It is with pleasure that I put in writing my experience with the Stampede Clublloe Flackler
with reference to their tenancy at Southeast Crossing Shopping Center in Tyler, Tetras.
As Property NlanagEr of the center, they have been a pleasure to work with as they have
presented.themselves very. professionally and have hired dependable and responsible staff
to manage the Club. In addition,. they. have. always been very. punctual with rent payments.
Since their lease commencement in October of 1994,. additional tenants have located to the
Center in their immediate area - a taekwondo studio, an appliance service center, a
temporary staffing agency, among others. They have recently exercised their option to
renew their Lease for an additional three year period. I would be-happy to discuss their
tenancy.. in further detail if desired.

hams-owners Heathy this proposed facitilty certainly da note, There ~J
enough unsightly business and parl~ing problems at the earner of Longmire
and Valley View already. Another facility wauid only add to existing
problems and bring in more.
Please consider the citizens of this neighborhood and their desires aver a
passible income to the city through permits and taxes.

Dear Ms. McCully:
Thank you so much for sending me the Notice of Public Hearing in the
above men#ioned matter. Since l live in Nevada, I will not be able t+o
attend the City Council hearing, however. I have. strong objections to this
proposal, of which I respectfully ask you to take note.
I own the 80-unit Brookwood Apartments, at ifiQ1 Valley View Drive,
adjacent to the property in question. This complex is Inhabited by
families with young children. and A&M students. Putting a night club into
this location will not only be very disturbing to my tenants and their
families, but I anticipate trash and refuse being disposed on my property
as a result of inebriated patrons leaving the club.
Furthermore, many of my tenants are serious students and the
anticipated noise from the club will be a detriment to their s#udying.
This is not only unfair to them, but the result could nega#ivety impact my
occupancy rate.
I respectfully submit my strongest objections to the approval of the
proposed night club in the Brandywine shopping center.

THE OLD K-MART SHOPPING CENTER
1Ne, the. undersigned residents of the College Station
Southwood and Bee Creek area, are extremely opposed to
the possibility. of a nightclub moving into our neighborhood.
The problems that. arise from these establishments are
unending; and we do not want our families exposed to
them. We chose to move and build our homes in this quiet,
family community, and do not want the traffic, noise, trash
and vandalism that a nightclub would bring to this area,
Our children attend the many schools and churches, and
play at the nurneraus parks that are nearby and are an
important part of our daily lives. we feel that having a
nightclub move into our peaceful community would disrupt
not only the lives of fihe families that currently live in the
area, but would deter future residents rom .selecting the
Southwood area as their home, as well,
We hope that the council will carefully and. thoughtfully
consider our strong oppo tion to making a nightclub a
permanent part of our family community, and deny the
request for the needed permits,

Applicant: Greenstreet, Inc.
Dear Ms. Hooks:
On August 21, 1997, the Planning and Zoning Commission of the City of College Station,
Texas, held a public hearing and determined the Conditional Use Permit Application (hereiinafter
the "Application") of Greenstreet, Inc. (hereinafter the "Applicant") for a portion of the
Brandywine Shopping Center, 2700 South Texas Avenue, College Station, Texas (hereinafter the
"Property")
The Planning and Zoning Commission, by a 5-2 vote, denied Applicant's Application.
The undersigned, being aggrieved by the decision of the Planning and Zoning Commission,
appeals said decision. For at least the following reasons, the decision of the Planning and 2toning
Commission was unjust and/or made in error.
The basis of the decision of the Planning and Zoning Commission was not stated and is
unknown.. Considering the recommendation. of the City Planning Staff, the public comment
received by the Planning and Zoning Commission and the statements of members of the Phuming
and Zoning Commission at the August 21, 1997 public hearing, Applicant understands than the
proposed use of the Property: by Applicant meets alI`the minimum standards established in the
zoning ordinance and meets the purpose .and intent of the zoning ordinance and is in harmony
with the development policies and goals and objectives as embodied in the Comprehensive Plan
for Development of the City. Applicant understands that the' sole basis of the .decision of the
Planning and Zoning Commission was that the proposed use of the Property by Applicant will
be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants,
and/or. will be substantially or permanently injurious to the neighboring property.
Applicant's .Application was submitted to the Planning -.and Zoning Commission with a
recommendation for approval .from the. City planning staff of the City of College Station. The.
report and recommendation of the City'planning staff did-not include a recommendation for any
restrictions or conditions on Applicant's proposed use of the Property.
At the public hearing of the Planning and Zoning Commission on August 21, 1997, .the
Planning and Zoning Commission did not receive any public comment that the proposed use of
the Property by Applicant would be detrimental to the health, welfare or safety of the surrounding
neighborhood or its occupants. Likewise, the Planning. and Zoning Commission did not. receive
any public comment that the proposed use of the Property. by Applicant will be substantiially or
permanently injurious to the neighboring Property. The public comment received by the Planning
and Zoning Commission was hypothetical, speculative and irrelevant. Thus, the decision of the
Planning and Zoning Commission was not supported. by any competent and relevant public
comment, thereby making the decision arbitrary, capricious,. unreasonable and illegal.
The decision of the Planning and Zoning Commission adversely and unfairly discriminates
against Applicant, the Property, and the proposed use of the Property by Applicant. Prior to
consideration of Applicant's Application, the City approved conditional use permits for idlentical
and/or substantially similar uses by other applicants in substantially similar locations. For
example, the City granted a conditional use permit to Burton Creek Pub, Inc., 2702 Texas
Avenue, College Station, Texas, which is located in the Brandywine Shopping Center.
The decision of the Planning and Zoning Commission was not consistent with. the City's
legitimate land use regulation interests or the proper exercise of the.. City's regulatory powers.
The Planning and Zoning Commission clearly abused its discretion in denying the Application
of Applicant.
The undersigned requests that the College Station City Council overturn the decision of
the Planning and Zoning Commission in its entirety and grant the Application of Applicant.

the Lawyer family and he is opposed to'the request. I told him he could come to the meeting .but

Had a call from Don-Canter this morning expressing concern about the possible parking problema in the
Brandywine. That part can be reported-in the staff report. You don't need to mention his name- just his
concern:
Now: for the rest of the conversation...Don thinks the people involved in this Wall Street are the -same
people who were involved in Grahams., Their name is Lawyer and the (according to him) have baen
banned. from operating bars here again! I told him the-name of the applicant is "Greenstreet, Inca" out of
Longview, but he says if anyone bothered to check, he thought they were the Lawyer family. That's not
our problem.
He also said he heard the plan is to have like $ or 4 nightclubs in one. And further, expressed concern
that becausethe existing businesses in the Brandywine Center are not doing exacfly booming business,
they will be replaced with expanding nightclubs & bars,
He said he is interested in doing something outside of the Northgate area, and asked me to send him
copies out of the zoning ordinance of the rules and regs regarding requirements for opening new clubs. I
will send him' the: parking requirements out of sec. 9, the conditional use permit section and all tha
specific district sections which. allow nightclubs as conditional uses. Can you think of anything else which
might be required.
Re: parking at Brandywine - how is that figured? On specific use or on shopping center requirements?

Dear Ms. McCulley:
I was surprised to learn on Friday, September 19, 1997, that the above-referenced appeal
was set on the agenda of the College Station City Counsil for Thursday, September 25, 1997.
Although I appeared before the Planning and Zoning Commission and filed the appeal from the
decision of the Planning and Zoning Commission, I did not receive notice that the appeal was
set on the City Counsil's agenda.. Rather, I was informed of this scheduling in our telephone
conference on Friday, September 19, 1997. Unfortunately, both the representative of my client,
Greenstreet, Inc. and I are unavailable for the City Counsil meeting this Thursday. By my
reading of Section 14 of the City of College Station Zoning Ordinance, a deadline is not stated
for, the time to hear an applicant"s appeal. from a decision of the Planning and Zoning
Commission. Accordingly, I understand that the City would not oppose a rescheduling of this
matter.
Please consider this letter a request that the appeal of Greenstreet, Inc. of the deciision of
the Planning and Zoning Commission denying the Conditional Use Permit application scheduled
for Thursday, September 25, 1997, be cancelled and rescheduled for another date.
