Item: Public hearing and consideration of a Conditional Use Permit to allow the expansion of
existing church facilities located at 1200 Foxfire Drive, the southwest corner of Foxfire and
Sebesta. (Planning Case No. 97-703)
Item Summary: This church was constructed before the site was within the city limits. The
proposal is to expand the facility from 6087 square feet to 9887 square feet and to bring the
parking lot up to code. Phase I of the expansion: will include the. addition of 3800 square feet, the
upgrade of 102 parking spaces, and the use of the existing gravel. drive for a maximum of one year.
The existing gravel drive will also be required to be upgraded as a fire lane.
Phase II will include the construction of 40 additional parking- spaces on either side of the drive.
The easterly portion of the site is reserved for future expansion. that will need to return to the
Commission for review. Phase I parking will exceed the .ordinance parking requirement by 69
spaces.

commercial areas, and from preserving historic areas...
Item Background: The site plan as presented to the Commission was .approved in 1995.
Conditional Use Permits. expire after a year (with one possible extension of 6 months) if no activity
is .undertaken. The. reason for such expiration dates is to ensure that. future sites meet the
requirements that. are in place at the time of construction. The only additional requirement that the
applicant. will need to meet is the .paving requirements for he fire lane (see above discussion
regarding Phase II).
Budgetary & Financial Summary: N/A
Staff Recommendations: If the Planning and Zoning Commission approves the expansion, Staff
recommends that the PRC comment relating to the paving standards be a condition of approval.

City Attorney Recommendation/Comments: Section 14 of the Zoning Ordinance authorizes the
existence of conditional uses. The Commission may permit a conditional use subject to
appropriate conditions and safeguards, when after public notice and hearing the Commission finds
that
1. The proposed use meets .all the minimum standards established in the ordinance for the
.type. of use proposed;
2. That the proposed use meets the purpose and intent of the ordinance and is in harmony
with the development policies and goals and objectives as embodied in the Comprehensive Plan for
Development of the City; and
3. That the proposed use will not be detrimental to the health, welfare, and safety of the
surrounding. neighborhood or its occupants, nor be substantially or permanently injurioti~s to
neighboring property.

The Commission may impose additional reasonable restrictions or conditions to carry out the spirit
and intent of the ordinance and to mitigate adverse effects of the proposed use. These requirements
may include, but are not limited to, increased open space, loading and parking requirerY-ents,
additional landscaping,: and additional .improvements such as curbing, sidewalks and screening.

Streets:.. Sebesta Road currently provides. and will continue to provide access to the site.
Additional. access: may be taken off of Foxfire if the .drive is upgraded to meet paving
standards.

Sidewalks: A 6' sidewalk is existing along Sebesta Road
Drainage; Detention will be required on site.
Flood Plain: According to the 1992 FEMA maps, the site is not located within the 100
year floodplain
