Dear Iblr. Smith: In response to your question regarding a portable concrete batch plat for the Universal Computer Systems project, Sec. 8.14 of the College Station Zoning Ordinances allows temporary buildings and equipment for uses incidental to construction on premises. Such temporary buildings and equipment shall not be located in the public street and shall be moved on the completion or abandonment of construction. We would consider the Business Center the "premise" for the purpose of multiple construction projects. A batch plant permitted under Sec. 8.14 could not be used for general retail or other sales of materials that were not used within the Business Center. I have forwarded your inquiry regarding possible sites for your portable plant off of the UCS tract to Elrey Ash,. Director of Economic and Community Development. VVe realize in 1998 there were conversations betweenyou, Mayor McIlhaney, and the former city maniager regarding an arrangement where the city would supply your water needs through the Wellborn Spdcial Utility District system.. This contract with Wellborn SUD is still being negotiated, and. every attempt is being made to reach a resolution withthat organization. A'meeting with representatives of Wellbe~rn was held as recently as yesterday on this subject. Realizing the difficulty of these contractnegations, for some time. city staff has been pursing other options... One viable option is to bore under State Highway C~,-and tap the old water line to provide water to your subdivision: We believe we can make the temporary tap by early summer, and when the new water line'is installed later this summer the city would move yoL~r tap to the new: line. Under this arrangement, the cost of the bore would be the city's responsibility. We understand that you'need water service now, o you can begin construction of the streets in South Hampton.. There are options on this matter also. Your street contractor can obtain water'from a temporary fire hydrant meter either in the Nantucket Subdivision or the closest fire hydrant that is part of the City of College Station's water system. Ms. Hobson, you have expressed concern with the City of College Station for delays with your development. However, from our perspective it appears your engineer and/or contractors have not followed through on :occasions over the last wo years. These include: • Your Sewer line contractor did not notify the.City prior to work beginning on the lines, eventhough the'city's subdivision regulations require inspection during this process. This results in .the City having to work with this contractor after the fact to perform the. necessary inspections. • Your water line contractor also failed to notify the .city before construction of the :water lines began. We have been told that you may have instructed your contractor that the City of College Station did not need to inspect the lines. Again, construction of these lines without inspection by the City is a violation of our subdivision ordinances.; We will have to work with your contractor for these inspections also after the fact: • A permit is needed from TxDot for the bore under State Highway 6 for your connection to the City's .sewer collection. system. It is the city staff's understanding that'you have an application for a permit renewal pending with TxDot. <Our experience has been these permits require one to three weeks for processing: and approval. Please be aware that you cannot file your final plat until your water and sewer lines.. are connected to an approved water distribution or sewer collection system, or you have P.O. The city has absolutely no control over how long Txdot takes to issue a permit for a bore. Let me take this opportunity to xemind you of several other requirements that you will need to comply with in order to complete the platting process: • Construct and receive acceptance from the City, or post a guarantee for all streets, sidewalk, and drainage facilities. This requires your contractor to notify the Citv staff so inspections can be made during the construction phase, not after the fact. • Pay the Park Land Dedication fee of $225.00 per single family lot. • Pay the sewer Impact fee associated with the sewer line you will be connecting to. The impact: fee is $243.38 per lot to be paid at he time the plat is filed.. • On June 11, 1998. the City Council directed staff to bring forward an oversized participation request for the sewer line bore at the time it was submitted by the developer. To date, no such request has been submitted to staff, and the city can not share in the cost of participation until the request is submitted and approved by City Council • The mylar of the final plat needs to be submitted which matches the plat that was approved by Planning and Zoning Commission, with the exception of any revision necessary of meeting the Commission's conditions of approval. Again, the city desires a positive resolution to these matters. It is to our benefit as well as yours far quality development to take place within the city. As has been pointed out, we are ready and willing to work with you to make this happen; and are willing to consider other options besides. those listed in the letter. However the criticism that the City is the reason you cannot start construction on your houses I believe to be unfair. It appears there are'still a number of items that your representatives have not addressed. Please let me know if you have any questions. Station has no objection to the use of water from the Wellborn Special Utility District distribution system for the purpose of testing the newly constructed water lines and street construction in the South Hampton subdivision. It is necessary. however, that the City of College `Station inspect and approve the disinfection and pressure testing of the system. ~, Immediately upon availability, the system must be completely disconnected from Wellborn and connected to the College Station public water supply. Upon connection, the system shall be flushed and appropriate bacteriological sampling conducted. Acceptable bacteriological results are required prior to acceptance by College Station. As with any construction in the City of College Station, please inform the City Engineering. at 979/764-3690 48 hours prior to any work being performed.. I have enclosedaheir letter. (See Attachment) My concerns with the South Hampton project are threefold: 1. A definite committment to water availability to the South Hampton development now. 2. At this,time there is an 8" Wellborn Waterline running in front of South Hampton. I would like temporary availability of this line to allow me to disinfect and pressure test the newly installed water lines. It would also allow me to complete the street construction for Phase I. This connection would be metered. 3. At the meeting in 1998 Mayor McIlhaney stated to the City Manager that it did not seem right that I be charged an impact fee and also be required to extend the sewer line under Highway 6 at my expense. She felt this needed to be reviewed. I would like an update, if I may. I am sorry that the City was not given proper notification of sewer line. construction by the contractors. My engineers gave them written instructions as part of the bid proposal. You mentioned that someone stated that I told them the City does not need to inspect the water line. Brown dated April 7, 2000 Dear Phyllis: We will address, to the best of our ability and knowledge, each of the points in Mr. Brown's letter, which concern the work done by MDG on the South Hampton project. Mr. Brown states that a viable option -for water supply would be a road bore under Texas Highway 6 to connectto the existing speedway line for temporary service. Your problem is the need for water service to disinfect and pressure test the newly installed lines. These should be tested and accepted prior to placing streets and sidewalks over them. Water service for street construction is necessary but would not necessarily involve activation of the newly laid lines as Mr. Brown so recognizes. in his letter. D & J Dozer, the sanitary sewer line. contractor did not notify the City of College Station before beginning construction although the plan sheets charge them with that responsibility. The necessary inspections were performed after the fact. Brazos Valley Utilities, the water line contractor, was also given plans stating responsibility for. notification and never, at any time, was instructed. by anyone from MDG that the City of College Station did not need to inspect the lines. When questioned, Mr. Haveron said a gentleman named Wright did the inspections. A permit application has been submitted to TxDOT for the sanitary sewer line bore under Texas Highway 6. A question on the sewer line guarantee required needs. to be addressed. Are .the developers required to guarantee the. entire cost of the bore or only the portion not approved as excess line size participation bythe City of College Station? The proposed street contractor, TexCon, Ina has in the specifications provided by this firm the requirements for notifying the City of College Station for inspection scheduling. Our representatives met with the City Council to request oversized participation for the sanitary sewer line highway bore under Texas Highway 6.
