Item: Public hearing and consideration of rezoning Lots 1, 8, 9, and 10 of Block 4 of Pooh's
I" Parks Subdivision located along the north side of Holleman between Texas Avenue and Lassie
Lane from. WPC -Wolf Pen Creek to G l General Commercial.. (98-115,116,117))
Item Summary:. In July of this year, City Council adopted a revised master plan for the Wolf Pen
Corridor. This was preceded by over a year of meetings and workshops with citizens, the Parks
Board, the P&Z and the TIF Board. This revised plan'reemphasizes-the potential uniqueness of the '
corridor.
Twoyears ago the.: City rezoned a large tract of land, known as Pooh's Park.from WPC to C-1

''~, with_the condition that the WPC requirements for dealing with the floodway and floodplain area be
adhered to at the time of development: The..property owners requested C-1 zoning because they
felt that the WPC restrictions were inhibiting the sale and development of their property.

I~ The property has not developed under the C-1 regulations while there has continued to be property
~' development within the Walf Pen Creek corridor on other tracts of land. Examples are The Arbors
and University Commons (multi-family developments) Office Max. and 3 restaurants that are
~ pending at present.
The property owner is now making this request to rezone 4 additional lots in anticipation that they
~''~ maybe consolidated with the larger tract that was previously rezoned. Three of the lots (8,9, &
10) lie east of what wilLbe the extension of George Bush East to Holleman. Lot 1 lies to the west
'~' of this future extension.
One: of the things staff analyzes in a rezoningcase along with the. Comprehensive Plan, is whether
conditions have changed to justify aparticular -request, especially if that request is contrary to the
land use plan. In this case, the rezoning that took place. two years ago. constitutes a significant
change in the WPC boundary. Itdeft several small lots along.Holleman as well as some lots along

Texas Avenue, isolated from the remainder of the district. This change could. justify rezoning these
it lots'out of the WPC district and to another commercial zoning classification.
Another change that has occurred in the area is the addition to the thoroughfare plan of the,
~ extension of George Bush Drive East to Holleman.. This street will cut through lot 7, block 4
iii which has C-1 zoning on it at present. This will leave a small amount (just' over 9,000 square feet)
'~ of property with C-1 zoning on the east side of George: Bush Dr. East. This future street extension
i should serve as a definitive boundary, a demarcation line, between the: existing C'-1 zoning west of
it and the remainder of the Wolf Pen Creek district to the east.
Budgetary & Financial Summary: NA
~ Staff Recommendations: Staff originally recommended that'the previous large tract be taken out
of the WPC district ONLY if compliance with the intent of the master plan relative to the creek
area could be achieved. The P&Z had unanimously recommended against taking any property out
of the WPC. district. With the two changed conditions; the previous'rezoning andthe George. Dr.
East-extension, staff recommends approval of rezoning lot 1 block 4 from WPC to C-1.. Staff
recommends denial of rezoning the other three lots out of the WPC district.. George Bush Dr. East

south from its bridge should be the boundary between any commercial zoning and the WPC
comdor.
Related. Advisory Board Recommendations:.The P&Z held a hearing on 9-17-98 and
recommended rezoning lot 1, block 4 from WPC to C-1 and recommended denial of rezoning lots
' 8,9, & 10. The Commission felt that his motion should send a message to property owners in the
WPC corridor that the Commission will not look favorably on taking any property east `of the
George Bush Drive extension out of the WPC zoning district,
The Commission also suggested that the City look at initiating rezoning the remaining lots on
Hollemanthat arewest of the George.Bush extension and the lots on Texas than extend from
Holleman north to the large Dale tract from WPC to C-l or some other commercial district.
City Attorney Recommendation/Comments: NA

Council Action Options.: The Council options are to approve rezoning as submitted, approve with
physical conditions that will mitigate negative impacts, approve a less. intense zoning classification,
' deny table indefinitely, or defer action to a specified date.

ENGINEERING:.
This site has adequate public infrastructure o support this rezoning request. Drainage will be
addressed at the time of site plan review: According to FEMA floodplain maps, these lots are not
located within the 100-year floodplain.
