Item: Public hearing and consideration of rezoning of approximately 1.:72 acres located on. the
southeast corner of Deacon and Wellborn Road being Lot 10, Block 71 of Fraternity Row, fronn C-
1 General .Commercial to R-5 Apartment Medium Density.. (98-108)
Item Summary: The. request is in conformance with the Land Use Plan and is in harmony with
the existing pattern of development in the area, with multi-family uses serving as a buffer between
the intersection and the low density residential uses further east along Deacon.
Item Background: The subject property was a part of a larger tract that zoned and platted in the'
mid-1980's for a fraternity subdivision with a commercial use at the intersection. Two of the 9
lots that are intended for fraternity houses have been built, the rest remain vacant. The area to the
south along Wellborn Road was later developed as the Edelweiss subdivision, which showed
additional commercial lots to develop along the Wellborn Road frontage. Three of the Edelweiss
commercial lots are currently under development for commercial uses.

The Land Use Plan reflects the property. as attached residential
Staff Recommendations: Staff recommends .approval as submitted.
Commission Action Options: Recommend approval of .rezoning as submitted, recommend
approval with conditions, recommend denial request, table indefinitely or defer action to a specified
date.

Drainage:. This site drains toward Wellborn Rd. and compliance with the City's
Drianage Ordinance will be required at the time of site development.
Flood Plain: According to FEMA Flood Hazard Maps, this property is not located
within the limits of the 100-year flood. plain as determined. by FEMA.

Parkland Dedication: Parkland is not required under the current zoning. The proposed
rezoning to residential will include a parkland dedication fee requirement, which will be
assessed at the time of building permit at $225.00 per unit..
Impact Fees: None.
