The grantee is responsible for all costs associated with the construction of this access driveway. 2. Maintenance of facilities constructed hereunder shall be the responsibility of the grantee, and the State reserves the right to require any changes, maintenance or repairs as may be necessary to provide protection of life or property on or adja- cent to the highway. Changes in design will be made only with approval of the State. 4. The Grantee shall hold harmless the State and its duly appointed agents and employees against any action for personal injury or property damage sustained by reason of the exercise of this permit. 5. The Grantee shall not erect any sign on or extending-over any portion of the highway right of way, and vehicle service fixtures such as service pumps, vender stands, or tanks shall be located at least twelve (12) feet from the right-of-way line to ensure that any vehicle services from these fixtures will be off the highway. 6. This permit will become null and void if the above-referenced driveway facilities are not constructed within six (6) months from the issuance date of this permit. 7. We had previously discussed the project with Vice President Gaston and General Peel, and since our conversation, the owner of the property, Bob Callaway of San Antonio, has met with Dr. Gaston. American Campus Lifestyles of Austin who propose this project have chosen Jack Craycroft of Dallas as the architect and our firm, Municipal Development Group, will do the site engineering. We have also talked to Jim Callaway, Director of Development Services for the City of College Station and with Bill Riley, the City's water and sewer superintendent and asked them to begin discussions on possible billing procedures from TAMU to the City of College Station and then from the City to the Owner of the project. tVe are currently canning profiles and doing field topograpa.y to establish the site and eievation of existing sanitary sewer facilities on the Campus in that area. We are hopeful that the recent storm drainage construction on George Bush Drive will not prevent gravity flow from the proposed 3.5 acre project site. We are aware that the proposed sanitary sewer line will have to be bored under George Bush Drive and we may have to use a lift station on our site to deliver the sewage. 000604-c.04-20(2836) ,,. It is the intent of the people on this project to produce a visually pleasing, enduring structure which is complimentary to the campus. We expect to pay for all sanitary sewerage facilities constructed on the campus to serve this project and to satisfy all the conditions you might impose. Date: 2/21/96 2:OSpm Subject: Infrastructure "Problems" -Reply -Reply Kent's on the right track- if one of our Council Issues to address for this year is the attraction development of retail business then we need to have the infrastructure to support that business. Pushing those costs onto the individual developments will deter, not attract, the desired retail growth. »> Kent Laza 02/21/96 10:22am »> Pll give you my opinion on how this should be handled if you'll tell me how the others reply. I believe if a business is locating in a developed area where water and sewer utilities are akeady available, the city should allow their development to take place. It is the city's responsibility to monitor it's infrastructure system. and make improvements as necessary. If the development causes capacity problems off-site, the city has two options. First, expand the facilities that are being overloaded as soon as possible without the expectation of reimbursement from the development. This would be appropriate for small businesses like McDonald's that will not place unreasonable demands on the system. This would be a cost the city would accept as an inticement (or at least one less hinerance) to these businesses. Second, in the case of major development (a defmmition will be necessary) where demands on the system will cause serious problems to existing customers, some sort of development agreement or impact fee be implemented to pay for the improvements. These types of developement generally do no occur overnight and the city should have plenty of time to build the necessary infrastructure to serve it. If we expect small developers to pay for infrastructure improvements (whether it's water, sewer, drainage, or streets), we will run them all off They simply can't afford to do business. Pd vote to let McDonalds, and any other small business on Marion Pugh, George Bush, or Colgate come on in. We'll deal with the consequences ourselves. Now you know my opinion. (Robert Callaway Corporation developed Treehouse, etc., and owns that land to the north of the complex). Callaway's tract of land is across Marion Pugh Drive from the tract McDonald's was interested in that we talked about some weeks ago. (On the same side of George Bush Dr. ) More and more we are going to have inquiries about the possibility of new development along and in the vicinity of George Bush Drive, and we are still unable to answer any questions. We had to tell people last week that "we don't know" in a Predevelopment Meeting when the question about the extension of Colgate came up, and that was deemed unsatisfactory. We had to tell the same thing to McDonald's - and V tells me she hasn't called the man back about that yet, and now we have another person we will have to tell the same thing if he calls for a predevelopment meeting. The development review staff needs some help and guidance in this area if telling people "I don't know" isn't acceptable. By the way, our meeting with the McDonald's man was in November! I know you told us, Elrey, that we probably would have to consider each request on a case-by-case basis, but that's the .same thing as telling someone his project may not be important enough for the City to participate! I believe we still need a real meeting in a room with a table where we can all sit down and discuss this, and perhaps come up with a policy statement that sounds more professional than "I don't know, Pll have to check".
