ORDINANCE NO. 2273
AN ORDINANCE AMENDING SECTION 10, ORDINANCE 1638, THE ZONING
ORDINANCE FOR THE CITY OF COLLEGE STATION REVISING THE SCOPE AND
FUNCTION OF THE PROJECT REVIEW COMMITTEE
NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS:
I.
That Section 10, Ordinance 1638, The Zoning Ordinance of the City of College Station, Texas,
hereby be amended to read .as follows:
SECTION 10. SITE PLAN REVIEW REQUIRE:MENTS
- Prior to any development other than single family or- duplex development or for development
pursuant to a conditional use pennit, an applicant must obtain site plan approval under this
section. No such development shall be lawful or pennitted to proceed without final site plan
approval. All improvements reflected on approved site plans must be constructed at the time of
development. All terms and conditions of site plan approval must be met at the time of
development.
10.1 APPLICATION PROCEDURE
A. Any development requiring site plan review shall submit a site plan including landscaping
(as required by Section 11).
B. No approval of a site plan which fails to meet the express requirements of city ordinances
shall be granted unless a variance to such requirements has been granted by the appropriate
appeals board or commission.
C. Required in the application or therewith shall be the following, together with any other
information reasonably necessary for the review process:
1. An application for site plan review.
2. A fully dimensioned site plan, drawn to an appropriate Engineering scale on a 24" X 36"
sheet of paper, reflecting:
(a) The name, address and telephone number of the Applicant.
(b) The name, location and legal description of the proposed project.
( c) Ownership and current zoning of all abutting parcels.
(d) A key map.
(e) Topography and final grading plan, and other pertinent drainage information.
(t) All existing streets, drives, buildings, and water courses on or adjacent to the
proposed project site.
(g) Floodplains on or adjacent to the proposed project site.
(h) ~he location and size of existing utilities within or adjacent to the proposed project
site.

(i) The proposed location, type, and size of the following:
(1) Buildings and structures.
(2) Streets, drives, and curb cuts.
(3) Off-street parking areas with parking spaces drawn and tabulated.
(4) Sidewalks.
(5) Landscape information as required in Section 11 of this ordinance.
(6) Common Open space sites.
(7) Sites for solid waste containers.
(8) Proposed signage. .
(j) The total number of residential. buildings and units to be constructed on the proposed
project site.
(k) The total number of bedrooms included in the proposed project. .
(I) The density of dwelling units per acre of the proposed project.
(m) The gross square footage of all non-residential buildings and the proposed use of
each building.
(n) The total site area.
(0) Other information as required by staff.
10.2 ADDmONAL REQUIREMENTS
In order to be approved a site plan must provide for:
A. Safe and convenient traffic control. and handling.
B. Assured pedestrian safety which may include the provision of sidewalks along the perimeter
of the property meeting the specifications for same as outlined in the Subdivision Regulations
relative to width and placement.
C. Efficient and economic public utility and sanitation access.
D. Public road or street access.
E. Satisfactory internal access; public, private or emergency.
F. Adequate parking and maneuvering areas.
G. Noise and emission control or dispersion.
H. Visual screening trash receptacles or. other areas offensive to the public or existing adjacent
development.
I. Runoff> drainage, and flood control.
J. Sign location, as an incident to the above considerations and the express requirements of this
ordinance. ..
K. Location and density of buildings or dwellings where topography or characteristics of the site
compel a lower density than would otherwise be allowed, or require location consistent with
accepted engineering practices and principles.
L. Visual screening from the right-of-way of parking lots for apartments.
M. Compliance with standards, guideline~ and policies of the City's adopted Streetscape Plan that
are not alteadycovered by Sections 9ior 11.
N. Compliance with the City's adopted Streetscape Plan for minor arterial type street trees along
collector streets wiI1be detenninedpy, the City's adopted Streetscape Plan.
O. Determination and ~lear indicati(mo~ what constitutes the building plot for purposes of this
ordinance and the sign ordinanc~,and the conditions or requirements imposed by the
provisions of city ordinances.
10.3 APPEAL
An applicant may appeal interpretations of site plan .r~uirements to the Project Review
Comnuttee within five (5) days after the site plan review is completed. The Project Review
Committee (PRC) shall include three members of the Planning and Zoning Comnussion. Any
member of tbe committee may designate a representative for fiimself to act in his absence. Any

representative desigt!ated shall be a member of the Commission. The PRC is a governmental body
and shall comply With the Open Meetings Act.]
Failure to appeal the PRC action shall constitute a contractual acceptance of all .conditions
imJ?osed, and a waiver and surrender of all. complaints, defects, or potential invalidity, whether
unoer state or federal law.

B. An app.~~t may appeal only interpretations of staff in applying codes, ordinances, standards
and poliCies.
C. Any notice of appeal shall state with particularity the aspects which are to be appealed.
D. An applicant may appeal a. decision of the PRC to the Planning and ZOning Commission.
10.4 DISCRETION.A.RY REVIEW

Planmng and'Zorung ComnusslOn for reVIew and approval Within three days after filing of the
written report. The PRC must notify the applicant in writing. The PRC may elect to approve the
site plan or may forward the plan to the Commission for consideration.
The scope and extent of the review of the site plan by the Planning and Zoning Corrtmission shall
be equivalent to that of an appeal to the Project Review Committee. The Corrtmission shall,
upon taking final action, issue a written report setting forth the conditions imposed under
express city ordinances and separately setting forth any conditions imposed under Section
10.2, above, and the reasons therefor. A revised copy of the site plan showing all such
conditions and requirements shall b~ filed with the City Planner. No permits shall be issued
prior to such filing.
10.5 SPECIAL RULES FOR M-l DISTRICTS

Zoning Ordinance Amendment
A. Public notice by publication in a local newspaper shall be made at least fifteen (15)
days prior to the date set for the public hearing.
B. * The City Planner shall notify all property owners .of record within two hundred (200)
feet. of the p'roperty in question at feast ten (10) days prior to the public hearing by
certified mall.
C. The. Gity Planp.er shall notity the applicant of the date, time, and place for the
prelInunary reVIew of the proJect.
D. The proposed Ql'oject shall be reviewed in accordance with Section 10.2 prior to the
Planrung and Zoning Commission meeting.. Written recommendations shall be
submittooto the Planrung and Zoning Comnussion. A copy of this repoI:! shall.be sent
to the applicant. The applicant. shall file ten (10) copies of the final site plan as
~pproved. showing all changes and r~uirements of approval. The Planning and
Zonipg Commi~sion shall hOld a public hearing for the purpose of approVIng or
denying the project plan.
E. The applicant or .the owners .of forty percent. (40%) or more of the proQerty within
two liundred (200) feet of the 'project site may appeal to the City Council any
determination made by the Planrung and Zoning Commission. The apgeal should be
mad~ by petition filed with the City Secretary within ten (10) days after the public
hearmg.

That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which.shall remain in full force and effect.
ill.
That any person, firm, or corporation violating any of the provisions of this chapter shall
be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a
fine of not less than Twenty-five Dollars ($25.00) nor more than Two Thousand Dollars
($2,000.00). Each day such violation shall continue or be permitted to continue, shall be
deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective
ten (10) days after its publication in the newspaper, as provided by Section 35 of the
Charter of the City of College Station.

That Section 2, Ordinance 1638, The Zoning Ordinance of the City of
College Station, Texas, hereby be amended to add:
DEVELOPMENT; the. new construction of, enlargement of, reconst:tUction or
eonversion of any-building, structute or improvflment, or the use of any property
regardless. of whether thete are associatedbundin~, structUteS or improvements,
or the subdivision of lanel into two or more parts by deed, contract for deed, or
any other method including lease. Excet-tionsare agricultural uses on 5 acres or
mote whete thete is no anticipated other developlDent.

That Section 10, Ordinance 1638, The Zoning Ordinance of the City of
College Station, Te~as, hereby be amended to read as follows:
SECTION 10. SITE PLAN REVIEW REQUIREMENTS
Prior to any development activity-on the ground for any parcel of land intended to be
utiliged for other th~ single family or duplex development or for property in any zone
to be developed development pursuant to a conditional use permit, an applicant must
obtain site plan approval under this section. No such development shall be lawful or
permitted to proceed without final site plan approval. All improvements reflected on
approved site plans must be constructed at the time .of development. ADterms
and conditions of site plan approval must. be met at the time of development.
Site plan re-:iew shall be before the Project Re-:iew Committee (PRe). ThePR-C shall
include the City Planner, the City Engineer, and the. Chainnan of the Planning and
Zoning Commission. Any tnember of the committee may designate a representati'le for
hi:tnselftoac4: in bis absenoe. Any representative designated by the. chairman of the
Planning and Zo11.ing Commission shall be a member eithe Commission. ThePRC is a
go':emmental body and shall comply '.vith the Open Meetings Act.
10.1 APPLICATION PROCEDURE
A. Any applicant proposing constrUction development requiring site plan review
shall submit a site plan including landscaping (as required by Section 11). to the
City Planner. Prior to filing an application for site plan 1'o.:io.....', an applicant may

application, the ordinance requirements, procedures,. and the basic aspects of
the proposal.. The applicant shall be furnished vnth an application f-orm. and any
additional information which is necessO:IY. Site plOOs m.ust be prepared by a
registered architect or engineer.
If the plan includes nineteen (19) parking spaces or let::;s, the City Planner shall submit
said plan to the appropriate staff for re'liew according to the stan(ku-ds established in
this ordinance and other ordinances of the City of Cop-ego Station. If the plan includes
twenty (20) spaces or more, the City Planner shall schedule a PRC meeting. The
deliberations ofthePRC shall be recorded and filed in the Office of the City Planner. A
copy of the report shall be sent to the indi':idual( s} seekihg approval of the plan.

state any additional conditions and requirements impased under this section af

10.3 APPEAL

The reviewing staff Project Re':iew Committee may forward through the Projeet
Revi~ Committee any site plan to the Planning and Zoning Commission for review

and approval within three days after filing of the written report. The PRC must notify
the applicant in writing. .ThePRC lIlay elect to approve the site plan or lIlay
forward the plan to the Commission for consideration.
The scope and extent of the review of the site plan by the Planning and Zoning
Commission shall. be equivalent to that of an appeal to the Project Review Committee.
The Commission shall, upon taking final action, issue. a written report setting forth the
conditions imposed under express city ordinances and separately setting forth any
conditions imposed under Section 10.2 above, and the reasons therefor. A revised copy
of the site plan showing all such conditions and requirements shall be filed with the
City Planner. NopeIJIlits shall be i~sued prior to such filing. After final action by the
PRC or Commission, an applicant shall furnish ten (10) copies of the revised site plan
to the secretary- of the Commission, who shall return nine (9) to the applicant for use
during development once they have been certified as correctly reflecting the action of
the Commission.
10.5 SPJ1;CIAL RULES FOR M-l DISTRICTS
RESERVED
10.6 SPECIAL RULES FOR C-N DISTRICTS
Site plan review and proposed uses within the C-N Neighborhood Business District are
subject to approval by the Planning and Zoning Commission. Applicants shall file an
application form with the City Planner no less than twenty (20) days prior to the
regularly scheduled meeting of the Planning and Zoning Corqmission at which the
plan is to be reviewed. The application form shall be accompanied by. all supporting
information required in Section 10.1 above, a list of property owners within 200 feet*,
and a receipt for filing fee. The application fee shall be determined by the City Council.

Property owners within two hundred (200) feet of the site shall be identified by the
Planning Office using the Tax Rolls suppliedl:>y the Brazos County. Appraisal
District.

requiremen!s of approvalimposed by the Project Re'!iew Committee, after which.

two hundred (200) feet of the project site. may appeal to the City Council any

III.
