Subject: Fwd: TxDIGITAL Galindo plans
fyi -this is from our conversation with Chris about deleting the storm sewer in the street and instead use
"diverter swales" to keep the stormwater from getting to the street so it can function per our ordinance.
looks like mr. bowers cant get the easements necessary to construct these channels. if they dont get us
those easements and construction drawings the street will need to be constructed as originally designed
with the storm sewer.
just fyi....dont issue any permits until this issue is cleared up. thanks

changes to the referenced report.
1. Construct berms on either side of Yechnology Parkway Instead of the originally proposed channels.
:These berms wilt prevent ad joining areas runoff water from. reaching the road. They are designed to
handle a 1 t>D-yr rain.
2. Construct relieve channels on behind the curb on either side of Technology Parkway. These channels
- witl collect runoff from upstream road surface through at least one 4'-wide curb cut on both sides of -the
;road as defined to the origins! report.

Per our telephone conversation today, the .original 3" water meter that you purchased in July of
1998 for 405 Technology Parkway may be reduced to a 2" water meter per the revised demands
provided by Bi11 Scarnmardo. As we discussed, we'will forward a work orderto our Water/Waste
Water Division to install the 2" tap`prior to receiving the $200 fee. 'Please submit the additional
$200 tap fee no later-than Monday, May 10, 1999.

ON FRIDAY, MAY 1, WE RECEIVED A COMPLAINT FROM A MR CHARLES KNIKER, OWNER
OF LOT 13 ON BROOKWATER, WHICH IMI~~DIATELY BACKS UP TO THE TDS PROPERTY.
HE SAID THAT THE TDS OWNERS WERE ERECTING A SECOND BARBED WIRE FENCE, THUS
CREATING A 40'-50' STRIP. THE WORKMEN INFORMED MR KNIKER THAT THE INTENT
WAS TO RUN CATTLE ON THIS AREA. MR. KNIKER QUESTIONED WHETHER THE CITY
WOULD ALLOW SUCH ACTIVITY, TAKING INTO CONSIDERATION THAT THE AREA WAS
DESIGNATED AS A BUFFER AS AGREED TO IN THE ORIGINAL REZONING TO M-1 WITH
DEED RESTRICTIONS AND THEN'.REQUIRED BY THE FINAL R&D ZONING THAT REPLACED
THE M-1 ON THE TDS PROPERTY.
WE RESEARCHED BOTH REZONING FILES, THE PRELIIvIINARY AND FINAL PLAT FII.ES, THE
SITE PLAN FII,E, AND THE R&D BUFFER RESTRICTIONS. LEE WENT OUT TO LOOK AT THE
AREA, AND JANE SPOKE WITH BOB BOWERS. BOWERS TOLD JANE THAT THE AREA HAD
ALWAYS HAD SOME CATTLE ON IT, AND THAT HE HAS PROVIDED A PASSAGE BETWEEN
TWO PASTURES FOR 4-6 COWS TO ACCESS. HE ADDED THAT THE INTENTION IS STII.L TO
MAKE THE LOTS THAT MAKE UP THE BUFFER ZONE AVAILABLE FOR SALE TO THE
ADJACENT PROPERTY OWNERS IN ,THE FUTURE, AND THAT THE PASSAGE AREA IS
TEMPORARY.
WE HAVE MADE THE FOLLOWING FINDINGS:
1. THE WRITTEN REFERENCES TO THE BUFFER AREA IN THE FILES STATE THAT
THE AREA IS TO BE MAINTAINED IN ITS "NATURAL" STATE AND THAT THE LOTS
IlVIlv1EDIATELY ADJACENT TO THE R-1 AREA ARE TO CONSTITUTE THE BUFFER
2. THE R&D RESTRICTS 'ACTIVITIES WITHIN A BUFFER AREA TO PASSIVE
RECREATION, INCLUDING EQUESTRIAN TRAILS. FROM A LAND USE STANDPOINT,
PROVII;ING A PASSAGE FOR CATTLE IS SIIvIILAR TO EQUESTRIAN TRAIL.
PROVIDED THAT THE ANIMAL DENSITY REMAINS LOW.
3. JANE AND I WERE INVOLVED IN ALL OF THE MEETINGS THAT TOOK PLACE
BETWEEN BOWERS AND THE NEIGHBORHOOD GROUPS. OUR RECOLLECTION IS
THAT THE .BUFFER AREA ' WAS TO REMAIN NATURAL, IlvIPLYING THAT NO
ADDITIONAL PLANTINGS Olt IRRIGATION WOULD BE REQUIRED. IN EXCHANGE
i
FOR RELIEF FROM THE ADDITIONAL COST OF PLANTINGS AND IRRIGATION,
BOWERS AGREED TO A LARGER BUFFER AREA THAN WOULD BE REQUIRED
UNDER R&D REQUIltEMENTS. BOWERS ESSENTIALLY AGREED TO SUPPLYING 4.1
ACRES RATHER THAN THE 1.4 ACRES THAT WOULD HAVE BEEN THE r~III~TIMUM
REQUIRED UNDER THE MA~QMUM R&D BUFFER STRII'.
THEREFORE, STAFF HAS REACHED THE FOLLOWING CONCLUSION:
BOWERS IS PERMITTED TO RUNA REASONABLEAMOUNT OF CATTLE THROUGH THE
BUFFER AREA AS LONG AS THE PROPERTY REMAINS UNDER HIS OWNERSHIP AND
WITH THE CONDITION THAT A SUBSTANTIAL AMOUNT OF THE NATURAL VEGETATION
REMAINSINTACT.

I think we can review this via .redlines. The concept is the. same, they apparently have changed their
mind regarding building locations and phasing.. 1 am handling this as a first review for engineering since:
1. We do not have any engineering redlines except for the PRC comments.
2. There have been enough changes (details and site layout) that we just can not review from redlines.

I started to take a look at them and they have redesigned the site a bit. What used to be phase II is now
part of this phase.:and they have omitted the building: at the end of the street where the flagpole is
proposed. Some. of the redlines we made. still apply, but others will not.

check room. These. plans include-the site plan revisions. Please check these plans so I can return them
to the architectural firm. I have placed the-planning. case file in the plans check room foryour use while
reviewing these: plans. I know we are running .late on checking these plans, and I will call Bill Scarmardo
and explain since today is actually the 5th day we've had #hem.

Karl, I just talked. to Bill Scarmardo who is the architect for this project, and he says that Texas. Digital
Systems will not be manufacturing boards at this facility so there will be no acid wash at this operation.
They buy the manufactured boards from somewhere else. They will be soldering on the .boards here,
and they have a shakedown room, but none of this waste will be going into the sewer system. He says
the only things going into the wastewater system will be from the bathrooms and then the stormwater
system wilF handle the runoff.

they. wash their boards with? Will they recycle a separate "none water" liquid to wash the boards or will
they be directly disposing of all waters down the drain?
I need to ask the same question of the other computer company coming into town.

I had a call from Bill Scarmardo this a.m. telling me that he has
made contact with the Ledbetters, and they tell him that they
have returned the signed easement to the city. I don't know who
to or when, so thought I'd send this to everyone who might have
anything to do with it to see if the easement is sitting on
someone's desk somewhere!- Since I have not been involved in this
for a long time I'm not real sure. what it's for, :but I think it's
an easement to cover an off-site extension of either a drainage
system or a sewer system (I think really it's sewer) for thee.
Texas Digital System development along the east side of the BP,
south of Sebesta Road. Mark, I think Kent worked on this, so I
included you in this memo.
Please look to see if .you have the easement, and if so, let me
know,. but get the easement to either Jan or Lisa in Legal asap.
