Item: Public Hearing and Consideration of a City Initiated Rezoning of all .lots within the
Foxfire Subdivision from R-1 Single Family Residential to A-OR Rural Residential.
Item Summary:. Foxfu-e was developed largely outside the City Limits. It was annexed
into the City in 1992 and zoned R-1 at the time. In 1995 the Council adopted regulations
for rural residential subdivisions. These regulations were. designed. to allow large lot single
family subdivisions to develop with more rural street sections and fewer urban standards,
all within the city limits. The A-OR zoning district was adopted as well as amendments to
the subdivisions regulations addressing the different standards.
At the time the A-OR standards were developed the Foxfire HOA became interested in
rezoning their subdivision. This rezoning would protect the largerlots by not allowing
any resubdivision of less than one acre. It .also makes their rural residential street sections
conform to the subdivision .regulations for this. type development. Changing from R-1 to
A-OR also exempts these lots from compliance with various ordinances such as weeds and
grass,. animal permitting and parking in the yard.
The HOA circulated a petition that resulted in 125 of the 178 lots in favor of rezoning, 5
lots. in opposition and 48 non-responses.
There are 3 one acre tracts within the area. (shown in white on the location map) that are
not a part of the Foxfire Subdivision.. These tracts were annexed and zoned R-1 along
with the lots in Foxfire in `92. We have not notified for these tracts to be rezoned to A-
OR. To avoid leaving: a .spot within the area with a different zoning classification- staff
recommends initiating rezoning of these 3 tracts as well.
Policy Issue Statement:
Civic Pride Citizens benefit from well-planned, attractive residential and
commercial areas, and from preserving historic areas.
..Item Background: After the 1995: annexations, Council directed staff to develop some
new ordinances that would help with some concerns of the newly annexed residents.. One
of the ordinances created a new residential district that allows rural type single family
development within the City limits. This district, along with changes. made. to the
subdivisonregulations, allows areas to be zoned A-OR Rural Residential.. Minimum lot
sizes are one acre and there are street standards and fire protection options that lend
themselves to more rural. type development.
The residents of Foxfire and :Sandstone were involved in these discussions"at that time.
Several Foxfire residents expressed interest in rezoning the entire Foxfire Subdivision to
A-OR to protect the existing one acre lots. The HOA began work gathering signatures
from all property owners in Foxfire to approach the City about rezoning.

Since there were some property owners. who did not respond to .the HOA's attempt to
gather all signatures for rezoning, the HOA asked the P&Z to initiate rezoning of all
properties. The P&Z Commission did so at their 11-20 meeting. Section 17 of the
Zoning Ordinance gives the City Council or theP&Z the ability to initiate rezoning of
property. All other notification procedures must be followed and the process is identical
to a rezoning requested by an individual property owner.

rezoning of the 3 tracts not included with this case.

Water: Water is existing throughout the subdivision..
Sewer: .Portions of Foxfire have access to a gravity sanitary sewer system.
Others still remain on septic systems. This rezoning would keep lots at' a
minimum 1 acre, which is the minimum lot size needed to have a septic system
permitted by the County Health Department.
~ Streets: The street system within Foxfire are rural streets. This rezoning would
allow these streets to conform with the subdivision regulations for this type of
~ development.

Sidewalks: Sidewalks are not required in A-OR on residential or collector
streets.

Flood Plain: The latest Federal Emergency Management Agency (FEMA)
