Date: 2/16/98 8:15AM Subject:. Ashford Square. Friday I had a meeting with Lynn, Skip, David Scamardo and Stuart Kling re: the parking lot/ROW encroachment. This is what I outlined as a solution: 1. We can't file a plat that differs from the. P8~Z approved plat BUT we will file this plat in "phases"- leaving out the .problem ROW and the lot with the. parking lot problem. It may be necessary to file some blanket. or other separate. easement documents. 2. Stuart Kling willprepare a "phase II" plat that addresses the ROW problem "probably by angling the ROW to the east. The "phase II" plat will differ from that approved. by P&Z and thus must go back to the Commission. Stuart should be in this AM to discuss this with me, hopefully bringing in some drawings. Dear Mr. Scarmazdo: Recently we discussed the problem of an existing pazking lot encroaching into a proposed right-of--way in the above referenced subdivision. Subsequent to that discussion I was visited by Phil Blackburn, the owner of a lot in the Ashford Squaze subdivision and of the parking lot in question. Based on Mr. Blackburn's comments, it was my understanding that the pazking lot was to be modified and that the encroachment would be reduced to approximately the depth or thickness of the curb face (approximately 0.5'). While we have no mechanism to license the encroachment in a street right-of--way, I did not consider the encroachment as described to be a significant problem and indicated that we would proceed with the plat filing. I requested that the encroachment be acknowledged and documented on the plat. On February 24, 1998, we received. a revised plat which included an inset drawing reflecting the existing parking lot and its encroachment into the proposed right~of way. This inset drawing reflected an encroachment of 4.5'. The actual encroachment of the parking lot into the right-of--way created by the replat is considerably more than I anticipated. It is appazent that there was confusion or misunderstanding regazding the amount of encroachment of this .parking lot into the new right of way. We have filed the plat as submitted on February 26. As we previously advised, we have no mechanism for licensing or otherwise authorizing the encroachment. We recognize the encroachment as an existing encroachment and will leave it as such so Iong as it does not limit or restrict public use or necessity within the right-of--way. The final plat that was filed, today had 17 duplex lots for a total of 34 units. {34 units x $2,25 = $7650) However, David is working on a replat that would create 2 additional lots or 4 additional units. (38 units x $225 = $8550) He wanted to go ahead and pay the parkland for these additional units at this time (plus, he already had a check cut for the total amount). The parkland for the 2 additional lots was taken care of with this dedication. How's that for confusing? During the course of our conversation Fred told me they had created 2 additional lots-which makes it MUCH different from the plafwhich was just approved in that it is zoned R-2 and. must. go thru the public hearing/public notification process. He also wants to know if he can get a development permit before the .plat is filed because David Scarmardo needs to begin construction by Fed 5th or "the deal falls thru". I'm having a problem with this whole development! Veronica, have you .had the drainage problems addressed to the point you feel comfortable saying they have met or will meet the ordinance requirements during .construction? What about this changing the plat? Can.. we possibly issue a development-permit on-the old plat and then have the. new plat pending with more lots? What if what David is doing is contingent on having the 2 additional dots and P&Z decides it needs to be denied? Fred has called me twice this afternoon and left messages on my voice mail wanting to get some answers; so I guess a need to get some input from you soon so l can get back to ham with some guidance. Kling RE: Variance Request on Replat of Ashford Square At the .City Council meeting on .November 27, 199 a motion .was made by Mr. Dick Birdwell to approve the Rezone Request on the above referenced project subject to staff recommendations and that the streets be public right of ways rather than the private access easements as currently shown and platted. This requirement. has necessitated that we request a variance from the .subdivision regulations (Chapter 9 -Ordinance No. 690 Revised 8/96) -Section 8- G.10 .Geometric S#andards which requires a 50' wide right of way width' for Ashford Drive artd Ashford V1/est Drive, We are requesting a variance to this requirement to a!!ow a 40' right of way width .with. a 12' public utility easement on each side of the road, this will provide a total width of 64' for the placement of a 28' pavement section and the necessary utilities. The granting of this variance request will assure that all building set back requirements will be met. Without the variance Lots 3R Block. D and Lots 4R, 5R, 6R flock C will not be in compliance with the set. back requirements. Additionally, the parking lot serving the existing building on lot 1 R Black C will encroach into the 40' right of way 4.5'. At a 50' right of way width the encroachment will be 14.5'.
