Plaza Addition Subdivision. (96-213)
City Engineer Laza presented the. staff report and stated that the subject property is located between
Dominik Drive and Harvey Road on the west side of Kyle Avenue South. The purpose of this plat is to
subdivide 10.02 acres into six C-1, General .Commercial lots in order to rectify illegal subdivisions that
have taken place since. the property was originally platted in April of 1975. A Presubmission
Conference was held on February 12, 1997 and several comments were addressed at that meeting. Staff
recommended approval of the final plat with the condition that all Presubmission Conference comments
are addressed prior to filing the plat for record.
Commissioner Smith moved to approve a final resubdivision plat of lot 4 of the Culpepper Plaza
Addition with the staff recommendations. Commissioner Garner seconded the motion which passed
unopposed (7 - 0}.
AGENDA ITEM NO.4: Consideration of a master preliminary plat of the CSL of Tezas, Inc.
.Addition located near the northeast corner of the intersection of Sebesta Road and State
Highway 6 Frontage Road. (97-305)
City Planner Kee presented the staff report and stated that. the property in this master. plat is currently
zoned for C-1 Commercial and M-1 Planned Industrial development. This master preliminary plat is
being presented in anticipation of development of 3.5 acres (lot 2). This master plat incorporates what
was a platted lot in the adjacent T.J. Addition and includes a large 35.8 acre lot for which there are
presently no development plans. Lot 1 is a small 1.1 acre lot. The master plat shows the future location
of a new collector roadway that would .extend. from Emerald Parkway to Sebesta as part of lot 3. The
idea for this roadway was developed as a' solution to .the cut-through traffic problems Emerald Forest
has faced over: the years since the Frontage Road was converted. to one-way. This will allow north-
south. movement between Emerald Parkway and Sebesta without traffic traveling through the
neighborhood. This roadway will not be built until lot 3 is ready for development. The developer of lot
2 will be asking the Council, through a development agreement, to delay. the construction of any sewer
infrastructure through lot 3 to lot 2. The proposed use on lot 2 does not have any significant sewer
demand. Staff recommended approval of the plat with presubmission conference notes, with the
condition that either a development agreement be approved by_Council addressingthe..timing of sewer
extension or the infrastructure'be constructed with the first final plat and with the discretion to apply
streetscape'reserved until site plan development.
Commissioner Gribou moved to recommend approval of the master preliminary plat of the CSL of
Texas,' Inc.. Addition with staff recommendations. Commissioner Lightfoot seconded the motion which
passed unopposed (7 - 0).
AGENDA ITEM NO. S: Discussion of gated communities.
City Planner Kee stated that the purpose of this agenda item is to bring to the City Council's attention
what appears to be a significant trend that could impact future development patterns. in our community.
The concept of gated communities was discussed a few months. ago in the Sunday magazine that comes
with The Eagle. At that same time, staff was discussing the possible gating of a street in a newly
developing subdivision with a local developer.

A Presubmisson Conference meeting was. held Wednesday, April 16, 1997 to discuss the above
mentioned preliminary. plat. The following is a list of ordinance requirements. identified by
the Presubmission Conference: This list does not relieve the applicant of total compliance
with all current ordinance .requirements..
Ordinance Requirements:
_ Clarify the title block to better describe the property. (Reference the replatting of the lot
in the T. J. Addition -not the J. C. Addition as shown on the plat.)
_ Modify the title block so that it reads "Master Preliminary Plat Not For Record".
_ Show how sanitary sewer will be extended to all lots.
Provide a basis of bearing for the survey.
_ Does floodplain exist on the property? If so, show the boundary.. If not, provide a general
note.
_ Clarify what is happening with lots 1 and 2. There are .several lot .lines shown and it is
confusing to determine which ones are proposed and existing.

Item: Consideration of a 41.81 acre master preliminary plat (C.S.L. of Texas, Inc. Addition)
:dividing the property generally located on .the northeast corner of Sebesta Road and the State
Highway 6 Frontage Road into three commercial-lots and Consideration of a Development
Agreement delaying the installation of ewer infrastructure. (Planning Case No. 97-305)-
Item Summary: Property in this master-.plat is currently zoned for C-1 commercial and M-1
Planned Industrial development. This master preliminary plat is being presented in anticipation of
development of 3.5 acres (lot 2). This master plat incorporates what was a platted lot in the
adjacent T.J. Addition and-includes a large 35.8 acre lot for which there are presently no
development plans. Lot 1- is a small 1.1 acre lot.
The master plat shows the future ovation of a new collector xoadway that would extend from
Emerald Parkway to Sebesta as part of of 3. The idea:.for this roadway was developed as a
solution to the cut-through traffic. problems Emerald Forest has faced over the years since the
Frontage Road was :converted to :one-way. This -will allow north-south movement between Emerald
Parkway and Sebesta without traffic traveling through the neighborhood. This roadway will not be
built until lot 3 is ready for development.
The developer of lot 2 will be asking the Council, through a development agreement, to delay the.
construction of any sewer infrastructureahrough lot 3 to lot 2: The proposed use on lot 2 does not
have any>significant sewer demand. Since this development comprises 3.5 acreswhich;represents
approximately nine percent: (9%) of the total area of the preiitninary plat, the developer is unable to
financially support the construction of the sewer line in its entirety. For this reason, .the. developer
is requesting the opportunity to financially guarantee his portion of the sewer line at this time in the
amount of Twelve Thousand One Hundred Thirty Dollars ($12,130.00). The timing of the sewer
line construction would be at the City's discretion. The development agreement would allow the
developer to install a "private" septic system for this development, but would require him<to
connect to a "public" sewer line whenever it becomes available: The agreement would also require

the developer to construct the entire sewer line if there is ever an expansion to or a change in use
that would increase the sewer demand beyond that of amini-storage facility.

Related Advisory. Board :Recommendations: P&Z voted unanimously to recommend approval
with the condition that the City either approve a development agreement delaying :sewer
infrastructure. construction or that the sewer line be built with this plat, and with the requirement
that streetscaping be required along Sebesta as-well as the By-Pass but to defer planting until site
.development. Approval was also made with all presubmission conference notes.

Water: Water is available through existing lines that will be extended into this property.
Sewer: Sewer is available through existing lines that will be extended into this property.
However, .the developer of Lot 2, is requesting that he be allowed the option of placing. a
financial guarantee withthe City for his portion of the sewer line to service his property.
He is proposing to install a "private" septic system on his property until: a sewer line can
be constructed to his property.
Streets: 't'his preliminary plat indicates the. location of right-of-way for the proposed
linkage between Emerald Parkway and' Sebesta Road: The majority of this property will
take access from-the frontage road of State Highway 6, but this proposed street will help
to reduce the amount of traffic that. would .use residential streets within the Emerald
Forest Subdivision.
Off-Site Easements: Not applicable.
Sidewalks: Notapplicable.
Drainage: The drainage requirements for this property will be reviewed for compliance
at the time of site>plansubmittal.
Flood Plan: According to FEMA Flood Hazard Maps, this-property is not located
within the 100-year flood plain.
Oversize Request: Even though the developer is requesting to delay the construction of
the sewer, he will be requesting oversize participation for the installation of the sanitary
sewer line. This is in order for staff to determine the .fair share portion that the developer
of lot 2 should pay as part of a development agreement. Any fair share portion has to be
determined after oversize is taken out. The City's participation will be determined based
upon the ,size of sewer line constructed and the size of line required by the .proposed
development:
Park band Dedication: Park land dedication is not required for .commercial
developments..
Impact Fees: Currently, there are no impact fees associated with-this property.
