(Planning Case No. 97-702) Item Summary:. The subject location is a 1200 sq ft leased site of Lot 39FR in the Southwood subdivision. The lot is currently zoned C-1 and includes a retail shopping center and ofI•ices that are east of the proposed tower location. Immediately to the north are multi-family housing units zoned R-6. The property to the east is also zoned R-6. To the south and southwest are more retail shopping buildings and offices zoned C-1. Southwood Drive runs along the northeast edge of the property with. multi-family units zoned R-6 across the street. Item Background: To date, several cell towers have been approved by the P&Z as conditional uses. These. have all been located in the undeveloped areas of the City. The_needs of the industry are resulting in additional. sites_being sought in the urbanized area of the. City. Such uses are. listed as conditional. uses in most of the. City's commercial zoning districts. Budgetary & Financial Summary: NA Staff Recommendations:.. Staff generally does not make recommendations regarding Conditional Uses. Should the Commission find that the subject site is suitable for the. proposed use, Staff recommends that approval be conditioned on all PRC comments. Related Advisory Board Recommendations: The PRC reviewed the site plan on March 5 and recommends that there be a wooden screening fence installed around the perimeter of the lease site (the letter describing the site states that a chain link fence with slats will be installed, which-has not been accepted by the City as appropriate screening...materials) andahat the driving surface leading to the site be paved (the site plan currently shows gravel, which does not meet City standards). City Attorney Recommendation/Comments: Section 14 of the Zoning Ordinance authorizes .the existence of conditional uses. The Commission may permit` a conditional `use subject to appropriate conditions and safeguards, when after public notice and hearing the. Commission finds that. L The proposed use meets all the minimum standards established in the ordinance for the type of use proposed; 2. That the proposed use. meets .the purpose and intent of the ordinance and is in harmony with the. development policies and goals and objectives as embodied in the Comprehensive Plan for Development of the City; .and 3. That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property. These requirements may include, but are not invited to, increased open space, loading and parking requirements, additional landscaping, and additional improvements such as curbing, sidewalks and screening. Flood Plain: According to the FEMA FIRM maps, this property is not located within the 100-year floodplain. Oversize request: n/a Parkland Dedication: Not required.
