assumption of that one certain Promissory Note in the Original
Principal sum of Sixty Thousand and No/100 ($60;000.00) Dol ars as
of March 1, 199:7, as described in the deed recorded in Volume 2791,
Page 85, of the Official Public Records of Brazos County, TE:xas.
Property. (Including Any .Improvements):
BEING a tract containing 14..095 Acres of land, more or less, out of
the ROBERT STEVENSON SURVEY N0. 54,-Brazos County, Texas, as more
particularly described in the hereto attached Exhibit "A"
ncorproated herein by this reference and made a part hereof for
all purposes.
Reservations from and Exceptions to Conveyance and Warranty:
Any easements, rights.-of-way, and .prescriptive rights,. whether of
record or not; all presently recorded restrictions, reservations,
covenants, conditions, oil and gas leases, mineral severances, and
other instruments, other than liens and conveyances (except for the
lien herein being assumed), that affect the property, rights of
adjoining. owners in any walls or 'fences situated on a common
boundary; and discrepancies, conflicts, or shortages in area or
boundary lines; any encroachments or overlapping of improvements.
Grantor, for the consideration and subject to the reservations from
and exceptions to conveyance and warranty contained herein, grants,
sells, and conveys to Grantee the property, together with all and
singular the rights and appurtenances thereto in any wise
belonging, TO HAVE AND TO HOLD it to Grantee, Grantee's successors
or assigns forever. Grantor binds Grantor's successors and assigns
to warrant and forever defend all and singular the property to
Grantee and Grantee's successors and assigns against every person
whomsoever lawfully claiming or to claim the same or any part
thereof, except as to reservations from and exceptions to
conveyance and warranty contained herein..
