Item: Public hearing and consideration of rezoning approximately 0.68 acres located on the
southeast corner of Dominik and George Bush Drive, being a portion of Lot 2, Block. I), of
Culpepper Plaza, from A-P Administrative Professional to C-B Business Commercial. (98-109)
Item Summary: The site .has frontage on Dominik and on George Bush Drive with a drainage
easement separating it from the apartment complex .located to the south and east. The site is
located on the southeast corner of the intersection of a minor arterial and a major collector. The
Comprehensive Plan's development policies would `support small, neighborhood-serving
commercial development at such locations.
The requested zoning will allow for the redevelopment of the site to a convenience store and service
station, which is the intended use of the property.. Such a use wouldnecessitate arequest for a
Conditional Use. Permit to be reviewed by the Commission at a later date.
Item Background: The subject property was a part of a larger tract that zoned and platted in the
late 1970's to early 1980's for amulti-family residential development. In 1981; the subject tract
was .rezoned to A-P for a bank drive-through facility. It was recognized: at that time Ghat it was
unlikely that any residential use would occur on the property because the drainage easement
separated it into a relatively small tract.
Policy Issue Statement:
Civic Pride Citizens benefit from well-planned, .attractive residential and
.commercial areas, .and from preserving historic areas.
The Land Use Plan reflects the property as attached residential.
Staff Recommendations: Staffrecommends approval as submitted.
Commission Action Options: The Commission acts as a recommending body on the questiorn of
rezoning, which: will be ultimately decided by City Council. The Commission options are to
recommend approval of rezoning. as submitted, recommend approval with conditions, recommend
denial, table indefinitely, or defer action to a specified date.

Water: Existing infrastructure is adequate for theproposed use.
Sewer: Existing infrastructure is adequate for the proposed use.
- Streets: Not applicable.
Off-site Easements: Not applicable.
Sidewalks: Sidewalks are required on Dominik as shown on the sidewalk Master~plan.
Although sidewalks are not shown on the Masterplan for George Bush East (fornnerly
Kyle South), the zoning ordinance gives the PRC discretion to impose additional
requirements when necessary for the protection of public safety and to preserve the
integrity of the city's comprehensive plan. This would allow the PRC to require
sidewalks in areas not shown on the Masterplan when warranted. The function and
.street classification of George Bush East has changed since the time when the Sidewalk
Masterplan was developed. It now serves as a more important pedestrian, bicycle and
vehicular link to the Wolf Pen Creek District. Staff would recommend that at time of site
plan review, sidewalks be required on George Bush East as well as on Dominik.
Drainage:. Any increased runoff occurring as a result of the redevelopment will need to
be addressed before a development permit or Building Permit is issued. It is expected
that a drainage report will be reviewed at time of site. plan submittal.
Flood Plain: According to FEMA Flood Hazard Maps, a portion of this property is
located above the limits of detailed study but within a Zone "X" which is defined by
FEMA as areas of SOO year flood; areas of 1.00 year flood with average depths of less
than 1 foot or with drainage areas less-than 1 square mile; and areas_protected by levees
from 100 year flood. There will be no requirement for extending any FEMA hydraulic
studies to this property.
Oversize request:. Not applicable.
Parkland Dedication: Parkland is not required under the current zoning.
Impact Fees: None.
