Item: Public hearing and consideration of a Conditional Use Permit for Christ United Methodist
Church, Lot 2, Barron Park Subdivision in front of the Desert Hills Hospital, 4303 Texas Avenue
South. (Planning Case No. 97-711)
Item Summary: The proposed use is for a new church and child care to be located in a largely
undeveloped area of the City. Land uses in the vicinity include the existing hospital to the east with
future. retail regional uses to the south and office uses to the north.
Policy Issue Statement:
Civic Pride -Citizens benefit from well-planned, attractive residential and
commercial areas, and from preserving historic areas.
Item Background: The property has been located in the City since 1983. The surrounding area
has that has recently experienced a large amount of annexation. The City is currently working on
land use plans and utility extensions in preparation for the future development of this southern part
of the City. A portion of the subject property may fall into a future impact fee area.
Budgetary & Financial Summary: N/A
Staff Recommendations: Section 14 of the Zoning Ordinance authorizes the existence of
conditional uses. The Commission may. permit a conditional use subject to appropriate conditions
and safeguards, when after public notice and hearing the Commission fmds that: (Staff comments
are in italics)
1. "The proposed use meets all the minimum standards established in the ordinance for the
type of use proposed."
The PRC reviewed the site plan and found compliance with the technical requirements of site
development and made some minor comments for changes.
2. "That the proposed use meets the purpose and intent of the ordinance and is in harmony
with the development policies and goals and objectives as embodied in the Comprehensive Plan for
Development of the City."
The request is in compliance with the Land Use Plan for the area.
3. "That the proposed use will not be detrimental to the health, welfare, and safety of the
surrounding neighborhood or its occupants, nor be substantially or permanently injurious to
neighboring property."
The public hearing is an opportunity for the Commission to measure the potential impact on
surrounding land uses.
"The Commission may impose additional reasonable restrictions or conditions to carry out the
spirit and intent. of the ordinance and to mitigate adverse effects of the proposed use. These

requirements may include, but are not limited to, increased open space, loading and parking
requirements, additional landscaping, and additional improvements such as curbing, sidewalks and
screening."
Unless the public hearing brings to light any new information indicating potential negative
impacts, Staff recommends approval with PRC conditions.
Related Advisory Board Recommendations: A Project Review Committee meeting was held on
July 2. A few minor revisions are required for ordinance compliance.
City Attorney Recommendation/Comments: No concerns expressed.
Commission Action Options: Approval, approval with conditions as provided in the above
section, or denial of request.

ENGINEERING
Water: Adequate infrastructure exists for the proposed use.
Sewer: Adequate infrastructure exists for the proposed use.
Streets: Access to State Highway 6 frontage road is proposed. Additional access to the
site may be .provided by a private access easement that extends to State Highway 6
frontage road which contains a concrete road leading to Desert Hills.
Off-site Easements:. An access easement may need to be obtained to grant secondary
access to the property via the concrete access road leading to Desert Hills.
Sidewalks: Not required.
Drainage: Drainage will be addressed before a building permit will be issued to ensure
compliance with City's Drainage Policies. At this point, it appears that there will be no
on-site detention required.
Flood Plain: According to the 1992 FEMA maps, the site is not located within the 100
year floodplain
Oversize. request: None
Parkland Dedication: None required
Impact Fees: None required at this time. The City is working on establishing a sewer
impact fee area that will encompass a portion of the existing site in the future.
