Dear Mr. Stuart, Several items are necessary for the issuance of a Certificate of Occupancy (C.O.) for the building at 1115 Welsh .Avenue. These items are basic ordinance requirements and have been noted throughout the development review process. Because we understand the needs of your tenants to occupy the building in order to provide basic ser~rices to their clients, we will .issue. a temporary and conditional C.O. This C.O. is temporary and will expire on Tuesday, March 31, .1998.. This temporary C.O. will allow your tenants as well as their clients to occupy the building. Prior to the expiration of the temporary C.O. the remaining ordinance requirements must be completed. These items may not be guaranteed. All items must be constructed or installed orr or before March 31, 1998 with no exceptions: ~ (1) .Install all elements ofthe landscape plan including the irrigation system. ( 2} The .parking lot must be striped and the proper handicap markings completed in accordance with the approved plans. (3) The following drainage related items must be completed. -- Submit an addendum to the approved construction documents (sealed by a registered professional engineer) that shows the "as built" conditions of the_ .parking lot and the necessary modifications of the detention pond in order to accommodate the site drainage. The parking lot was not constructed. in accordance with approved plans .which may cause some redesign of the detention pond or parking lot. This construction addendum must be submitted and reviewed' by .City staff prior to construction. of the detention facility. -- Construction of the detention pond and associated infrastructure as shown on the revised and approved construction documents. -- -Fine grading of the site to include general clean-up and forming earthen berms along Welsh Avenue in accordance with the approved plans.. Issuance George Stuart Page 2 of 2 ( 4) Mr. Stuart must sign.and/or obtain the necessary easement documentation for the off-site 20' public utility easement for the sanitary sewer and storm sewer. The City's Legal Department is currently reviewing the .easement dedicated to Mr. Stuart. by the Wozencraft Family. The City must be given the necessary rights to access and maintain the public utilities within this off.-site easement. ( 5) Installation of lintels for masonry support at all exterior window and door openings.. (A letter signed and .sealed by a registered professional engineer may be submitted in lieu of installing the lintels if the engineer can verify that the masonry is self-supporting.) ( 6) The conduit installed .for electrical service to the building leaves your project site .and crosses. onto private property. You must relocate the conduit and sernce onto your property or secure an easement from the impacted property owner. Please note the importance of addressing all of the above items.. We can not issue the permanent C.O: until all of the above mentioned items have been completed. While we will do everything we can to assist you in meeting these requirements, we are relying on you to take the action necessary. to do so. (cont.): ( 8) Cost estimates sealed by a registered Engineer to be reviewed and approved by staff that includes the following costs as if the City of College Station were responsible. for the following: -- Construction of the detention pond and associated infrastructure as shown on the-approved construction documents. -- Redesign of the drainage for the site that takes into account the existing parking lot. The parking lot was not constructed in accordance with approved plans which may -cause some redesign of the detention pond or parking lot. -- Modifications to the parking lot that may have to be made in order to properly drain runoff from the parking lot to the detention pond. -- Fine grading 'of the site to include general clean-up :and forming earthen berms along Welsh Avenue in `accordance with the approved plans.. The following revisions have been made: 1) The proposed junction box shall change in size from a 5' X 15' box to a T X 15' box. The addition width will allow for a capacity of 92.39 c.f.s. at full-flow capacity of the upstream 36" R.C.P.. 2) The proposed 6" sanitary sewer crossing through the proposed junction box shall consist of a 7" steel encasement pipe as protection and maintenance access for the carrier pipe. Penetrations through the junction box shall. be made water tight. 3) The cross-section at the proposed sewer line has been shown to reflect the junction box flowlines. The junction box flowline data is as follows: • FL (36" In) = 310.76 • FL (36" Out) = 310.38 • FL (@ Sewer) = 310.51 The proposed junction box will be laid at the existing storm sewer grade of 2.54%. However, we understand the needs of your tenants to occupy the building in order to-provide basic services to their clients. In order to facilitate your tenant's service delivery we will issue a temporary and conditional C.O. This. C.O. is temporary and will expire after 45 .days .from. the. date. of issuance. The C.O. will include a condition limiting occupancy to employees of the tenant agencies. This temporary C.O. can not be issueduntil the following items have been completed:. ( 1) The electrical and mechanical subcontractors must request and pass the final inspection for each of their jobs. ( 2) The Building Official and. Fire Marshal mush inspect and pass the final building inspection. Major .pending items include 'fire dampers and door closers. The final building.. inspection can .not be performed until the electrical and mechanical inspectians have been passed. ( 3) The erosion control silt fencing shown on the construction plans must be in place until such time that the detention pond is constructed and accepted by the City and the vegetative ground cover has been sufficiently established to prevent erosion. Prior to .the expiration of the 45 day temporary C.O. the remaining .ordinance requirements must be completed. These include: ( 1) A letter of credit or guarantee in the amount of $11,350 must be submitted for the plant material that is shown. as part of the landscaping plan but not yet installed. RUSSELL PATES College Station Holleman & Welsh Office Building Time Line March 4. 1997 - A predevelopment meeting was held with Mr. Stuart to discuss his proposal for an office building that will house the Texas Rehabilitation Commission and the Texas Commission for the Blind. Staff discussed platting issues, utility availability and possible extensions, potential ZBA variances and the City's development review process. September 24. 1997 -Municipal Development :Group (NIDG) submitted the final plat. September 30. 1997 - MDG submitted the site, landscaping and grading plans for review by the Project Review Comnuttee (PRC). This same day, Mr. Stuart requested a slab only permit to start construction. Staff informed him that the City would not be in a .position to issue such a permit until the PRC approved the site plan and reviewed. the final plat. Staff agreed to discuss the possibility of issuing a slab only permit at the PRC meeting. .October 6. 1997 -Staff faxed NIDG a copy of the concerns identified by staff after their review of the final plat and site plan. These concerns would be discussed in more detail at the PRC meeting. October 8. 1997 -The PRC reviewed and recommended approval of the final plat with several conditions. The final plat was scheduled for the November 6, 1997 Planning and .Zoning Commission meeting. Mr. Stuart informed staff that the building had to be completed by December L, 1997.: He needed a,buildng permit as soon as possible and could not wait until after the Commission :meeting for a permit. Mr. Stuart stated that he had to start the project immediately or he could lose the entire. deal. He again requested a slab only permit to at least get started on the project. The PRC reviewed and approved the site .plan with many conditions and concerns. Staff agreed to the following at the PRC meeting: To issue a slab only permit .given the following parameters:. _ The applicant submit the revised .site plan :addressing the concerns outlined in the meeting that could potentially impact the site layout. (Staff .offered to review the revised site plan between 2:00 and 3:00 the same day. If the revised site plan was not received by 2:00, the five day turnaround time would be necessary given. staffs schedule over the. next few days. The revisions were received at 4:00 and staffreviewed them that afternoon.) _ Monetary guarantees for the infrastructure associated with the final plat would be required before a full building permit is issued. A Certificate of Occupancy would not be issued until the final plat is filed for record'. October 9, 1997 -The slab only permit was issued. October 10 1997 thru October 19, 1997 -Staff worked closely with MDG reviewing and revising site and construction plans. October 20, 1997 -Staff approved ,the full construction. documents with the exception of two details; the landscape screening berm and the junction box. detail. The full building permit was issued. November 4, 1997 -Staff approved the details. for the landscape screening berm and the junction box detail. A .copy of the approved :details were faxed to NIDG. November 6. 1997 - P&Z approved the final.. plat with staff recommendations. November 13. 1997 - Staffrnailed a copy of the approved screening berm and junction box details to Mr. Stuart and asked that he attach the details to the approved plans that are kept on the site. Months of November & December -Natalie and Shirley drove by the site several times to check on the progress of the development. Over the Christmas Holidays - Mr. Stuart called and requested a final building inspection. At this time, the subcontractors had not requested a final inspection for the electrical, mechanical or plumbing work. Natalie Ruiz started working on the C.O. punch list. for the entire project. December 29, 1997 -Natalie discussed many of the outstanding. items with Mr. Stuart including the sanitary sewer. line, junction box, landscaping,. final inspections,- etc. Natalie met with Engineering Inspector, Jerry Jones on the site to determine what engineering: details needed to be completed. The contractor responsible for installing. the sanitary sewer ne from the main to the building was just beginning work. He informed staff that the junction box was not a part of his bid. Natalie and- Jerry informed the contractor and Mr. Stuart that the junction box must be installed with the sanitary sewer line. as,designed by MDG. December 30 1997 - Mr; Stuart faxed Natalie a letter requesting "120 days in which to complete the details not directly associated with the building itself'. December 31. 1997 -Natalie met with Mr. Stuart and discussed a draft "punch list" of outstanding items that must be :addressed prior to issuance. of a C;O. The final punch list was faxed and mailed to Nir. Stuart. (See letter dated December 30, 1997.) The .electrical. department attempted to install the primary service from Holleman Drive to the transformer. Jerry Garrett and Rob Bullock noticed that the conduit installed by the contractor, Ron Lowe, had too many sharp bends. The stub out for the transformer was also tilted and placed closer to the property line than. shown on the approved .plans.. Jerry .and Rob agreed to try and pull the. conductors through;:. however, they were unsuccessful The contractor was told to straighten out the conduit so that the service: lines could be installed. January 2. 1998 -Shirley Volk met with Mr. Stuart, Doug Harrison and Keith Stanford (Representatives of the Commission for the Blind & Rehabilitation Commission). They discussed the letter and discussed the possibility of a temporary C.O: once all health and safety related items were completed including the sanitary sewer line, building code requirements, etc. January S. 1998 -The electrical department connected the secondary system from the transformer to the building. Jerry Garrett and Rob Bullock noticed that the conduit placed by the contractor from the transformer to the .building was incorrectly placed approximately 2' on the adjacent property. They spoke with the utility contractor,. Ron Lowe, and agreed to connect the electrical service temporarily given the time constraints placed upon the owner. At that time, they informed Mr. Lowe that he had the following two options: Relocate the conduit onto the subject property Obtain a public utility easement from the adjacent property owner. Jerry and Rob explained that since the City is responsible for the service to the building, they need access to the line for future repairs. This access can be given through an easement on the adjacent property or by relocating the service to the subject property.. In an effort to facilitate the completion of the building; Lance Simms approved an electrical "early on" to .allow electricity to the building. The Building. Official has the discretion to allow an "early on" in certain situations and he allowed one in this case.. January 6. 1998 -1VIr. Stuart paid his portion of the electrical service costs to the building. (This was item #5 in the punch list dated December 30; 1997.) He submitted a personal letter guaranteeing that the landscaping and drainage items will be accomplished within 120 days. Mr. Stuart also submitted a mortgage commitment letter and. agreed to escrow the exact amount of the drainage improvements:once determined. Natalie informed Mr. Stuart that the City requires a letter of guarantee from a lending institution :prior to issuance of a C.O. The other 9 items on the punch list must be taken care of before issuance of a C.O. .Ianuary' 7...1998 - Jirn Callaway met with Mr. Harrison and Mr. Stuart to discuss the punch list. Jim agreed to issue a temporary and conditional C.O. for 45 days to allow employees only in the building once several health and afety related items were completed. Within the 45 day time frame;... the remaining items. on the punch list must be completed: and/or guaranteed; (The details of this agreement are outlined in a letter from Jim on January 7, 1998.) February 23, 1998. January 14. 1998 - Mr. Stuart and NU. Harrison met with Tim, Lance and Natalie. to discuss the remaining items on the punch list. Mr. Stuart stated that he could not guarantee both the landscaping and the drainage improvements._Mr. Harrison expressed concern that ahe State may have to cancel he lease agreement and find facilities elsewhere. January I5, .1998 -Natalie and Vern Wright, the engineering inspector, inspected the. site and went through the engineer's estimates to "check off' the items that had been completed since the letter was written in order to lower the total amount to be guaranteed. Two items on the list had been completed and the total amount to be guaranteed. was reduced by $3200 for a total of $13.,953 in drainage improvements. A temporary C.O. was issued to allow- employees and the public to occupy the building. All items remaining on the punch list must be constructed or installed on or before March 31, 1998 with no exceptions. The developer no longer has the option to bond the remaining improvements. Dear Mr. Stuart, This letter. is o touch base with you regarding the items necessary for the issuance of a permanent Certificate of'Occupancy (C.O.) forthe building at 1115 Welsh Avenue. On January 15, 1998y the City issued a temporary and conditional C.O. to allow the two State: of Texas organizations to provide services to their clients. There were six items outlined with the temporary C.O. that had to be constructed or installed on or-before March 31, 1998 with no exceptions. (These items are outlined in a etter to you on January 15, 1998. that is attached to the temporary C.O.) after a site visit on Friday, February 13, 1998, I noticed that the. majority of the items on the original list have been addressed. The following is a st of items that are still outstanding: (1) Install all elements of the landscape plan including the irrigation system. Once the irrigation system and all plant materials are installed, staff will inspect the landscaping and verify that the irrigation system is operational: ( 2) Fine. grading of the site to include general clean-up and forming earthen berms along. Welsh Avenue in accordance with the approved plans The subject property a»d ;any adjacent properties that were disturbed during construction must be graded and either seeded or sodded There are a few areas on and off-site that need to be addressed. (The areas off-site include the existing transformer location near the convenience store and the adjacent Wozencraft .property to .the .rear. These areas were disturbed during the installation of electrical conduit, sanitarysewer and storm sewer. infrastructure. The trees that were. cut down need to be removed and the site needs. to be graded and either seeded or sodded.) The approved plans show three berms that .are parallel to Welsh Avenue near the front of the property. The purpose. of these berms was to screen the transformer and the parking lot from Welsh Avenue. (The original plan showed a row of shrubs along the back of the building that would not be visible from Welsh Avenue. Mr. Stuart asked o move those shrubs into the islands so they would be more visible.) A'"revised" irrigation system plan. A "revised" site plan showing the changes to the detention area. ~' Mr. Stuart asked about the screening. of the transformer location. On the revised .plan he shows two shrubs in front of the transformer to screen it from Holleman. I expressed concern that the two shrubs may not be'adequate and that additional screening may be required. I agreed to visit'the site and take a look at what'he's done and get with him later. Lance and I spoke with Mr. Stuart over the telephone and informed him that a check valve will be '~ required at the meter for the irrigation system. Before installation of the system, a licensed irrigator or a certified plumber must pull the .permit. Upon the inspection of the landscaping, staff will check to make sure the irrigation .system is operating properly. I hand delivered a copy of .the list of acceptable back flow presenter's to Mr. Stuart on Friday, January 30, 1998. I reviewed the revised .site plan with Veronica: on Friday, January 30, 1998 and we noticed that the changes to the site plan were made by Greg Taggart. with 1VIDG and dated 1/97. The seal on the plan was by North Barden on October 17, 1997. The revised plan did not show the information referenced in the January 15, 1.998 letter to Mr. Stuart. The plan did not include as built conditions and was not sealed properly by a registered .professional engineer. Veronica requested that I set up a meeting with North, Greg and myself at their office to discuss the information submitted. Than same ,.Friday afternoon, I spoke with Mr. Stuart and informed him that the revised site plan submitted is not acceptable. I told -him that we would set up a meeting with NIDG as soon as possible to discuss the situation. Mr. Stuart expressed concern that his contractor is trying to beat the rains forecasted for -the weekend and could not wait until next week for an answer. I stated that I could not give him the authorization to proceed with the detention area without an approved set of plans that were properly sealed.
