Your request to tie a .private service line on to the new 18" waterline may be granted provided the following: 1) The private service line may be connected to the 18" main, but will need to be run on private property. It cannot be carried through on State right=of-way. 2) The private service line will be for domestic service ONLY. There will be no fire protection provided off this line. 3) You will need. to design the new system to meet all applicable plumbing codes. This may mean disconnection from the existing well or at the very least, cross connection control. You may coordinate this with the Building Department. 4) We will need a letter from you assuring the City that those facilities currently. constructed on-site are only those allowable through the development agreement and thatyou understand that no expansion may take; place without constructing the public waterline across the frontage of your: Property: 5) As per the development agreement, the City needs a current copy of your insurance. This should be provided to the City of College Station Risk Manager's office, attention Toni Johnson. Of course all applicable fees and permits must be paid and obtained. As a follow up to our conversation regarding sanitary sewer service to the proposed subdivided tract, we would request the application of provision 8-P.3, found on page 9-26 of the City's Subdivision Regulations dealing with the allowance of on-site sanitary systems. In particular, we ask the City to consider allowing an on-site septic system due to the fact that the topography of the area makes it impractical to connect to the existing gravity drainage system. And, as previously discussed, we may not have an on-site office at all, and if we do, the sewerage requirements would be .much less than a single family residence. These minimal. sewerage requirements, coupled with the lack of development anytime in the near future on the remainder of the tract make it impractical to require extension of sewer collection facilities at this time. Finally, we would be willing to provide a bond or similar assurance to cover the reasonable costs of extending any future sewerage line across the 3.5 acre `tract. This proposal should allow proper handling of any waste we may have, as well as ensure that the City will not be "stuck" with extension costs across the 3.5 acre tract in the future. I hope this proposal will alleviate .any concerns the City may have regarding this issue. We will be happy to meet and discuss this proposal at your convenience. NOTE C.S.L. of Texas, Inc. Subdivision Case #97-305 Jane, Kent and myself met on Wednesday, Apri19, 1997 to discuss the request by William D. Farrar (in his. letter to Shirley Volk dated April 8, 1997) to obtain a building permit for the proposed mini-storage facility on the 3.5 acre tract, lot 2, block 1, We felt that the time constraints outlined in Mr. Farrar's letter were unrealistic and not possible .considering we have only had one predevelopment meeting to date on the subject property. After that initial predevelopment meeting, Jane informed Mr. Farrar that we would need to see cost estimates and a request for O.P. in order to determine their "fair share" of the sewer line. To date, we have not received these cost estimates. The. same day, Jane and I called Mr. Farrar and informed him that we .would process the master preliminary plat and tentatively schedule it for P&Z on May 1, 1997 and Council. on May 22, 1997. We would consider possibly overlapping the final ..plat later on in the process so that it can be considered by ..the P&Z on June 5, 1997. However, we would not consider. the final plat until the sewer issue is resolved. Mr. Farrar asked that staff look into section 8-P.3 of the Subdivision Regulations that allows septic systems when factors make sewer collection facilities impractical. Jane suggested that their engineer contact .the City Engineer to discuss the sewer issue in ,general and how it pertains to that section of the ordinance. He felt. that ..his client was willing to go above the ordinance and still contribute some money for the future construction of the line. Mr. Farrar seemed to think that. this new time schedule would work and they would submit their site &' building plans for review so that thee. final plat is approved, filed for record and a building permit issued the first week in June. Jane and I agreed to work with the legal department to determine if the sewer issue can be handled as a condition of the master preliminary plat approval or as a development .agreement. Either way, we would work to resolve the sewer issue-at the May 22, 1997 Council meeting via the,plat or development agreement. On Thursday, April 14, 1997, Jane.. and I spoke with Roxanne. and she determined .that a development agreement would: be required and the sewer issue could not be handled as a condition of the plat. We agreed to pull the a similar agreement (the Greensworld development agreement that .postponed the construction of the water line) and start drafting. an agreement to be reviewed by legal and scheduled for the May 22, 1997 meeting. Jane pulled the agreement and Kent agreed to handle the processing. The same day, Jane called Mr. Farrar and informed him about the development agreement requirement and our intentions of scheduling it for the May 22, 1997 meeting. However, we must have COMPLETE cost estimates for the entire sewer line so that we can determine their portion of the cost NO LATER THAN MAY 1 1997. If the :cost estimates. are turned in any later, the development agreement. WII,L NOT be scheduled for the. May 22,.1997 meeting - no exceptions. Dear Ms. Volk: The purpose of this letter is to request an expedited review of the subdivision of a 3.5 acre tract out of an approximate 41 acre tract of land being proposed by CSL of Texas, Inc. We are under severe time constraints pursuant to Internal Revenue Service regulations to have the proposed development completed in its entirety by the end of June, 1997. We cannot get an extension of any type under. any circumstances to extend this deadline. Given a construction period of at least eight (8) weeks, we need to obtain our building permit approvals by early May. Failure will result in a direct cash loss to us of more than one hundred fifty thousand ($150,000.00) dollars. We cannot afford this loss and the project will not allow this type of "additional cost" to be added in. If we cannot obtain accelerated approval of this project we may be required to develop in another town. On a more positive note, our project will: • add approximately one million ($1,000,000.00) dollars to the local tax base; • be an attractive, well-kept commercial development. Our project WILL NOT: • burden the school system with a single additional child; • place a load on the electric utility system greater than a fourplex; • place a load on the water or sewer systems beyond that of a single family residence; • generate any noticeable increase in traffic; • generate any noise. I'll call Will Farrar and tell him that once we .see estimates and requests for OP and what the fair share portion of the sewer for the lot to be finaled platted is (based on a cost per acre basis rather than linear foot frontage basis) we'll recommend approval of the PP on the 'condition that the owner of the .lot to be final platted pay his fair share portion of the sewer by giving the City this money. If the proposed use of a mini-storage warehouse ever changes then the sewer will have to be installed '(not by the City) .and this money would be reimbursed. As a follow up to our conversation regarding sanitary sewer service to the proposed subdivided tract, we would request the application of provision 8-P.3, found on page 9-26 of the City's Subdivision Regulations dealing with the allowance of on-site sanitary systems. In particular, we ask the City to consider allowing an on-site septic system due to the fact that the topography of the area makes it impractical to connect to the existing gravity drainage system. And, as previously discussed, we .may not have an on-site office at all, and if we do, the sewerage requirements would be much less than a single family residence. These minimal sewerage requirements, coupled with the lack of development anytime in the near future on the remainder of the tract make it impractical to require extension of sewer collection facilities at this time. Finally, we would be willing to provide a bond or similar assurance to cover the reasonable costs of extending any future sewerage line across the 3.5 acre tract. This. proposal should allow proper handling of any waste we may have, as well as ensure that the City will not be "stuck" with extension costs across the 3.5 acre tract in the future. I hope this proposal will alleviate any concerns the City. may have regarding this issue. We will be happy to meet and discuss this proposal at your convenience.
