Subject: Language for a Plat -Reply
Shirley, as long as the easements. are non-exclusive on the plat, neither party
holding an easement over the area would have to ask permission of the other to
access the easement. Rather,; both parties would have a right of use in the
area.

Cameron, if you'll recall at the P&Z the other night there was a preliminary
plat for the Edelweiss Business Center. Well,. one of the lots is getting
final platted now .and across the eastern side of the lot there has to be the
landscaped. buffer established by the conditions of the rezoning ordinance.
Also along that same side,. and within the landscape buffer is a public Futility
easement. Here's the deal. The City needs to have access always to its
utilities. The Homeowners Association needs to have access to this landscaped
buffer area to make sure it is being maintained properly. ,The developer has
proposed to label this buffer area a "25 foot landscape buffer and HOA
easement". The potential problem as staff sees it is that it is also a
"public utility easement", and we are wondering if having the 25 foot area
labelled both a PUE and an HOA easement would create the possibility of
causing the City to have to '.get ',permission from another entity to have access
and do .maintenance on its utilities! Boy this is hard to explain. -If you'd
like for me to bring you a copy of the plat and draw out what I'm talking
about, I'd be happy to.
I'd also welcome different language if you have some readily available! In
other words....HELP!!!

concern, so I went ahead and told the engineer (McClure) to go ahead and word
it "public utility easement, 25 foot landscape buffer and HOA easement"', or
something to that nature. Thanks".for the reply. I guess what I told them
will make the City responsible for'replaoement of landscaping if we damage it,
doesn't it?

This can either be a joint use easement by city and hoa or a public utility
easement by city and give hoa permission to use the easement area for
landscaping under certain joint use .agreement.
If you make it a blanket joint use agreeement then the city is liable to
replace any landscaping installed in the easement area if we damage it.
My preference is our easement and let them use it pursuant to a joint use
agreement.
let me know what you want to do.
If you make it city easement: and allow hoa to use easement area under certain
terms and conditions than we can prescribe the terms of the use of our
easement .and do not have to be,responsible for the landscaping. It depends on
how you want to structure it. Let me know how you want to approach this.

A Presubmission Conference meeting was held Wednesday, .February 12, 1997- to discuss the
above mentioned final plat. The following is a list of ordinance requirements identified by
the Presubmission Conference. This list does not .relieve the applicant of total compliance
with all current ordinance requirements.
Ordinance Requirements:
_ Change the name of the subdivision to reflect the "Edelweiss Business Center" name.
