Item: Public hearing and consideration of a Conditional Use Permit for the use only for a day care facility
at 4106 Tiffany Trial. (Planning Case No. 9'1-705)
Item Summary: The. applicant has operated a business that is defined as a `Yegistered day care" facility
by relative State agencies. Under the Zoning Ordinance, the business is not required a Conditional Use
Permit (CUP) until the number of children that will be cared for within the home exceeds seven children
per day. In this case, the applicant wishes to care for up to five additional children, and a CUP is
therefore required.

areas, and from preserving historic areas.

Staff Recommendations: Staff generally does not make recommendations in Conditional Use Permit
cases. The public hearing is an opportunity for the Commission to measure the potential impact on
surrounding land uses.
Related Advisory Board Recommendations: Due to the fact that no site changes are proposed, no site
plan review (PRC) is required.
City Attorney Recornmendation/Comments: Section. 14 of the Zoning Ordinance authorizes the
existence of conditional uses. The Commission may permit a conditional use subject to appropriate
conditions-and safeguards, when. after public notice and hearing the Commission finds that
1. The proposed use meets all the minimum standards established in the ordinance for the type of
use proposed;
2. That the proposed use meets the purpose and intent of the ordinance and is in harmony with the
development policies. and. goals and objectives as embodied in the Comprehensive Plan for Development
of the City; and
3. That the proposed use will not be detrimental to the health, welfare,. and safety of the surrounding
neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property.
The Commission may impose additional reasonable restrictions or conditions to carry out the spirit and
intent of the ordinance and to mitigate adverse effects of the. proposed use. These requirements may
include, but are not limited to, increased open space, loading and parking requirements, additional
landscaping, and additional improvements such as curbing, sidewalks and screening.
Commission Action Options: Approval, approval with conditions as provided in the above section, or
denial of request.
