Stewart dropped this plat off himself and expla ned that he

to change the black line of the-phase to include the entire
acreage,.. with the subject tract being lot 1 and the rest being
a reserve..tract, if that would be better.. iie, needs advice
then as to how to divide the reserve .tract - whether it
needs to be a -replan, a vacation and replat, a final plat or
just what. Since Sabine i-s learnr.ng=~`~o be the plat guru,
.thought maybe she ~'..? should have input on .this..
Also, Stewart said the conditions of access at the. time of
approval of the preliminary plat specified to have 2 accesses,
one which was to go away when the median is put irr Univ. Dr.
Instead of that, he chose to reconfigure the 2 acre lot and.
move the shared access further to the east (I think), and
says it lines up as much as possible with the Shoney's -drive
across the street. l told h~i::m he"would have to show that
driveway so we can make a better judgment call on whaf he

Dear Mike,
Below. is a punch list of items that need to be addressed .prior to issuance of a Development
Permit and Certificate of Occupancy on the above mentioned Baymont Inn.
Development Permit: (Prior to issuance of a development permit, the following items must be
addressed.)
(1) Issuance of the TxDOT Permit. for the work to be -done in the University Drive right-of--way.
(Staff submitted- this permit along with the approved civil site plans on Monday, March 1,
1999 to the local TxDOT offices.)
Certificate of Occupancy: (Prior to issuance of a certificate of occupancy, the ,following items
must be addressed)
(1)-Dedicate the off site private drainage-easement for the detention. area. (At .this time, the
developer must also include the maintenance entity of this facility.).
(2) LOMR must be approved by FEMA. (In discussions with FEMA per Veronica. Morgan's
letter to you dated November 5, 1998, FEMA has indicated LOMB approval should be a
condition of a C.O. The LOMB has been reviewed by City staffand will be FedEx'd to FEMA
on Tuesday, February 23, 1999.)
(3) Dedicate the 15' private access easement on the reserve tract for the proposed driveway.
(This easement is 'being. returned to you by our Legal :Department. Since this is a private
easement that does not contain. anypublic infrastructure,. it is your responsibility to file. Once
filed, provide a copy of the easement and/or the volume and page number on the .approved site
plan.)
(4) Dedicate a 3'0' public access .easement to the creek for maintenance.

(5) Dedicate an ofd-site public drainage easement to cover the creek in its proposed location.
(6) Dedicate the off-site public utility easement for the waterline.. (Stewart Kling submitted the
metes and bounds description and associated drawing of the utility easement. Once the
Easement Information Sheet is submitted' with the necessary attachments, staff will process
the easement and file it for record.)
Once staff has reviewed the architectural plans for the new hotel, I will be able to put together a
punch list for the issuance of a building permit.
We also suggest having a preconstruction meeting with staff to discuss the off-site elements and
how they will impact the issuance of a Certificate of Occupancy for Baymont Inn. Issues that
need to'be addressed are when will the channel be constructed, who will.. do it and how will it tie
into the pond work for Levtex, (The pond cannot. be constructed prior to the channel. work
because he proposed pond location is `m the middle of the existing creek.)- Staff. has time
available on the afternoon of Tuesday, .March 2, 1999 to meet with yourself, a representative of
the' Wheeler property and. appropriate engineering staff.

.Below are ,the .questions that .you asked in your .letter of"October 21; 1998 and our
response:
1. Can we get approval for the Final Plat prior to FEMA approval?
Yes, according to FF.MA even though this is an unnumbered "A"zone and their
regzrlations require, because. of the size of the.' platting„ that this area be studied
and submitted to them, we can approve and file the final plat for record prior to
their approval of the study. They did say thaf the floodplain line and floodway
lines will be subfect to their .approval. .Because of our discussions, I would
suggest that such wording be placed on the plat.
2. Can we get a building permit prior to FEMA approval?
Yes, due to the topography on the site and the fact that- the .location of the
building. is we1L beyond the approximate graphical floodplain line and the
proposed studied line FF'~fA has. said that with that information and the height of
the proposed building finished floor (+10) we cauld issue building permits.
3. Is this building permit in any way conditional to FEMA approval? If we
were to start construction on oursiteand FEMA were to reject the report submitted
by Kling; does this have any impact on our site? Could grades change (finish floor,
parking lot, etc.)? Could FEMAS response create additional construction cost to
our site?
Perhaps to all questions. The one item. that FF_MA said that we must disclose to
you is that if for some reason your finished floor ends up being less .that one foot
above the 100year base flood elevation, as approved by FEMA, then you would
be required to floodproof your structure to the-one foot plus elevation. This is
pretty far fetched with the fact that your finished floor is now set crt en feet above
the proposed 100-year flood elevation, but it is a risk that FEMA said we must
disclose.

4. We have been informed by Stewart that the drainage report for FEMA has
been returned to you and ..that the remarks you had made on his .previous report
were minimal. Has this report beenretut-fied to you? When do you feel. that if will
be ready to submit to FEMA?
It is rue that we have reviewed the .report to FF'i1~fA some time .ago and that our
comments were minimal. No, the report has not been returned to the City as of
this writing.. In my latest conversation with Kling Engineering their estimated
time. frame for resubmttal at present is unknown. I have :asked for. a time frame
but as yet have not received any further information.
5. The .40 acre detention area between our site and the .proposed floodway as
defined by Kling. on the Final Plat has been agreed to- be :.purchased by our
company.. We were intending to have this platted at a later date.. This. date to be
determined when Wheeler develops the remaining tracts. Is this okay with the city:?
We will allow a separate instrument easement to cover the detention area with a
maintenance entity to be named. The City will need to receive some soz•t of
documentation to assure that someone is responsible for the maintenance and
what level of maintenance that will include., So, yes we will allow you to plat if at
a later date but it will need to have a separate instrument easement on it now.
6. Assuming that we can get Final Plat approval prior to FEMA approval
(asked in question 1). Can we amend the Final Plat at a later date to include the
detention area so that we get Final Plat approval for the overall acreage?
Yes, you can amend the final plat at a later date to add the detention area and if
the floodplain and floodway lines have changed from. the: original fried copy. those
could be amended as well.
7. If we cannot get Final Plat approval prior to FEMA approval can we amend
the Preliminary Plat at a ater date to include the Detention Area so that we can get
Final Plat approval for the overall acreage?
Not applicable.
There is one more bit of information that I will .pass onto you. In discussions with
FEMA, it appears that we will need to make a condition of the certificate of occupancy
that the LOMB is approved by FEMA. Since. this channel work will most likely be done
.prior to the building or at least concurrently with, this should not pose,a problem unless it
is not submitted to FEMA`in a timely manner.
I hope that these answers help. I apologize for the delay but FEMA has .most all of their
mitigation officers in San Antonio helping with the disaster and it took quite a while to get
in touch with them.

This is in response to your October 15, 1998, construction plan submittal for the above referenced
subdivision.
The information submitted on the plans appear to meet all requirements for approval provided the
following items listed below are. addressed adequately in other reports: Please provide
documentation showing that these items have been addressed:
• The channel velocities in the drainage report are not excessive for the proposed lining type to
be used with regard +,o the steeper slope proposed..
• The drainage report addresses the requirement that the .concrete trickle channel carry one-third
(1/3) the,peak discharge of the five (5) year ultimate conditions storm.
• The revised channel configuration is included in the Conditional Letter of Map Revision
(CLOMR).

3) There will be 2 detention areas:

b.) along the existing channel leading from
the 36" .RCP crossing Lincoln. At the
time all or part of the 6.47 Acre Reserve
Tract develops detention will be constructed.

Subject:Wheeler 2 Subdivision - Outstanding Surety $15,245
Let me know if you have additional information or thoughts. Below are the (chronological) facts
I’ve assembled on the subject outstanding surety:
- In 1998, FW Bert and Mae Dean Wheeler Family Trust provided a check to the city in the
amount of $15,245.00 for the surety to cover the required 412 LF of 8 inch waterline (along
University Drive from Lincoln Ave to Phase 2 (Lot 1, Block 1). This surety was required to
file the Final Plat. A receipt records the check was deposited with the City.
- The subject Final Plat of Wheeler Subdivision Phase Two (single lot subdivision) was filed
on Nov 10, 1998 at the Court House as recorded in Volume 3308, Page 44. This Final Plat
was subsequently re-platted (simply expanding Lot 1 and renaming to Lot 1R) and filed on
May 28, 1999 in Volume 3490, Page 269.
- Development of Wheeler Phase Two did not occur in 1998 or subsequent years as anticipated
and the associated 8 inch waterline was likewise not constructed.
- In 2005, development was re-initiated on this lot by Kyle Legends I, LP with the
AmeriSuites Hotel project. This development determined however that a 12 inch waterline
was required for the proposed hotel (along the same alignment as the previously proposed 8
inch). The hotel (now Hyatt Place) and 12 inch waterline were constructed in 2005.
(Related note, there was a Development Agreement with Kyle Legends for over-sizing the
sanitary sewer line for this project where the city participated $5,454.)
- I did not find any reference in the 2005 development files referencing the 1998 surety.
Apparently, the development including the construction of the 12 inch waterline occurred
without the knowledge of the 1998 surety being held at the city.
- City staff in reviewing all surety files and funds now in 2012, has discovered the subject
1998 surety funds are outstanding. Due to the 12 inch water line construction, the 1998
surety is no longer needed by City.
- I would suggest the 1998 Surety be returned to developer that provided the funds.
