AN ORDINANCE AMENDING CHAPTER 3, SECTION, 3, AND CHAPTER 9, SECTIONS 3, 8, AND 12 OF THE CODE OF ORDINANCES, CITY OF .COLLEGE STATION,. TEXAS INCORPORATING ADDITIONAL STREET CLASSIFICATIONS FOR THE CITY'S THOROUGHFARE PLAN AND THEIR ASSOCIATED REVISED STREET. DESIGN CRITERIA WHICH WERE APPROVED AS PART OF THE CITY'S AUGUST 1997 ADOPTION OF THE NEW COMPREHENSIVE PLAN. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: That Chapter 3, Section 3, of the Code of Ordinances, City of College Station, Texas, is hereby amended to read as follows: CHAPTER 3: BUILDING. REGULATIONS SECTION 3: DEVELOPMENT OF STREETS A. AUTHORITY This section is adopted under the authority of the constitution and laws of the State of Texas including particularly Chapter 106, Acts of the 40th Legislature, First Called Session 1927, as heretofore or hereafter amended (compiled as Article 1105b V.A.T.S.), andthe provisions of Section 4 of the Municipal Annexation Act as heretofore and hereafter amended (compiled as Article 970a, V.A.T.S.); and .pursuant to the provisions of Article II of the City of College Station, Texas, Charter. B. SCOPE AND PURPOSE (1) This section shall. govern the development of all streets, sidewalks,: bikeways, driveways and vehicular parking on streets, .within the corporate limits of the City of College Station, Texas, including both the subdivided and. unsubdivided portion of the City, and within the extraterritorial jurisdiction of the City as established by the Local Government Code, as amended. (2) The regulation of street development is a major factor of sound community growth and ultimately becomes a public responsibility in that he streets must be maintained together with the utilities established thereon. The welfare of the entire community is thereby affected in many important respects. It is the intent of these regulations to encourage the growth of the -City of College Station in an orderly manner, and they are deemed. to be the minimum requirements as adopted by the City Council for the protection of the public health, safety, .and welfare. C. DEFINITIONS For the purpose of this section, certain words as used herein are defined as follows: (4) Bikeway is a trail, path, partof a highway shoulder, or any other means specifically marked and assigned for bicycle. use. Bikeway facilities are further classified as bike paths, lanes, and routes. (2) C~ refers to the municipal corporation, City of College Station, Texas. (~4) Corner means the point of intersection of the lines of two (2) street curbs extended ~ into the street intersection. (4~) Cul-de-sac means a street having only one (1) outlet to another street and terminat- ~ ing on the other end in a vehicularturnaround. L6) Curb Return means that portion of a curb which is constructed on a curve, to connect ~ normal street curbs at a street intersection, or at driveway approaches connecting the street curb to the driveway. approach. L~ Driveway means a place on private property for vehicular traffic. ~ (~~) Driveway Approach means an area or facility between the street and private property ~ intended to provide access for vehicles from the street to private property. A driveway approach must provide access to something definite on private property, such as parking area, a driveway, or a door at least eight feet (8') in width, intended and used for entrance of vehicles. ($S) Extraterritorial Jurisdiction. (within the terms of the Local Government Code) means ~ the unincorporated area, .not a part of any other city, which is contiguous to the corporate .limits of the City of College Station, the outer boundaries of which are measured from the extremities of the corporate .limits of the City, outward for such distances as may be stipulated in the Local Government Code, in which area, the City may enjoin the violations: of this street regulations section. (1~6) Shall is always mandatory. ~ (1 E?~) Sidewalk is a paved way for pedestrian traffic. (1Z~) Street is a way for vehicular traffic or parking, whether designated as a highway or any of the following types: (a) Residential or local street serves aresidential- neighborhood, either a cul-de- sac,.loop or short street of restricted use. (b) Minor G~ollector street is to serve other residential areas: primarily internal to one neiahborhood. fespes~e-areas: (~$a-9} Street Width shall mean the distance as measured from back of curb to the back of curb. 1n the case where there is no curb, street width shall. mean the distance between the edges of pavement. (~~) Thoroughfare and Transportation Improvement Plan refers to a plan which is a part of this section and which establishes a location for certain principal traffic ways withirrthe corporate limits of the City, and within the extraterritorial jurisdiction of the City. b. STANDARDS OF STREET CONSTRUCTION (1) Residential Streets Residential or local streets are restricted to cul-de-sacs,. loops, or short streets with the following additional restrictions: A cul-de-sac shall not be over six hundred feet (600') in length.. and shall terminate in a turnaround of not less than a fifty foot (50') radius. A loop shall terminate in a collector street. at both ends. Right-of--way width shall be not less than fifty #eet (50~, .and: if utility easements are not provided at the back of .lots, the width shall be increased as required. by the City Engineer. Street width shall be not less than twenty-eig#f~e~n feet (2Z~'). Parking may be permit- ~ ted. Sidewalks are mandatory on one side of the street, with the exception of cul- de-sac streets. Cul-de=sacs will be required to have a sidewalk on one side,. if needed to provide through .pedestrian movement. (2) Collector Streets Collector streets are rx-aje~thoroughfares providing for two. (2) to four (4) lanes of ~ moving traffic. (3) Arterial Streets Arterial streets are major thoroughfares providing for. four (4) toto six~(61 lanes of ~ moving traffic. Engineer means a person duly authorized and licensed under. the provisions of the Texas Engineering Registration Act, to practice the profession of engineering. Extraterritorial Jurisdiction, within the terms of the Texas Municipal,Annexation Act, means the unincorporated area,., not a part of any other city, which is contiguous to the corporate limits of the City of College Station, the outer boundaries of which are measured from the extremities of the corporate. limits of the city, outward for such distances as may be stipu- lated in the Texas Municipal Annexation Act, in which area, within the terms of the act, the City may enjoin the violation of its subdivision control chapter. Feeder Line shall .mean any line, wire, or cable and appurtenances which distributes, transmits, or delivers a utility service. from a source to a general. area or to .multiple developments, and not to a specific: end user. Lateral Line shalt mean any line, wire, or cable and appurtenances used to distribute, transmit, or deliver service from a feeder line to two (2) or more sites or end users of the utility service within a specific',development. Lot is physically an undivided tract or parcel of land. as shown on a duly. recorded plat. Major Street includes state highways. major and minor. arterial. c}p~ major collector streets.,. - Master Development Plan refers to a conceptual, informal map of all ' property .under common ownership showing potential future subdivision or development. It is of sufficient accuracy to be used for purposes of discussion and classification. It shall include information as described in Section 6-6.1. Master Preliminary Plat refers. to a map of a proposed subdivision or development with the same level of detail as required for a preliminary plat under .Section 6-C. A Master. Preliminary Plat is essentially several preliminary plats together on one document such that portions may be subsequently submitted-for approval. as final plats as per Section 6-B.2.1. Minor Plat as defined by Section 212.0065: of the Texas Local Government Code. A subdivision involving four or fewer lots fronting. on an existing street and that does not require the creation. of any new street or the extension of municipal facilities. Mobile Home Park means a parcel of land, under single ownership, which. has been. planned and improved for placement of mobile homes for nontransient use. See Chapter 3, Section 4 of this Code of Ordinances. May is permissive. Pavement Width means the portion of the surface of the street available for vehicular traffic; where curbs are used, it is the portion. between the-€ase~Ck of curbs, ~ Planned Unit Development, PUD, means a parcel of .land completely planned as a unit development, requiring special handling and approval: See Section 11. Planning and Zoning Commission means the duly appointed Planning and Zoning Commis- sion of the City of College Station, Texas. Plat means a map of a subdivision showing the location and boundaries of individual parcels of land subdivided into lots, with streets, alleys, easements, etc.,. usually drawn to scale; also includes a replat and an amended plat." Preliminary Plat refers to a map indicating the proposed layout of a subdivision meeting the requirements of Section 6.C. Principal Street is a street so designated and indicated in the street regulation section of this Code of Ordinances, Chapter 3, Section 5. Service Line shall mean any line, wire, or cable and appurtenances .used to distribute, transmit, or deliver autility service froma source ofsupply, feeder line, orlateral line directly to an end user. Street is a way for vehicular fc svi'd°n#i...l c~rco4 ~+~^Fcri.~l streE Subdivider means any person or persons. firm, or corporation subdividing a tract or parcel of land to be sold or otherwise handled for his own personal gain or use. Subdivision means the division of a lot, tract, or parcel of land into two (2) or more parts, lots, or sites, for the purpose,. whether immediate or future., of sale, division of ownership or building development. This also includes the resubdivision of land or lots which are a part of a previously recorded subdivision. Divisions of land for. agricultural purposes, where no building construction is'involved, in parcels of five (5) acres or more, shall not be .included within this definition, unless such subdivision of five (5) acres or more includes the planning or development of a new street or access. easement. An addition is a subdivision as is defined herein.. Surveyor means a licensed state land surveyor or a registered public surveyor, as authorized by the Texas-Land Surveyors Registration Act. Utility Easement means an interest in land granted to the City, to the public generally, and/or to a private utility company, for installation or maintenance of utilities across, over, or under private. land,. together. with the right to enter thereon with. machines and vehicles as necessary for maintenance of such utilities. Zoning Ordinance refers to the duly enacted zoning ordinance of the City of College Station, Texas, adopted by reference in Chapter 12, Section 2 of this Code of Ordinances. Definitions not expressly .prescribed herein are to be construed in accordance with- customary usage in municipal planning and engineering practices. (Ordinance No. 2179 of May 9,.1996) Shall is always mandatory. i SECTION 8: GENERAL REQUIREMENTS AND MINIMUM STANDARDS OF DESIGN 8-G.8 Principal Streets on Master Plan Where subdivision embraces a principal street as shown on the master plan of the city, such street shall be platted to maintain continuity:in the approximate location as shown, and of the type indicated. In certain cases the city may have constructed a street through the area to be subdivided, in which case the subdivider shalt develop the necessary street intersections at his: expense, in accordance with the requirements of this chapter. The Planning Commission may require that, where practical, residential lots .adjacent to .arterial ~¢ I collector °+ree+~ ^r ^.,..~,.,°.,~ be platted or restricted so as to prevent .driveways opening into such streets_ 8-G.9 Minor Streets Minor streets shall be laid out to discourage their use of through traffic. 8-G_10 Geometric Standards Design Criteria fpr Urban and Rural streets are shown in_Table 1. Street Design Criteria. The cross sections for' each of the different street tvoes generally reflect the cntena set forth in Table 1. Refer to street regulation section for other requirements. ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 9, "SUBDIVISIONS", OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY AMENDING CERTAIN SECTIONS AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING A PENALTY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That Chapter 9, "Subdivisions" of the Code of Ordinances of the City of College Station, Texas, be amended as set out in Exhibit "A", attached hereto and made a part of this ordinance for all purposes. .PART 2: That if any provisions of any section of this ordinance shall be held. to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full 'force and effect. PART 3: That any person, firm, or corporation violating. any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and. upon conviction thereof shall be punishable by a fine of not less than. Twenty-five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00). Each day such, violation shall continue or be permitted to continue, shall be deemed a separate offense.
