Upon reviewing the information you submitted for:. the above referenced properties, I have identified the following item that needs to be addressed The encroachment into the fifteen (15) foot sewer easements by the swimming pool and Buildings 2, 3 and 6 must be rectified. by abandonment..A Utility Easement Abandonment application can be obtained from the City Engineer's office within ,the Development Services Deparhnent at 1101 Texas Avenue. .closing, but will The City will not requu~e the property owner to abandon these easements pnor to ..require that the easements be abandoned. and new easements dedicated to cover the existing sewer and electrical lines by plat prior to October 31,1997. The existing sewer and electrical lines are not located within a dedicated easement and therefore the City does not have the right to enter thcproperty in order to make repairs or provide maintenance. For this reason, the City will waive the fees 'associated with the easement abandonments anal replattings in order to provide easements for the existing on-site utilities. However, the property owner will be responsible for preparing all of the necessary documents .for abandonment and rededication. Encroachments for Lot B, Tauber Addition and-Lots 2, 3 and 4, Matt Cooley Subdivision Dear Ms. Webb: Upon reviewing the information you submitted for the abovereferencedproperties, the following areas will need to be addressed. 1. The encroachment into the fifteen. (15) foot sewer easement by the office and laundry buildings must. receive a License to Encroach from the City Council. The License to Encroach application can be obtained from the City Engineer's office within the: Development Services Department at 1101 Texas Avenue. The City will not require the properly owner to obtain this license prior to closing, but will require that it be obtained by October 31,1997. The' property owner should also understand that the City is not responsible for any damages to property within the specified easement due to the identified encroachments. 2. There is an existing fifteen (15) foot sanitary sewer easement (Vol. 145, Pg. 333) located across the northern portion ofthe property that is to beabandoned and rededicated as,part of The Villas of Cheery Hollow described as Lots C and D of the Tauber Addition. This easement should be abandoned and rededicated as part of the Cherry Hollow application. The purpose for this easement dedication is to-provide an easement over existing utilities that are not' currentlylocatedwithie an easement. As with the Cherry Hollow abandonment, the City will waive. the fees .associated `with the easement abandonment and replatting. However, the properly owner will be responsible for preparing all of the necessary documents for abandonment and rededication.
