Contact .Development Coordinator, Shirley Vollc at (409) 764-3570 for details. ***fee subject to change without notice*** O:~fomu~planlFNLAPP.DOC From: Shirley Volk To: Harvey Cargill Date: 8/18/97 8:34AM Subject: Wording on Plat ~j Harvey, we have-been. looking at a plat of Southwest Crossing subdivision and have some questions regarding some of the wording and what it actually means. £ ~ rr~ In one of the dedication sections it states: "I, Ron Cruse, owner and developer of land shown on this plat, and designated herein as the Southwest Crossing Subdivision to the City of College Station, Texas, and whose name is subscribed hereto, hereby dedicate to the use of the public forever all streets, alleys, parks, easement and public places thereon shown for the purpose and consideration therein expressed." The question is as follows: There are 20 foot alleys in several places on this plat. They are not designated as "public".alley, but only "20' alley". With the wording in the dedication paragraph, I would think that "the public" would have the use of the alley, and in fact, could take access from that alley to a lot or lots that are adjacent'to that alley. Is that a correct interpretation? Also, with the alley designated as a "20' alley", does that mean it is a private alley that the people in that subdivision will maintain, or because of the dedicatory. language does it mean that the City will maintain the alley. February i8, i998 City Council City of College Station P.O, Box 9960 College Station, Texas 77842 Re; Discussion of Streetscape ordinance Dear Mayor and Council Members; I understand that a review. of the Streetscape ordinance is scheduled for your February 26 meeting. As I may not be back in town in time for the meeting I have taken the liberty to convey my concerns and questions to you. in writing. The Dartmouth Crossing development, which includes the extension of Dartmouth Drive will require streetscaping along both Southwest Parkway and Dartmouth. As shown on the attached reduced master plat, the development will consist of mixed uses. A section of the Ordinance, which suggests deleting the streetscape requirement for R-2 zoned land, was approved by the Planning and Zoning Commission and later referred back to the ' Citizen Advisory Committee by the Council. T believe that the Committee has or will request that streetscaping be required''for all zoning categories. I do not disagree with streetscaping R-2 parcels, but I ask that a method for City maintenance be considered as the ordinance is reviewed. Our development will be required to plant trees on private property in the back of the duplex lots along Southwest Parkway and Dartmouth, -The fences that will be required in the back yard.. will have to be moved approximately three feet inside the. property line to allow the trees to be located adjoining the right of way and thus look like streetscaping. The ordinance requires an irrigation system to provide water to the trees. Again, I am willing and required to install such a system and. to create the required .three-foot easement in the back of the duplex lots for the system. However, I do not have a homeowners association, permanent developer, or anyone other than future individual lot owners to provide and service the watering and mowing requirement. I estimate that 34 trees will be required at a cost of approximately $8,650.00 and that the required irrigation system will cost approximately $4,000.00. I estimate that the annual mowing and utility bill for maintenance will cost approximately $2,000.00. . Whereas, Carrabba is the owner of 8,289 acres in the Morgan Rector Survey, College Station, Brazos County, Texas, described in Exhibit "A", attached hereto and incorporated herein by reference; and WI-~REAS, Carrabba has submitted a final plat (attached hereto and incorporated by reference as Exhibit "B") for the property coupled with proposed zoning classifications of the property; and WHEREAS, the City Council has approved the Final plat, with the proposed zoning classifications; and WHEREAS, as part of final plat approval, Carrabba is required to construct and extend Dartmouth Road; and WHEREAS, Carrabba requests that the CITY pay oversize participation on Dartmouth from Southwest Parkway through the subdivision as the construction of Dartmouth progresses; NOW, THEREFORE, for and in consideration of the recitations above and in consideration of the promises and covenants herein expressed, the parties do hereby agree and covenant as follows: 03/27/98 10:01 d 409 846 8252 BRAZOSLAND PROP 1003 Construction and Design of Dartmouth Carrabba, as a condition of plat approval on Dartmouth Crossing Subdivision, shall construct that portion of Dartmouth contained within Dartmouth Crossing beginning at Southwest Parkway and continuing south to the end of the property. CITY agrees to permit Carrabba to construct the aforementioned. portion of Dartmouth from Southwest Parkvway to the end of the Carrabba property after it places the construction contract out to public bid under the fallowing terms and conditions: (a) Carrabba guarantees the cost of the construction for its portion of the Dartmouth extension with an irrevocable letter of credit. The letter of credit shall be deposited with the City Engineer within ten (i0) days of the final plat approval and shall be a condition of final plat approval. Carrabba shall submit a construction cost estimate for the Dartmouth extension prepared by Hester Engineering to establish the total amount of funds necessary to be guaranteed by the letter of credit. The letter of credit shall be released to Carrabba upon completion of construction, acceptance of roadway by CITY and presentation by Carrabba of an affidavit of bills paid for contractor. (b) Carrabba agrees to award the construction contract to contractor chosen through public bid process. (e) Carrabba enters into a construction contract with contractor within 10 days of award of the construction contract for the Dartmouth extension. (d) Carrabba agrees to act as OWNER o£the construction project and be responsible for the entire project. (e) Carrabba agrees to retain Hester Engineering to act as CITY's representative for purposes of payment to contractor for CITY's portion of the contract price (as shown on Exhibit "C") (f) Payment Procedures (1) CONTRACTOR shall submit applications for payment. Applications for. payment will be processed by Carrabba_ CITX shall .make progress payments on account of the percentage of the contract price owed by CITY on the basis of CONTRACTORS applications. for payment as recommended by Carrabba. On or about the 2C1'~' day of each month during construction, as provided below, all progress payments will be made on the basis of the work. The funding shortfall is on a cash basis; there will be additional funds available next year when the remainder of the 1995 Bond authorization is issued. Staff has discussed this issue with the developer and he would be amenable to payment of oversize participation due to him over a two year period if the City pays any interest. which may be associated with the extension of time.
