Wellborn Road Corridor -Gateway to TAMU George Bush Library, TAMU Special Events Center, Ofsen Field, Kyle Field, Northgate. The request fora conditional use permit for the Traditions night club is one that I hope will bring about some planning for future use of the Wellborn Corridor. This is a good example of what we may very well .experience in the near future with other requests .for uses in this area. The time. has come for us to develop some specific planning for the Wellborn Corridor, just as we have for University Drive and Wolf Pen Creek. I encourage you to pay close attention to the reasoning behind the Planning and Zoning denial of the request for a conditional use for the Traditions night club at 305 Marion: Pugh Dr. in the Wellborn Road Corridor: Please refer to the minutes from the two P & Z meetings where this request was reviewed by the P & Z Commission (dated Feb 6, March 20 ). My name is Hans Betten, and I speak on behalf of Tracy Moody, myself, and the other investors who have an interest in the business, known as Traditions. Section 14.2.C of the Zoning Ordinance states that the commission may permit a conditional use subject to appropriate conditions, if the Commission finds: 1.) That the proposed use meets all the standards established in this ordinance-for this type of .use; 2.) That the proposed use meets the .purpose-and intent of this ordinance and is in harmony with the development policies and goals and objectives as embodied in the Comprehensive Plan for Development of the City; and 3.) That the proposed use will not be detrimental to the-health, welfare, and safety,of the.surrounding neighborhood or itts occupants, nor be substantially or permanently injurious to neighboring property. 305 Marion Pugh does meet all the minimum standards established in this ordinance. We 'feel that it also meets the purpose ..and intent of this ordinance, and coincides with the goals and objectives of the cities. plans for growth and development. As for the third criteria, we feel that this use will not be detrimental to the health,'welfare, or safety of the surrounding community. We feel that this use will beautify a currently overgrown, trash collecting piece of property. It will also help to'light and bring activity.. to 'a currently dark, secluded area. This building has been vacant for three years. The reason for this is that no one wants to pay top dollar to occupy this building for industrial use. We'are proposing a business, which will be able to use this property, and will be less detrimental to its. surroundings than its previous use. Another concern that he Commission addressed was that they feared that this business endeavor is temporary. They raised questions as to what would become of this property and its surroundings in the future. My associates and I have come to love College Station, and plan to live here for the rest of our lives. I assure you that we have every intent of complying to the rules, regulations, and conditions set upon us. We also plan to contribute to the community and to Texas A&M in the years to come. We have already made plans to be involved in March to the Brazos and the Big Event.. It has also been brought to my attent-ion that it is one of the goals of the City of Col ege Station to keep some of the young students coming out-of Texas-A&M in the community. The Planning and Zoning Commission denied us a Conditional Use Permit once before when it met on February 6, 19.97. Wewere scheduled to appeal at the February 27 City Council meeting, but two days before the...meetng we were informedthat we had to return to Planning an Zoning, because of a notification error with the first meeting. All of the issues addressed in this letter up to this point were addressed in my first appea letter from February 10, 1997. During this last meeting, Planning and Zoning expanded on their reasons for denying us the first time. It seems that everyone is concerned with the impact our business will have on the health, welfare, and the safety of the community. The Commission addressed pedestrian traffic, automobile traffic, parking. in the neighborhoods across the street and the possible impact that we would have on the Historical District across Wellborn. We have come up with possible solutions to these reasons of opposition. These solutions include; 1.) If the property owners.. between the Mcdonalds and us agreed, we could construct a 10 ft'-high fence to run from the Mcdonalds to the end of our property. It is already impossible to cross .the tracts at the concrete plant because of current obstacles, This would'elminate many problems. It would create a greater buffer: between'Wellborn and the Treehouse apartments. It would create a significant buffer between us and the neighborhood across the street, including the Historical district. It would keep headlights from our place and from the apartments out the homes. It would at the same ',time-keep the headlights from the streets across'Wellborn from reaching the apartments. A 10 ft high fence would definitely keep pedestrians from crossing the railroad, except for at, the Wellborn. and George Bush intersection. This fence... would also keep-my patriots from parking in the neighborhood across the street. 2.) We have contacted the Department of .Transportation and the railroad. They informed us that with the expansion of the Wellborn and'George Bush intersection, they are updating the railroad crossing. 3.) The expansion of Zuther and Jones Butler will help to take some. of the congestion off. of Marion Pugh. 4.) We would also. like to work on the continuation of Marion Pugh to Hollman. .This would be beneficial to the city, to the growth of that area,_and to the property owners on Marion Pugh, including the apartments. 5.) We plan to have' nightly monitors of the parking area to control the conduct of our patriots, police trash, and to keep parking off of Marion Pugh and out of the apartments. We are brainstorming everyday_to come up with solutions to the concerns which have been brought to 'our attention. We would like to work in harmony with the surrounding neighborhood,. and become an asset to College $~.aton. Because of the reasons stated above, we feel that we have a basis to appeal the decision, given by the Planning and Zoning Commission, to decline "Traditions" its Conditional Use Permit.. I manage Treehouse: Apartments: and find great difficulty in "acknowledging" and approving of the rezoning and implementation of a night club on 305 Marion Pugh.. Treehouse Apartments has been known for its ..great location, accessibility and the type of environment and atmosphere to promote successful learning & development at Texas A& M University. Allowing a nightclub within 200 feet of Treehouse would. be financially and aesthetically disastrous, not only to our business but to the environment of 100 % of our residents being students. The average age is between 18 and 22. 'The majority of the rents are being paid by parents.. Parents will not condone .their children} residing next door to a night club. Statistics show that crime, dnuilcenness and car accidents involving drunk or inebriated individuals increases near "night clubs". Marion Pugh was not designed to accommodate such a high volume traffic business, as would be the case with a nightclubs Accidents will be more likely o occur with this increase. Why should we allow our apartments to close down and subject our decent law abiding residents to be exposed to this? We are deeply opposed to the rezoning appeal. Marion Pugh was zoned for residential use. We appeal to you, please keep Marion Pugh residential. Allowing a night club would mean disaster in not only the quality of life of our residents but will affect Treehouse and other businesses in the close proximity. CONIIv1ENTS: Here is the revised site plan for the Traditons Niaht .Club. The angled parking spaces took more width across the parking lot even with the reduction in aisle width. We were able to get more parl~ing with the head in scenario than the than the angled parking. The aisle widths have been increased to 23' and the setbacks adjusted as suggested. We can not fit a 2D' pavement within a 20' right of way, therefore, the fire lane requirement for a portion of the drive is not met, and we assume a variance for this will be needed. The main drive that will also serve as a. fire lane must be adequately marked and a minimum. of 20' wide. Clearly indicate where curbing will be installed. We agreed that if Debbie could address all of the. comments and submit 10 copies of the revised site plan on Monday morning, March 3, 1997 we could keep the site plan on the same PRC and P&Z schedule. Jane, Debbie Keating and myself met with all three applicants of the Traditions night club at 4:00 on Friday; February 28, 1997 to discuss the changes to the site plan and he vanance request to the parking requirement. They were given the option of redrawing the site plan and. revising the variance request accordingly or not revise. the site plan or variance request and wait to hear the outcome of the use only request before the Commission. They could continue with the site plan and variance request .(either to parking numbers or standards) at their own risk pending the outcome of the use only request before P&Z. AND'THE OTHER INVESTORS. IN THE BUSINESS."zs this not like buying a pig in a poke? Who are the others??? They cite Sec. 14.2C of .the. Zoning ordinance, listing the conditions: by which'they',should be permitted. I question their interpretation of the first two conditions, and I 'strongly protest their rendition of Item 3.1: That the proposed uae will not be detrimenta'1 to the health, welfare, and safety of the surrounding neighborhood or its occupants, nor be substantially or permanently injurious to neighboring property. These people have no idea of the health, welfare, ,age, and/or safety of any of the surrounding neighborhood. Compound this with the fact that the city DID NOT send. the required certified letters to six (6) addresses within the 200' boundary, so they literally knew nothing about the P&Z hearing, since. only one small .legal notice was published. Also one on this meeting. It WILL be detrimental to 'the health, welfare, and safety of the surrounding community: The proximity of the railroad, the congestion of Wellborn Road .and Marion Pugh Dr. (Treehouse Apts., the coming Melrose apts.,, the influx of drinkers); the loud music and''raucous behavior of drunks, the noisy comings and goings of autos, vans, trucks. at all hours into the mornings,will desecrate the peace andlquiet of our Historical SOuthside Area. TX 77840 Council Members, With regard to the appeal of the Planning & Zoning (P&Z) Commission's decision to deny a Conditional Use Permit request for the conversion of a vacant warehouse to a night club at Marion Pugh Drive, I would like to offer the following comments. Despite. the publicity that has indicated that the decisonwas based on subjective sorts of points, I believe that the request was-denied for very specific reasons. As a P&Z Commissioner, my vote to deny this request was based on three basic issues: safety, the integrity of the urrounding neighborhood, and_other general planning issues. From a safety standpoint, the nature of this business. and its close proximity to two major transportation thoroughfares creates the potential fore a hazardous.. situation. Patrons crossing the railroad and Wellborn Road to access this business run the: potential of being hit, especially if their judgement were impaired in any way. The moral liability hat I would -feel if a patron were hurt, not to mention the potential .legal liability of approving the request were important considerations in my decision to deny. It is my belief that the neighborhood surrounding this establishment would not benefit from. its presence. The South Side residents are struggling for an identity. They want to preserve an historical part of our community, but are feeling. threatened by such proposals that they believe are not conducive to attracting permanent residents to their neighborhood. I also understand that the Treehouse Apartments are opposing this, in part because a majority of their occupants are students who have parents who are not. encouraged by the presence-of such a business so close o where their children. live.. Thee planning issues I mentioned that caused me to vote against this request include the uncertainty of other development opportunities .resulting from the presence of such .improvements as the Bush Presidential Library Complex and the Reed Arena. Additionally, the unsettled nature of the Wellborn Transportation Corridor leaves me to wonder if such a proposedimprovement at this point is prudent. There maybe other opportunities that could develop in time as the effects. of these improvements are known. ', Page. 2 City Council April 10, 1997 It should also be said that the decision to deny this request was not an arbitrary one.. It was not based on the personalities of the applicants or the ability of such a business to survive. As reflected in the Planning & Zoning Commission minutes dated March 20, 1997,. the P&Z attempts to focus on the impact of such -proposals on the surrounding property and the city as a whole. I believe that this is the philosophical basis on which we .denied the Conditional Use_Permt. I personally believe that the efforts. of the applicants should be highly commended for their persistence and.drive to want to improve themselves. In this case, however this. seems to be a .good:-business proposal, planned. for the wrong location.. The currenf urrounding area is composed primarily of multi-family homes, a church, McDonaid's, and an exercise facility. Marion Pugh is a dead-end street with currently more titan 1,000 persons residing and traveling on it. The McDonald'd that opened in September 1996 is open 24 hours a day increasing the flow of Traffic round the clock. The quiet, peaceful enjoyment of the surrounding. homes has already been compromised. We feel. that the warehouse Deing utilized as a night club will encourage not on{y more traffic but an .unsavory marketing aspecf for the multi-family. homes/business. The three apartment communities houses primarily college age. (18-22~ persons.. Although this may seem ideal for those promoting ihls proposal, it is not ideal fnr chose established mufti-family homes. Mainly due to the fact that the parents of these college age students are fhe ones paying their rents, and having a nigh# club within waitcing distance to their children's homes would not be acceptable. There is as well, the crime element that ultimately follows or surrounds.an area where bars are. Those young men are determined, but so are we, the citizens of the Southside Historical Area who have every reason to NOT want this in our proximity. The parking. for this operation would be just about as bad as what the NorthGate area now endures. No matter how much noisy parking is provided. in a too-small area, that will do nothing to alleviate the impact of dozens of cars, trucks, vans (possibly even more for. a 10,000 sq. ft. beer joint) on narrow, crowded Marion Pugh Drive. This is the only access road, serving Tree House .apts. There is a crossing over the tracks at Holloman, and the other is George Bush and Wellborn, always a very dangerous intersection...drunk OR sober. The parking and traffic so close to very active railroad tracks would be particularly life threatening at -night, and believe me, 3-4 trains- go through right after midnight daily. Maybe a few life-threatening accidents will prove our contention thbe this project should NOT be approved by any governing body, it Zoning Board of Adjustment, Planning and Zoning, or the City Council OR any member of the city staff. This entire project is ill-conceived, and believe me, any parking you approve will spill over onto much-traveled Wellborn Rd....We are used to seasonal traffic problems in the fall of each year..but not something like this. on a permanent basis. YET: With no final decision to date: They are; continuing work on the building; have been permitted to urn an electricity; have moved-in tables and chairs; had live music and l0 kegs of beer last weekend, creating a disturbance in the surrounding neighborhood. HOW: Can they. proceed without council's final approval? HOW: Can they serve alcoholic beverages without a permit and approval from all concerned? WHAT recourse do we have if_they have openly violated codes? At the P&Z meeting, 3 you:sg men presented#;hemselves as the owners of this 9,`OZ5 sq. ~t. night club (A lot of space for beer drinking since dancing and .live entertainment were even turned down by the Planning Dept. recommendations) In their 2/10/97 letter of appeal, they identify themselves as "HANS BETTEN, TRACY WOODY, AND THE OTHER INVESTORS IN THE BUSINESS."Is this not like buying a pig in a poke? Who are the others??? They cite Sec._14.2C of the Zoning ordinance, listing the conditions by which they should be permitted. I question their interpretation of the first two conditions, and I strongly protest their rendition of Item_3.1: That the proposed use will not be detrimental to the health, welfare, and safety of the surrounding neighborhood or its occupants., nor be substantially or permanently injurious to neighboring property. These people have no idea of the health, welfare., age, and/or safety of any of the surrounding neighborhood. Compound this with the fact that the city DID NOT send the required certified letters to six (6) addresses within the 200' boundary, so they literally knew nothing about the P&Z hearing, since only one small. legal notice was published.. Also one on this meeting. It WILL be detrimental to the health, welfare, and safety of the surrounding community. The proximity of the railroad, the congestion of Wellborn Road and Marion Pugh Dr. (Treehouse Apts., the coming Melrose apts., the influx of drinkers),. the loud music and raucous behavior of drunks, the noisy comings and goings of autos, vans, trucks at all. hours into the mornings will desecrate the peace and quiet of our Historical SOuthside Area. Single family detached land uses are not compatible .with higher intensive uses without buffering (HOK) . The nightclubs already in B-CS will tell-you that they have to constantly seek new ways_to keep interest high..I seem to .recall topless nights, ladies free, contests. Why would this club be any different? The students are notorious for not slowing down for anyone...sober. Get 'em drunk and we really have problems. This will be further encroachment of a .commercial use and with various disturbances related to student activities. They seem to be saying what they think the governing boards want to hear to further"their cause. Not for one moment do I feel they have veered from their original intent of anightclub with its attendant loud .noises inside and out. The perils of the location, sandwiched beteen two residential neighborhoods of houses and apartments and the railroad tracks are still present..a customer can eat a sandwich from the grill but still spend hours 'drinking. The a men are not currently enrolled in A&M. They are not registered voters. They.. do not live in College Station. They were dismissed from the corps two years ago for being troublemakers. The corps commander says he does not want his cadets going to this club. In a real estate prospectus, the asking price for this location is $600,OOO...a one-year lease-purchase. option. These men have no visible means of support. Their other investors have not been identified. Again, I ask your continued vote against granting this request for what will be a major nuisance in the Southside Area.
