ORDINANCE NO. 2242
AN ORDINANCE REZONING A PARCEL OF LAND CONSISTING OF A 4.242 ACRE
TRACT AND AN 8.471 ACRE TRACT SITUATED IN THE RICHARD CARTER SURVEY,
ABSTRACT NO. EIGHT (8), BRAZOS COUNTY, TEXAS, CONVEYED TO F.W. "BERT"
WHEELER BY DEED RECORDED IN VOLUME 444, PAGE 800, OF THE DEED
RECORDS OF BRAZOS COUNTY, TEXAS, FROM R-1, SINGLE FAMILY RESIDE1'fTIAL
TO A-P, ADMINISTRATIVE-PROFESSIONAL, AND C-B, BUSINESS-COMMERCIAL.
WHEREAS, on May 8, 1997, the City Council of the City of College Station, Texas convened
and, pursuant to notices prescribed by law, held a public hearing with regard to the application
for rezoning of a parcel of land consisting of a 4.242 acre tract and an 8.471 acre tract situated in
the Richard Carter Survey, Abstract No. Eight (8), Brazos County, Texas, conveyed To F.W.
"Bert" Wheeler by deed recorded in Volume 444, Page 800, of the Deed Records of Brazos
County, Texas, and more particularly described as follows:
TRACT ONE:
All that certain 4.242 acre tract or parcel of land, lying and being situated in the Richard Carter
Survey, Abstract No.8, Brazos County, Texas, and being part of the 13.727 acre tract described
in the deed from Frauline Putz Sims and husband, lW. Sims to F.W. "Bert" Wheeler recorded in
Volume 444, Page 800, of the Deed Records of Brazos County, Texas, said 4.242 acre tract
being part. of the 13.54 acre tract described to F.W. Bert Wheeler, Trustee, said trust being
recorded in Volume 743, Page 143, of the Official Records of Brazos County, Texas, and being
more particularly described as follows:
BEGINNING at the. I" iron rod found marking the east comer of the
beforementioned 13.727 acre tract, said 1" iron rod also being the common comer
between the 12.264 acre Tract No.1, Carter's Grove Second Installment
according to the plat recorded in Volume 228, Page 161, of the Deed Records of
BrazoS County, Texas, and an angle point to the southwest line of Block B -
0.799 Acre Post Oak Forest according to the plat (refiled) recorded in Volume
326, Page 715, of the Deed Records of Brazos County, Texas~
THENCE S 43021' 22" W along the common line between the beforementioned
13.727 acre tract and the 12.264 acre Tract No.1, adjacent to an 8' high chain link
fence, for a distance of926.41 feet to a chain link fence comer found marking the
south comer of the said 13.727 acre tract, same being the west comer of the
12.264 acre Tract No. 1~
THENCE N 450 19' 19" W along a southwest line of the beforementioned 13.727
acre tract, at a distance of 19.04 feet past the common comer between the said
13.727 acre tract and the 1.007 acre perpetual easement from F.W. "Bert" ..
Wheeler to the City of College Station recorded in Volume 777, Page 424, of the
Official Records of Brazos County, Texas, continue on with the perpetual
easement line for a total distance of 24.71 feet to a W' iron rod set in the curve
concave to the west having a radius of716.00 feet;

THENCE along the east right-of-way line of Lincoln Avenue (60' right-of-way)
as described in the beforementioned perpetual easement (Volume 777, Page 424)
as follows:
Northerly along said curve for an arc length of514.79 feet to a W' iron rod
set at the end of this curve, the chord bears N 030 48' 31" E - 503.77 feet;
N 160 47' 19" W 17.34 feet to a W' iron rod set at the beginning of a
transition curve concave to the Southeast having a radius of25.00 feet;
THENCE northeasterly along the transition curve from Lincoln Avenue to FM
No. 60 - University Drive, for an arc length of 39.27 feet to aW' iron rod set at
the end of this curve in the southeast right-of-way line ofFM No. 60 - University
Drive, the chord bears N 28013' 00" E - 35.36 feet~
THENCEN 730 13' 19" E along the southeast right-of-way line ofFM No. 60-
University Drive for a distance of 571.08 feet to the north comer of the
beforementioned 13.727 acre tract, an 8" creosote post fence comer bears S 650
37' 37"W- 9.52 feet and a W' iron rod in concrete bears N 460 13' 47" W - 0.42
feet~
THENCE S 460 13' 47" E along the common line between thebeforementioned
13.727 acre tract and Block B - 0.799 acres Post Oak Forest, for a distance of
85.35 feet to the PLACE OF BEGINNING, containing 4.242 acres of land, more
or less.
TRACT TWO:
All that certain 8.471 acre tract or parcel of land, lying and being situated in the Richard Carter
Survey, Abstract No. 8, Brazos County, Texas, and being part of the 13.727 acre tract described
in the deed from Frauline Putz Sims and husband, l.W. Sims to F.W. "Bert" Wheeler recorded in
Volume 444, Page 800, of the Deed Records of Brazos County, Texas, said 8.47l acre tract
being part of the 13.54 acre tract described to F.W. Bert Wheeler, Trustee, said trust being
recorded in Volume743, Page 143, of the Official Records of Brazos County, Texas, andl being
more particularly described as follows:
BEGINNING at the W' iron rod found marking the west comer of the
beforementioned 13.727 acre tract, same being the north comer of Lot 1, Block
One, OQ.e LincolnPlace according to the plat recorded in Volume 690, Page 175,
of the Official Records of Brazos County, Texas, and being in the southeast right-
of-way line ofFM 60 (University Drive)~
THENCE along the southeast right-of-way line FM No. 60 (University Drive) as
follows:
N 720 26' 19" E - 634.74 feet to a Y2" iron rod set,
N 840 13' 19" E - 157.19 feet to a Y2" iron rod set,
N 730 13' 19" E - 19.41 feet to a W' iron rod set at the beginning of a
transition curve concave to the southwest having a radius of25.00 feet~

THENCE southeasterly along the transition curve from University Drive to
Lincoln Avenue - 60' right-of-way for an arc lengthof39.27 feet to a Y2" iron rod
set at the end of this curve, the chord bears S 61047' 00" E - 35.35 feet~

THENCE along the west right-of-way line of Lincoln Avenue, described in the
perpetual easement from F.W. "Bert" Wheeler to the City of College Station
recorded in Volume 777, Page 424, of the Official Records of Brazos County,
Texas, as follows:
S 16047' 19" E -17.36 feet to a Y2" iron rod set at the beginning ofa curve
concave to the west having a radius of656.00 feet,
Southerly along said curve for an arc length of712.28 feet to a Y2' iron rod
set at the end of this curve, the chord bears S 140 19' 01" W - 677.80 feet,
S 450 25' 22" W 114.48 feet to a Y2" iron rod found marking the east
comer of Two Lincoln Place - 2.3 7 acres according to the plat recorded in
Volume 2251, Page 329, of the Official Records of Brazos County, Texas~
THENCE N 450 29' 30" W along the common line of the beforementioned
13.727 acre tract and Two Lincoln Place at a distance of 176.26 feet past the north
comer of the beforementioned Two Lincoln Place, continue along the common
line between the B.727 acre tractand Lot 1, Block One, One Lincoln Place, for a
total distance of 795.26 feet to the PLACE OF BEGINNING, containing 8.47l
acres of land, more or less.
WHEREAS, the above-described property is currently zoned R-l, Single Family Residential, and
the current use is as vacant land;
WHEREAS, Ms. Mae Dean Wheeler, Independent Executrix of the Estate ofF.W. Bert Wheeler,
Trustee, the current owner of the above-described property, has applied for rezoning of 4.242
acres to A-P,Administrative-Professional, and 8.471 acres to C-B, Business Commercial;
WHEREAS, the City Council of the City of College Station, Texas, heard evidence that 4.242
acres of the above-described property is located at the Southeast comer of University Drive and
Lincoln Place, and 8.471 of the above-described property is located at the Southwest comer of
University Drive and Lincoln Place~
WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the
University Drive Corridor Study recommended, upon request, an A-P, Administrative-
Professional, district at the Southeast com~r of University Drive and Lincoln Place, and a C-B,
Business Commercial, district at the Southwest comer of University Drive and Lincoln Place~
WHEREAS, the City Council of the City of College Station, Texas heard evidence that rezoning
the above-described property would encourage development of the tract;

WHEREAS, the City Council of the City of College Station, Texas heard evidence that rezoning
the above-described property is in accordance with the City's Comprehensive Plan for
development~
WHEREAS, the current owner of the above-described property has agreed to provide the City
with a sewer impact study at the time of development of said property, analyzing the impact of
the development of the sewer infrastructure and that the installation and cost of any
improvements required by the study will be born by the developer; and
WHEREAS, the current owner of the above-described property has agreed to install a buffer as
provided in the Research & Development district between the western tract and the R-IA zoned
patio homes on Lincoln Place and that the zoning for the C-B tract will be come effective after
said buffer has been installed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that the above-described property is rezoned to A-P,
Administrative-Professional, and C-B, Business Commercial, effective immediately.
