Transportation Analvst Item: Public Hearing and possible action on an ordinance amending Chapter 9, Subdivision Regulations, by adding Section aw, Gating of Roadways, to the College Station Code of Ordinances. Item Summary: Over the past few years there has been a dramatic increase in the number of gated subdivisions in the state of Texas. In the last year,staff has had several inquiries from developers regarding the City's policies and guidelines on these types of developments.. The City's first gated subdivision, Grand Oaks, has been underway since May of 1997. It served as the impetus for the development of this ordinance Staff reviewed and researched ordinances for gated subdivisions from numerous other cities in the development of our own ordinance. As with all other cities, our ordinance requires that all gated subdivisions must have a Homeowner's Association (HOA) and that all streets within .the subdivision be private. It sets parameters which, dearly identifies HOA responsibilities, establishes design guidelines for the restricted access entryway, and sets forth a means by which the City can reclaim all private "common" area as public infrastructure. The conditions set forth by this ordinance shall provide the city, developer, and the HOA with spe~fic guidelines relating to the "Common" areas and amenities of a gated subdivision to assure the continuing successful operations of the association. Citizens benefit from the ability to move into, within, and out of College Station in a safe and efficient manner. ~ It. .\( ,J Item Background: At the regular council meeting held on Maya, 1997, staff gave a presentation discussing the significant trends and future impacts of gated communities. Developers have simply responded to this market demand and are now inquiring to staff about the requirements for developing gated subdivisions in College Station. Council directed staff to develop an ordinance addressing the conditions to establish the gating of roadways in College Station. Staff contacted ten cities throughout the United States, seven in the state of Texas, researching criteria used in other cities relating to gated subdivisions. Budgetary and Financial Summary: The primary cost implications of this ordinance are on private development As with the Grand Oaks subdivision, the ordinance requires that adequate funds be placed in a reserve account for maintenance. Staff Recommendation: Staff recommends approval of the ordinance amendment. The Planning and Zoning Commission recommended unanimous approval of the ordinance at their October 2, 1997 meeting. Since this time, staff has made minor revisions to the ordinance by addressing a concern made by the P&Z Commission, consolidate two subsections, and include an indemnity clause. City Attorney Recommendations/Comments: The City attorney's office has reviewed and assisted in the preparation of the attached ordinance Council Action Options: Councils options are adoption as presented, adoption with revisions, tabling, or non-adoption.
