He believes we are going to do it for him and I don't want to get into that habit. Therefore, Pm going to be reluctant to recommend approval of a replat (or any other dedication) until he fulfills his responsibility in getting access to the landlocked lot.. As to question No. 2, just as with easements we prefer that dedication on a replat because it is easier from a record keeping perspective. I would like to hold out for that. At the same time I asked him about the driveway to Holleman from the lot which land-locked. They were having extreme difficulties obtaining the letter of credit so they asked if we would accept cash as the guarantee and we said yes. This $3400 is for a two. course seal coat street to the land locked lot. I talked to JJ about 5-6 months ago when the owner of the land locked lot called and said that he was interested in building a house on that property. JJ said that he would build the street ONLY when he received a letter stating that a building permit was going to be issued for that Iot. We have a detail for this construction in the Development Permit Files #186R as well as a financial guarantee in the amount of approx. $3,400. After checking, I told him that staff would require that. he build the access to the landlocked lot before we would be willing to take this back thru the process.. to dedicate the street. CC: KLAZA, VMORGAN J ~ From: Shirley Volk To: KLaza, 5Homeyer Date: 12/31/96 10:48am Subject: Pershing Park I have spoken. twice to Mason Newton of PD .about any problems they have had at 901 Holleman or 807 Holleman (the 2 houses which back up to Pershing Park and about which Myrna Hughes has complained). He went out and looked the situation over and called me to say that. he has checked PD complaint files and has found the following: In 1994 they had a complaint for a loud party at 807 Holleman. In 1996 theg had a complaint for a loud party at 901 Holleman; and in 1993 they had a complaint for a loud party at 901 Holleman. So by their standards, there is no problem at either house. They also understand that some type of access has to be given to the vacant lot which backs up to Pershing Park Lots 9 & 10, and they have no problem with having a driveway to that lot paved (as Engr has required). He suggested that perhaps the Pershing Park people would like to buy that vacant lot - then they wouldn't have to build access to it! He also suggested that if Myrna has complaints about trespassing through her property to the houses on Holleman, or about noise, or even about a lot of people parking in her subdivision who don't belong there, that she report these things to PD so there will be a record.
