note the requirements for floodway revisions as outlined in NFIP regula-
tions Subparagraph 65.7(b)(1), which states that when a floodway change is
proposed a copy of a public notice distributed by the community stating the
community's intent to revise the floodway, or a statement by the community
that it has notified all affected property owners and affected adjacent
jurisdictions, must be submitted to FEMA. This requirement must be addressed
when requesting a map revision to reflect the effects of the completed Wolf
Pen Creek Corridor Master Plan
Upon completion of the proposed Wolf Penn Creek Corridor Master Plan, your
community should request a revision to the effective FIS and FIRM. The
revision request must include the data listed below:
1. Evidence of compliance with NFIP regulations Paragraph 65.4(b), t
which states that "all requests for changes to effective maps
must be made in writing by the community's Chief Executive
Officer (C£0) or an official designated by the CEO. Should the
CEO refuse to submit such a request on behalf of another party,
FEMA will agree to review it only if written evidence is provided
indicating the CEO or designee has been requested to do so."
2. "As- built" plans of the Wolf Pen Creek Corridor Master Plan,
certified by a registered professional engineer.
3. HEC -2 hydraulic models of the 10 -, 50 -, 100 -, and 500 -year floods
and floodway representing "as- built" conditions. The elevations
in the "as- built" HEC -2 models must coincide with the effective
FIS elevations at the upstream and downstream ends of the
analysis.
4. Delineation of the revised 100- and 500 -year floodplain
boundaries, the floodway, and the locations and alignment of the
cross sections and flow line used in the hydraulic model.
a. This information should be shown on a map of suitable scale
and topographic definition to provide reasonable accuracy.
b. All items should be labeled for easy cross - referencing to
the hydraulic model and summary data.

5. Evidence of compliance with NFIP regulations Subparagraph
65,7(b)(1) regarding floodway change notification, as previously
discussed.
6. Source data and engineering documentation for the previously
mentioned items, as well as a bibliographic list of other sources
of-information used.
We have enclosed a copy of Part 65 of the NFIP regulations, which further
describes the nature and extent of the material needed to support a request to
revise an effective FIS and FIRM. Compliance with the criteria outlined in
this document will expedite FEMA's review process, thus allowing the effective
FIS and FIRM for your community to be revised as appropriate, in a timely
manner.

Dear Greg,
This letter is to follow up our telephone conversation on Thursday, January 29, 1998 concerning
the revised preliminary plat. The following is a list of comments and concerns that must be
addressed prior to proceeding to the Planning and Zoning Commission:
( 1) Submit the 1994 Nathan D. Maier hydraulic study referenced on the preliminary plat to be
reviewed by staff.
( 2) The " Floodway Line & 20' Dedication Line" shown along the rear of lots 1 e 3 cannot be
the same line.
(3) The access easement on lot 4 should be lined up with the existing driveway or submit a
proposed driveway layout for all four lots to be reviewed and approved by staff. (The 25'
private access easement cannot be located entirely in the 24' landscape reserve because a
limited amount of contiguous pavement is allowed between landscaped areas.)
(4) Why does the floodway line end between lots 3 and 4? Show the floodway line as it
continues through lot 4.
(5) Submit a separate drawing showing the location of the existing parking lot and building on
lot 4 and their relation to the floodway and dedication line. Are you dedicating floodway
+ 20' or something else?
( 6) Expand the general note concerning the 1994 Nathan D. Maier study to reference the
approximate floodway and floodplain lines until approved by FEMA and explain the
required LOMR.
( 7) Show the 20' dedication line on the reserve tract. This 20' strip does not have to be
dedicated now; however, it must be shown.
( 8) Remove the note "Not Included" on the reserve tract. The 2.3 acre reserve tract must be
a part of this preliminary plat.
( 9) Submit additional information concerning the 15' sanitary sewer line to be abandoned.
Verify that the line is currently not in service.

(10) The shared access easement on lot 2 should continue to provide access to lot 1. An
additional curb cut may be allowed to lot 1 at the time of site development.
(11) Show the floodplain line as a solid, bold line that is consistent throughout the entire plat.
(12) Clarify what is happening with the floodway and floodplain on the 2.3 acre reserve tract.
Why is the dedication line shown where it is given the location of the floodway? When
will the dedication occur for the reserve tract? (Depending on the answers to these
questions, a drainage easement may be required on the reserve tract.)
Staff will include in their staff report to the Planning and Zoning Commission that the 2.3 acre
reserve tract will obtain water service from the other side of Harvey Road. Please submit the
above mentioned information along with 13 copies of the revised Preliminary Plat in order to
scheduled for a Planning and Zoning Commission meeting. Submit the hydraulic study as soon as
possible to allow staff time to review calculations.

i don't remember if the property we looked at a couple of weeks ago included
a one -acre tract immediately to the west of the condos but i think it did
(the piece with stallings running thru it).
i've been talking to the owner of that one acre, chris rhett, who bought it
from don ganter. there is evidence to show that when don bought it, it was
an illegal subdivision. so the one acre tract is a part of the entire
parent tract,, the rest of which i think is still owned by paul clark. so i
would think we would require the lot to be included in the plat (final plat
even) and rhett will have to be a signator.
there has been some discussion between clark and rhett regarding the future
plans for the '1 acre apparently ganter had signed some power of attorney,
which expires in about a year, that gives clark's attorney the right to
dictate what can be done with that tract. clark has threatened to use the 1
acre as the detention area for the rest of the "development ", whatever that
is. or perhaps he will use it all for parking or landscaping. at any rate
it sounds as if our friend has sold off an illegal lot and is reserving the
power to render it unbuildable! hey, I'm in the wrong business, eh? I'd
have a lot more fun keeping the little people down!
well, i told rhett that in my opinion he would have to be a signator to the
final plat, and if he will not sign a plat, that this would have to go as a
variance (like first american did, didn't they ?). at any rate he would have
an oportunity before council to get his own attorney involved (he's had
discussions with ......eeek i can't remember now but his legal eagle anyways
- and it seems as though the power of attorney has holes in it). i told him
the city would not let anyone plat an unbuildable lot. so the important
question is will we require the one acre to be included in the final plat?
i think it should but we may have some "holding hostage" precedence that
gets too complicated for my feeble brain.
so this is fyi with that point to ponder...

because the power of attorney is bogus, then it is his responsibility to get
that resolved privately. he knows that at the staff level we have had some
discussions regarding this area. he does not yet know why. we do not have
a file on it yet, but I'm worried that he's gonna come back when the legal
stuff starts rolling and claim that he should have been informed. i
promised i would keep him informed as much as i legally could...

I started looking for the final plat file for West Wolf Pen Creek and, of course, can't find one because we
don't have one ! At least, if we do, I can't find a file.
If, indeed, we don't have one, should we be reminding Paul Clarke so they don't think they can get
building permits for these restaurants and then find out when they are ready to build that they can't?
I'm gathering some information for Jim to give to Paul today, so it might be a good time to remind him.
