As to question No. 1, from the indication he has given both you and Steve, it doesn't appear he has plans to build that driveway at all. He believes we are
going to do it for him and I don't want to get into that habit. Therefore, Pm going to be reluctant to recommend approval of a replat (or any other dedication)
until he fulfills his responsibility in getting access to the landlocked lot..
As to question No. 2, just as with easements we prefer that dedication on a replat because it is easier from a record keeping perspective. I would like to hold
out for that. There's no law that says he can't dedicate it through a metes and bounds description. In my mind that should be a last resort.

AND...is the only way a street can become public is to replat it?

I read Jane's a-mail on thin but deleted it before. replying. Natalie and I remember 7J putting up a financial guarantee for the driveway, but not cash for us to
use to build it. That's not the way we do business. She is going to research that in our records. Before we replat anything to make it public, that driveway

7. J. Johnson. (764-9663). just called me to see how to go about dedicating Hawthorne Street in his subdivision to the City. Ltold him I would check.
At the same time I asked him about the driveway to Holleman from the lot which land-locked. He said he had given money to the City to build that
driveway, so he assumes it is the Gity's responsibility now.
Can one of you either steer me the direction to take on the first question, or better still, tell me you will take over and get with J.J. on this!

Natalie is correct about the guarantee. They were having extreme difficulties obtaining the letter of credit so they asked if we would accept cash as the
guarantee and we said yes. This $3400 is for a two. course seal coat street to the land locked lot. I talked to JJ about 5-6 months ago when the owner of the
land locked lot called and said that he was interested in building a house on that property. JJ said that he would build the street ONLY when he received a
letter stating that a building permit was going to be issued for that Iot. That was where it was left because the lot owner never pursued a building permit.

I looked in the guarantee files for this project and found that Myrna Hughes (JJ's wife) gave us a check for $3400 as a guarantee for infrastructure in
Pershing Park before we'd file the plat. They were going to put up a letter of credit; however, they told us their bank was .giving them a hard time and they
weren't willing to wait. Steve, do you remember if this $ was for the driveway? I don't see any engineer's estimates in the file that address the driveway.

I believe a curb cut exists on Holleman at this location, but may require
widening. We have a detail for this construction in the Development Permit
Files #186R as well as a financial guarantee in the amount of approx. $3,400.
I think this is the point of contention for JJ because he wants the City to
build it because he has given us the money.

I know what this is about! Several weeks ago JJ called to see what he would
have to do to dedicate his private street to the City. After checking, I told
him that staff would require that. he build the access to the landlocked lot
before we would be willing to take this back thru the process.. to dedicate the
street. That was the last I heard from him, but it sounds like he needs a
curb cut (on Holleman?) to provide access to that lot. I can'. pull the ~>lat
file for anyone who needs it. Just let me know.

on friday I got a message from JJ Johnson, and jsut called him back.
he said that Shirley said that I was asking or demanding that a curb cut: a
gravel road be placed somewhere in Pershing park.
I told him that she must have meant you or veronica, since I'm out of tYlat
loop now.

Subject: Pershing Park
I have spoken. twice to Mason Newton of PD .about any problems they have had at
901 Holleman or 807 Holleman (the 2 houses which back up to Pershing Park and
about which Myrna Hughes has complained). He went out and looked the
situation over and called me to say that. he has checked PD complaint files and
has found the following: In 1994 they had a complaint for a loud party at 807
Holleman. In 1996 theg had a complaint for a loud party at 901 Holleman; and
in 1993 they had a complaint for a loud party at 901 Holleman. So by their
standards, there is no problem at either house.
They also understand that some type of access has to be given to the vacant
lot which backs up to Pershing Park Lots 9 & 10, and they have no problem with
having a driveway to that lot paved (as Engr has required). He suggested that
perhaps the Pershing Park people would like to buy that vacant lot - then they
wouldn't have to build access to it!
He also suggested that if Myrna has complaints about trespassing through her
property to the houses on Holleman, or about noise, or even about a lot of
people parking in her subdivision who don't belong there, that she report
these things to PD so there will be a record.

Ordinance Requirements:.
V' Remove the City Council signature block. The Planning and Zoning Commission will
approve or deny the final replat. The City Council will consider the final plat only if the
applicant chooses to appeal the decision of the Commission.
Change the dedication of Hawthorne Street to a "50' public right-of-way".
Correct the location of the floodplain location. (The floodplain does not cross the
floodway along the park commons and lot 16.)

the volume and page number of that agreement.
~ The improvements included in the median at Hawthorne & Thomas must be addressed

SUBJECT: Final Plat -Pershing Park; proposed amending plat of 6.25 acres divided into 16
single family lots located along the east side of Thomas Street, just east of the
Hawthorn '.Street intersection. This plat includes. the proposed dedication of
Hawthorn as a public street. (97-202)
A Presubmission Conference meeting was held Monday, December 30, 1996 to discuss the above
mentioned final plat. The following is a list of ordinance requirements and comments
identified by the Presubmission Conference. This list does not relieve the applicant. of total
compliance with all current ordinance requirements.
Ordinance. Requirements:
_ Remove the .City Council signature block. The Planning and Zoning Commission will
approve or deny the final replat. The City Council will consider the final plat only if the

the final plat.
