Ed, Steve, Sabine & I met with John Doucet & Ken Carr this afternoon for a
second .meeting to discuss Longmire and platting of the property between First
Nat'l Bank & the hospital - to Birmingham and perhaps even Graham.
They raised several questions which we were unable to answer, so Steve & I
wrote them down and told them we would get back to them with some answers.
The que ions/tasks are as follows:
1. opy of Traffic Impact Analysis (Steve is checking on this; I wasn't aple
to find it while they were here. )

2. Who builds the street? Steve had the preliminary plat .file in the meeting
and he pulled the staff report/cover sheet which went to council (again).
That report states that "...the preliminary plat should be conditioned upon
the construction of the turn lane prior to any future final platting of the
parent tract." It is my opinion and Steve's as well, that the.deve-3:r~~ of
agent tract will be res onsible far buildin th T E -tu. - e_
and it will be his responsibility to deal with the. seller of the property and
the owner of the bank's lot to get them to participate if he can~;\ As far as
timing, I think it can be built with the rest of the infrastructu a for the
subdivision,-and be handled just as any other infrastructure requirement -
the_y do the plans, guarantee it and build it.
'`J 3. Mr. Carr asked again about a dedication of a regional detention area, Tub
(, with a little different twist this time. He said they may buy the Tiller
tract as well as what we have been looking at, and thought that perhaps the
detention area could be in the existing creek area and serve a large region,
and perhaps they could dedicate it as a park. We told them that as commercial
development, it would not be subject to parkland dedication, and this would be
something that Parks would have to take into consideration. We didn't decide
who would be referring this to Beachy, but I would imagine Sabine will.

be aware that would be necessary.
6. Steve told them if they abandon the existing sewer line from Birmingham to
the middle of this parent tract, they would either have to fill it with grout
or remove it completely.
7. Is this area or the area along Graham Road east of the service center part

of the sewer impact fee area? Steve & Sabine-did not think so. ,p
$. Would "Brazos Village" be an acceptable name for a subdivision (shopping
center, too, T guess)? I checked with 911 and they don°t have a problem, as
long as it's not a street name. I'll also check with Fire & PD to get their
opinion.
That's about all I have written down on the meeting. Please read this and
respond if you know the answer to any of the questions. Ed thinks we need to
have a meeting to talk. about. who builds the right turn lane, .but maybe we can
handle it with e-mail..

Based upon the information that you have given me, I don't think that we need
any parkland in that area. If it was contigous to Southwood Athletic Park it
may be something that would have value for recreation purposes.

i would send you something more detailed but I'm afraid this is all we've
gotten so far. the developer came in for a predevelopment meeting, and showed
us a conceptual layout of some property. between rock prairie road and
birmingham. but then they started talking about acquiring some land adjacent
to the use and maybe even more along graham road. there was no drawing to
accompany this part of the conversation.
they wanted an answer to the concept of the city taking over maintenance of a
larger detention area. we know the answer to that - a resounding "no". but
then they asked if we would consider taking over a detention area if we got
some additional parkland out of the deal. well, i had to think about the
edelweis park, where we essentially did just that.
the big difference here is that the entire area that these guys are looking to
plat is zoned exclusively for commercial use. we will not get any parkland
east of the use and north of birmingham when this area develops out (no
parkland dedication is required'of nonresidential subdivisions). maybe this
is ok with you. guys. but if it'sn't, do we want to look at a deal now while
the opportunity is there rather than be in a position where we may be looking
at a land purchase later?
i guess my main question at this point is:
do we need or want parkland in this future commercial area?

Steve, i need to talk with you regarding the acceptance of a detention pond
and commercial area park for the property between birmingham and rock prairie
road. these guys have .asked us whether we would accept and maintain a
detention area if they add some land to the deal and give us parkland that we
would otherwise not be able to get because the subdivision would be for
commercial uses.
what do you think?

Subject: John Doucet
I checked with the. RRC about building over a plugged well and they said that
the casing should be cut-off a minimum of 3 feet below grade. This would
allow for construction over the well bore. If in the event, the casing is
exposed during construction they would like to inspect the casing when it is
cut again. He said that the State would not pay to have the casing lowered.
His name was Gill (Something??) at 713-956-4000.
With this info, I should be complete with my tasks
1) RRC
2) Traffic Impact Study
3) Disks for utilities

Last Friday Ed gave Scott and I a Reader's Digest version of the discussion I
missed during the Lone Star Pavilion crisis. From that, I came away with the
understanding that the alignment that was submitted would be ok. Ed said that
he felt that it may not be necessary to continue Longmire from Rock Prairie to
Cypress Meadows. He said that it would prevent the commercial to residential
traffic that could potentially cause a problem "disturb" the residents in the
surrounding neighborhoods. There were numerous possibilities for extensions,

needing.

I just got a call from Keith Schauer in John Doucet's office (512)329-8743
wondering if anyone had reviewed the alternate Longmire alignment that John
had left with us! I was very surprised to receive that call because I thought
that had been taken care of at the very latest right after our meeting a week
ago today. I told him I would check on this, and since I haven't seen Ed
today it might not be today that someone responds to his question. I told him
I couldn't respond to it officially because although I thought Ed had
determined the alignment through the property they were working with would
work, he thought it was going to require some type of realignment on the
southern end to make it work and it was going to take someone a lot more
knowledgeable than I to respond so they could continue with their planning
from the response.
He was very nice and said that yesterday John had asked him to check on this,
so as of then no one had called them. Who feels qualified to call or .should
we wait until Ed gets back. When is that, Jane? I think Monday will be fine,
but I didn't know for sure when Ed will return.

I called Keith Schauer back re the Longmire alignment this AM. We got that
squared away.
I also informed him about the access easement we would be looking for to
connect Lot 1 (FNB) with the Longmire extension. I faxed him a copy of the
bank site plan which shows the location of "future cross access". The bank
site plan shows it to be 27' wide with its CL being 34.5 north of Lot 1's SW
property corner. Keith asked if there would be some flexibility in its
location due to its impact to their proposed Lot'4. I said possibly.
The TAC preliminary plat does not show this access easement, nor is there any
indication of it on the LO Ball plat of Lot 1.
Keith also asked me about the. design of the right turn lane. I told him to
design it such that the banks driveway is not in the taper and to begin the
taper west of the banks drive..

Got a call yesterday from J. Doucet and his partner Keith(?). They called to
ask me about the section of the ordinance which could require them to pay for
a portion of a signal at R. Prairie/Longmire. I explained it and said it
would be something we as a staff would consider as part of .their plat
submittal. They said they plan to have one submitted by the end of next week.
I said it was v. important that they show the acces easement from Longmire to
Lot 1 (the Bank). I had previously faxed Keith a copy of the bank site plan
showing where the easement would have to connect to the bank property.
J. Movahill w/ Bury&Pittman called to ask me about the striping for Luther and
J-B. T gave him some direction and he will be submitting plans for our review
early next week.

are several businesses beginning with "Brazos" and several with "Brazos
Valley". I would like to know what the address numbers would be so that we
can try and get them to be different than the other businesses that begin with
"Brazos".

Dev. Services staff met with some people today who want to plat some property
along the future extension of Longmire, and they wanted to know if they could
name it "Brazos Village". That would be the name of the subdivision, but also
the name of the development or shopping center as it develops. I checked with
911 and they didn't have a problem with it as long as it's not the name of a
street. What say ye7

since we all have differing recollections .why don't you pull the file and Kent
and Jim wil lhave to decide. They had the most recent dealings with the bank.
I do know we did not require the bank to build it with their development.
Originanly it was to be put off until the .rest of the platted property
developed. At the time the curb cuts for the bank were discussed is where I
get fuzzy. Jim should know..

I disagree with Veronica that we should start accepting detention ponds where
multiple commercial entities are involved. I just don't think we want to get
into that practice. Brandon Heights was an .unusual situation involving a
pond/park in a residential subdivision, and in my opinion we should not use it
as a precedent for a new policy.' This development sounds similar to the
HEB/Target/Enclave/et al. in which they share ownership and maintenance
responsibilities. That's the example I'd like to follow.
I remember talking about the right hand turn lane on Rock Prairie and Jane
indicated Monday that the turn lane had been eliminated. I don't think we
required ROW from the bank for that purpose.

explore ownership of a pond and let them "mow" it, through some sort of
contractual agreement with the city. i think Brandon heights opened a new door
for us in this realm. as for the'turn lane. i thought it was still a
requirement, when the "need arose", which wasnt with the platting of just the

Tony, Ed, Steve & I met with these people today to discuss primarily the
location of Longmire thru this tract and the tracts to the south to Graham
Road. During the discussion the'subject of detention came up and Steve
explained that in some instances', several separate entities have gone together
to form an "ownership" of a detention facility for the purpose of maintenance,
with all seeparate entities contributing to the financing. The potential
developer, Kenneth Carr, asked whether the City would accept the facility and
maintain it. Steve explained that the City usually does not. Mr. Carr
indicated that the hospital has asked about sharing a facility with this
potential development, and he wondered about the. City's USC facility and how
detention was handled there. The .bottom line is, I said at the meeting that I
would ask the question as to whether the City would be agreeable,to accepting
a detention facility for maintenance, much like it did in the Brandon Heights
subdivision, if several large tracts developed one large .detention facility
instead of a bunch of small ones.
Also, the required right hand turn lane on Rock Prairie Road came up and Ed &
Steve think that is still a requirement. I thought that had been dropped. We
need. some help on this one.
There are about 44 acres involved in this project, and tenative plans are for

an "upper scale" grocery. store, a fast food,. some retail, some showroom type
retail, possible medical office building and the hospital has expressed
interest in buying some of the land.
I have business-cards for the 3 men who were at the meeting with Fain
MacDougal, and they indicated John Doucet, a consulting engineer out of Austin
would be the main contact for any answers, questions, comments.. I still need
to check to see if indeed."Belmont Place" was ever filed for record! If you
have questions, don't hesitate to ask.

Subject: fain mcdougal predevelopment meeting
fain called me yesterday and wants. to talk .about the property between graham
and birmingham where longmire will go through. his client wants to
purchase/develop the property. but the bank has some time frames they want him
to meet on the contract. he is concerned he cant meet those if he wants to
assure a rezoning and platting. can be approved before he signs on the dotted
line. i told fain about what we did for john godfrey on enclave and offered
that we could do the same here for his client. then his client can take that
calendar that we work up and show the bank it takes "x" long to do this and
see if he can work out the deal. fain said that sounded "great and we were
wonderful for offering to do this type of thing". so he will be ca ling
Shirley to set up a predevelopment meeting so that we can all talk about
process, scheduling, submittal dates, etc. i told him we needed prior to the
meeting, a map showing the property in question and what he wants to do with
it (ie zoning, platting, etc. - not necessarily "what business")

Subject: L.O. Ball right turn lane
In looking at the site plan of the First National Bank and the prelimary plat
of the site, it appears that .the right turn lane has indeed been required and
right-of-way dedicated during the development of the bank.. We were mistaken
in saying the ROW for the right turn lane had been deleted. As the remainder
- of the property on Rock Prairie develops we need to get any additional ROW
from it as well.

the February 20, 1997 Planning Commission meeting and rescheduled on the March 6, 1997

ITEM: Consideration of a Preliminary Plat for the L.O. Ball Subdivision, a commercial subdivision
located at the southwest corner of Rock Prairie Road .and the SH 6 East Bypass. Thee applicant is
TAC Realty and Don Ball for Kovak & Co.
ITEM- SUMMARY: The preliminary ply consists of a 1.43 acre lot at the corner of Rock. Prairie
Road and the ; S.H. 6 Frontage Rd..and: a 27..58 acre reserve tract. This plat is being submitted in
.order that the 1.43 acre tract can be developed at this. time. This preliminary plat and a final plat
associated with the 1.43 acres are being run concurrently due to a pending sale.
This plat. involves the future extension of Longmire Drive. The dedication of the Longmire right of
way and its associated construction will occur with the final platting and development of the 27.58
acre reserve tract.. Lot 1's physical size is approximately 5 % of the overall subdivision and Lot 1 is
.not guaranteeing with the City any portion of the Longmire construction. Staff has no problem with
this because of the small size of Lot 1, however there should be no future subdivisions of the- reserve
tract without the extension of Longmire. Staff would .not be in favor. of platting any of the reserve
tract, regardless of its location relative to Longmire, without the construction of Longmire. Staff is
trying to avoid piecemeal .platting of the. reserve. tract so that we do not end up with another Welsh
street situation, wherein .the area remaining o be developed cannot support the cost of the street.
There is also aright-of--way dedication shown fora :right turn lane on Rock Priarie. According to
impact studies the reservation of the. right-of-way for a right turn is appropriate at this time. The 1.43
acre corner tract is willing to dedicate. the right-of--way for this right turn lane. Based. on the. possible
permitted uses in the G2 district full development of the parent tract may necessitate construction of
the right turn lane. For this reason the preliminary_ lp at should be conditioned upon the_c9usttsi ti~_on _
of the turn lane prior to any future'final platting of the parent trac_t~,
There is a shared. access point between Lot 1 and .the reserve tract. This will be the only.. access point
for Lot 1 from Rock Prairie-due to the proximity of the Rock Prairie/SH6 intersection.
STAFF RECOMMENDATIONS: Staff and P&Z„recommend unanimous (5-0) approval of the
preliminary plat with the following conditions`.
1. Complete water and sewer impact studies,
2. Extension of the 20' PUE along SH 6 Frontage,
3. Verification that the driveway access easement on Rock Prairie Rd. alignswith the
Victoria`Bank driveway access,
4. Provision of PLTEs to cover power poles along Rock Prairie Rd.,
5. No future subdivision will be allowed without Longmire construction

6. No future subdivision will be allowed without the construction of the right turn lane
shown on Lot 1.
7. No additional future access points will be allowed to Rock Prairie east of the
Longmire intersection.

A Presubmission Conference meeting was held Wednesday, February 5, 1997 to discuss the above
mentioned final plat. The following is a list of ordinance .requirements identified by the
Presubmission Conference. This list does not relieve the applicant of total compliance with
all current ordinance requirements.
Discretionary Items:
_ The Conference recommended that Streetscape be required along the Longmire Drive
extension. However, the plantings will not be required with the final plat buf with the site
plan of each individual lot.
Ordinance Requirements:
_ Correct the vicinity map to show the location of the subject property.
Show the existing Lo ammire Drive right-of--.way across Rock Prairie "Road".
_ Change the designation of Birmingham to "Birmingham Road".
_ Show the right-of-way dedication along Rock Prairie Road along lot 5 for the right turn
lane. (Clearly designate this dedication onlot 1.)

Show the location of the entrance ramp for State Highway 6 along the frontage road.
Show the location of the opposite and- adjacent driveways along Rock Prairie Road.
Show the existing infrastructure and easements.
Complete the application submitted.
_ Does floodplain exist on the subject property? (If it does, show the location. If it does
not, provide a note to that effect.)
Show the access locations on the final: plat and note the distance to other access points and
intersections. Staff suggested. the following changes:
_ Show the shared access location between lots 2 and 3, block 1. Because of the limited
space in which a :curb cut will be allowed along the Frontage Road, include the access
point' on lot 3 block 1.
Show the extension of the access easement along lot 4, block 1 that will connect lot 1,
block 1 to Longmire Drive. This easement must connect with the existing access
easement on lot 1, block 1 for First National. Bank as shown on the. approved site plan.
Show the shared access easement between lots 1 and 5, block 1.
Show the shared access easement between. lots 1 and 7, block 2.
_ Show the. access point for lot 6, block 2.
_ A total of three access points .will be allowed for lots 1 - 5, block 2 from Longmire
Drive (The_required spacing is 230'.) Staff suggests the following locations:
-- A shared access easement. between.. lots 1 and 2, block 2 that will align with the
access easement .along lot. 4, block L across Longmire Drive.
-- An accesspoint in the center of lot 3, block 2.
-- A shared access easement between lots 4 and 5, block 2.
_ While lot 3, block 1 has. adequate frontage. along Birmingham Road and Longmire
Drive, the access locations may be limited due to the location of opposite and adjacent
driveways. Staff. suggests that the developer, locate these access. points with this final
plat to be reviewed and approved with the .other locations.

_ The construction documents are being returned to the applicant on Wednesday, February
5,-1997. Due to the incompleteness of the plans,-staff was not able to do a comprehensive
review. Submit the revised plans along with the "original redlined set to be reviewed by
staff. All construction documents must be approved prior to filing the final plat for
record.
_ Any necessary easements identified .during the review of the construction documents must
be added to the final plat prior to filing.. (Public utility easements may be required parallel
to Longmire Drive for the proposed utilities.)
Remove the signature block for the City Council.
_ The "ownership. & dedication" and "surveyor and/or engineer" certifcates must be
completed :prior to consideration by the Planning. and Zoning Commission.
_ The City may require developer participation in the installation of a traffic signal at the
intersection of Longmire Drive and _Rock Prairie Road. An agreement between the City
and the developer must be in place to establish joint participation levels for the costs of
design, materials .and construction of the signal prior to issuance of a letter of acceptance
for the infrastructure of Longmire .Drive. More information is needed in determining the
City and developer levels of participation. Discussions to address the signal need to begin
as soon as possible.
