HomeMy WebLinkAboutOrdinance , ORDINANCE NO. 2255 AN ORDINANCE REZONING A PARCEL OF LAND TOTALING 2.45 ACRES LOCATED IN THE RICHARD CARTER SURVEY, ABSTRACT NUMBER 8, AND BEING A PART OF THE 5.05 ACRE TRACT DESCRIBED IN THE DEED FROM BERT WHEELER'S INC. TO REGENCY PARKWAY, INC., RECORDED IN VOLUME 1219, PAGE 280 OF THE OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: The subject property, a 2.45 acre tract described by metes and bounds in "Exhibit A" and shown graphically in "Exhibit B", is rezoned from R-l Single Family Residential to C-2 Commercial Industrial. A notice of the time and place, where and when said ordinance would be given a public hearing and considered for final passage, was published in The Eagle, a daily newspaper of general circulation in the Cities of Bryan and College Station, said publication being on Monday, July 28, 1997, the same being at least fifteen (15) days prior to a public hearing to be held in the Council Room of the City Hall in College Station, Texas, at 7:00 p.m., on August 12, 1997, to permit the public to be heard prior to final consideration of this ordinance. "It "EXHIBIT A" ORDINANGE NO. 2255 Rezoning Request R-1 to C-2 2.45 Acres Richard Carter Survey, A-8 College Station, Brazos County, Texas Field notes of a 2.45 acre tract or parcel of land, lying and being situated in the Richard Carter Survey, Abstract No.8, College Station, Brazos County, Texas, and being part of the 5.05 acre tract described in the deed from Bert Wheeler's Inc. to Regency Parkway, Inc., recorded in Volume 1219, Page 280, of the Official Records of Brazos County, Texas, and being more particularly described as follows: BEGINNING at the %" iron rod set at the west corner of the beforementioned 5.05 acre tract in the east right-of-way line of State Highway No.6 (East By-Pass); THENCE N 75000' 38" E along the northwest line of the beforementioned 5.05 acre tract, for a distance of 120.00 feet to a %" iron rod set; THENCE across the beforementioned 5.05 acre tract, same being approximately 10' south of the Carter's Creek bank, as follows: S 790 59' 58" E S 380 22' 07" E S 470 06' 22" E S 28007' 18" E 220.00 feet to a %" iron rod set, 1 09.60 feet to a %" iron rod set, 60.00 feet to a %" iron rod set, 94.64 feet to the common line between the beforementioned 5.05 acre tract and the 34.13 acre tract described in the deed to Davis & Scarmardo Construction Company, recorded in Volume 1082, Page 337, of the Official RecQ!ds of Brazos County, Texas; THENCE S 760 11' 24" W along the common line between the beforementioned 5.05 acre tract and the 34.13 acre tr?ct fora distance of 397.86 feet to the south corner of the beforementioried 5.05 acre'tract in the southwest right-of-way line of State Highway No.6 (East By-Pass); THENCE N 180 13' 02" W along the southwest right-of-way line of State Highway No. 6 (East By-Pass) for a distance of 328.86 feet to the PLACE OF BEGINNING, containing 2.45 acres of land, more or less. kes9 7-0 2b:\grenwrld .rzn PAr.E 2 O!" 3
