From: Shirley Volk To: JCallaway Subject: David White The following will be a brief synopsis of the meeting we had with David White on 7/30/96 regarding the problems he has run into while trying to convert at least part of his building on Graham Road into a gymnasium: Attending the meeting were David White, Jim Callaway, Jon Mies {Fire Mazshal), Lance Simms (Building Official) and me (Shirley Volk). David addressed all the questions he had regazding why he was stopped from doing what he wants to do. He was assured by both Lance 8c Jon that if he wants the uses to be storage/wazehouse, what he has done (and what was approved on the plans submitted and permitted) is fine and everything is o.k. If he changes the use from storage into a gymnasium, then there will be some additional requirements which are: 1. A sprinkler system (for fire prevention) because the occupancy would be an assembly over the City's maximum allowed without a sprinkler system of 7500 sq. ft. (proposedtobe 10,000 sq. ft.) 2. The maximum occupancy allowed in the gym would be 650, using building code tables, and the minimum plumbing facilities would be 4 water closets and 1 lav in each bathroom. (Additional will be required) 3. The exits aze not adequate. The requirement would be 4- 36" openings with at least 50% being on the front of the building. -Doors must be "single operation"'doors. 4. Exit lights will be required with abattery backup for egress. 5. Class "A" ratings on wall; floor covering, etc., around egress (approximately 15 ft. around and in front of doors) 6. Tenant sepazation wall mustbe 2 hr. fire rated. 7. Zoning ¢an be addressed by taking thisuse as a Conditional Use Permit to the Planning and Zoning Commission for consideration per Jim Callaway. 8. No fencing between this project and any projects to the reaz will berequired per Jim Callaway. 9. No upgrading of the parking lot will be required per Jim Callaway. 10. There,will be no additional landscape requirements for this tenant changeper Jim Callaway. Lance suggested Ghat Mr. White. address :handicap requirements for accessibility even tho' no exterior changes were being proposed. Mr. White was informed that he could request variances. to any of the requirements listed, and that Shirley Volk could coordinate his applications forany if he desires. Since the meeting David has contacted Shirley and will be coming in on Monday, Aug. 5th to meet with her to telpher what his plans aze. This property is currently zoned M-2 Heavy. Industrial. The permit was issued because the request met the zoning of the district as well as building code requirements for warehouse use and tenant separation. The new user of the :lease space has changed the original intent of the building and would like. to be able to actually each gymnastics classes rather than simply store gym equipment on site. The use is not listed within the list 'of permitted uses within the M-2 district, but is allowed in the A-P and C-1 districts. .The occupancy type would also. necessitate additional building code requirements such as additional bathroom facilities, exits, and fire walls. Before the applicant invests the additional money to either make the improvements required by the building code, he is seeking relief from the Zoning restrictions. In consideration of such cases, the Commission should find that the requested use meets the intent of the zoning district and that it is compatible with other uses that may be located within the. district.. Although this case comes to you because of an individual circumstance, the P&Z must determine whether this use is appropriate for the M-2 district in .general. The M-2 zone has since. 1984 been reserved for more industrial type uses, and includes the uses listed in the M-1 and C-2 districts, but specifically excludes C-1 uses. The purpose statements of the M-1, C-2, and M-2 purpose statements are as follows: (M Y) This district is provided for high technological, light manufacturing, non- polluting industries, properly proportioned and designed for. aesthetic appeal, with controlled design of plant exteriors and construction materials.. Not only.. site design and layout, :but facades, materials, lighting, and apparent architectural aspects of the project are subject to review and approval. All vehicle access shall be paved. The M-1 District may be compatible with adjacent uses in any .other district, depending upon the character. of the operation and the conditions imposed ~C 2) This .district is designed to provide locations for outlets offering goods and services to a limited segment of the general public. The uses included primarily serve other commercial and industrial enterprises. (x'12) This .district is designed to provide land for manufacturing and industrial activities with generation. of nuisance characteristics greater than activities permitted in the C-2 and M-1 zoning districts. Cumulative ordinances are used in some other cities.. These tend to be more flexible for property owners. However, the City of College Station has opted for a noncumulative. zoning, which .gives the City a better planning tool and protects property owners and tenants within the major classifications from unexpectedly incompatible land uses. While it is more. critical to ensure that residential uses are prohibited from commercial and industrial zones, this City has become. sensitive to ensuring certain areas. remain exclusively industrial. There are several uses. in dower intensity zones that are allowed in the. higher zones within each major classification, and: in the past, this City had. been more cumulative in nature. However in 1984, the Zoning Ordinance was amended to remove C-1 uses from the M-2 zone. IMPROVEMENTS TO WAREHOUSE AT 589 GRAHAM ROAD The following improvements are planned to be made to the warehouse at 58.9 .Graham. Road. The.tenant will be a-warehouse occupancy.- 1. The existing metal 3 foot door from the east side will be relocated too the rear of the building to be used as an additional fire exit. 2. A new glass '3 foot door will be installed on the east side where the metal door was. 3. A new 3 foot metal door will be installed on the west side of the .building, 3 foot north of the existing warehouse overhead door in the new 2500 square foot warehouse area. 4. A fire wall, (1) hour, will be installed to divide the 100 X 100 foot area from the (2) 2500 square foot area. (see drawing) Wall to be constructed of metal studs, with 5/8 inch rated sheetrock on each side, taped and'floated.'Wall will be painted after seams have been floated. 5. Two new restrooms, (1) men's and (1) women's, to be installed as per drawing. Both restrooms to be handicapped designed.. - Design to be built on 10 x 10 treated lumber off of the floor. Drainage to be out of rear wall and tie into existing sewer line that was installed this year. (see drawing) - Walls to be 2 X 4 except center wall to be 2 x 6. - Floors to be 3/4 inch plywood covered with the - Floor beams to be l0 x 10 inch treated beams - Inside walls to be green sheetrock - Outside walls to be plywood 7/16 inch - Inside ceiling to be green sheetrock - Outside roof to be plywood 7/16 inch - Deck on outside of restrooms to be 3/4 inch plywood with ramp to allow wheelchairs - Outside deck to have railings - Ramp to have non slip surface - Toilets to have railings as per code - Water supply to be from existing water supply in warehouse - Hot water to come from electric water heater for sinks - Each restroom to have light with fan 6. Electrical to be separated from existing building. - 10,.000 square foot area to be on separate meter. - 2500 square floor office area to be on new meter. - 2500 square foot new warehouse area to have lights only on 10,000 square foot area.. r °7. This property is currently zoned M-2 Heavy Industrial. The permit was issued because the request met the zoning of the district as well as building code requirements for warehouse use and tenant separation. The new user of the lease space has changed the original intent of the building and would like to be able to actually teach gymnastics classes rather than simply store gym equipment on site. The use is not isted within. the list of permitted uses within the M 2 district; but is allowed in the. A-P and C-1 districts. The occupancy. type would also necessitate additional building code requirements such as additional bathroom facilities, exits, and fire walls. Before the applicant invests the additional money to either make the improvements required by the building code, he is seeking relief from the Zoning restrictions. In consideration. of such cases, the .Commission should find that the requested use meets the intent of the .zoning. district and that it is compatible.. with other uses that .may be located within the district. Although this .case -comes to you because of an .individual circumstance, the P&Z must determine whether this use is appropriate for the M-2 district in general. The M-2 zone has since 1984 .been reserved for more industrial type uses, and includes the uses listed in the_M-1 :and C-2 districts, -but specifically excludes C-1 uses. The purpose statements of the M-1, C-2, and 1VI-2 purpose statements are as follows: (M-I) This district is provided for high technological, light manufacturing, non- pollufing industries, properly proportioned and designed for aesthetic appeal, with controlled design.. of plant exteriors and construction materials.. Not only site design:. and .layout, but. facades, materials, lighting, and apparent architectural aspects. of the project are subject to ~t review and approval. All vehicle access shall be paved. The M-1 District may be compatible with adjacent uses in any other district, depending upon the character of the operation and the conditions imposed. (C-2) This district is designed to provide locations for outlets offering goods and services to a limited segment of the general public. The uses included primarily serve other commercial and industrial enterprises. 2) This district is designed to provide land for manufacturing and industrial activities with generation of ' nuisance characteristics greater than activities permitted in .the C-2 and M-1 zoning districts. Uses. within this district are not compatible with residential uses and lower intensity commercial uses. The list of uses includes all those allowed in M-1 and C-2. Cumulative ordinances are used in some other cities. These tend to be more flexible for property owners. However, the City of College-Station .has opted for a noncumulative zoning, which gives the City a better planning tool and protects property owners. and tenants within the major classifications from unexpectedly incompatible land uses. While it is more critical to ensure that residential uses are prohibited from commercial and industrial zones, thin City has become sensitive to ensuring certain areas remain exclusively. industrial. There are several uses: in lower intensity zones that are allowed in the higher zones within. each major classification,. and in the past, this City had been more cumulative. in nature. However in 19.84, the.Zoning. Ordinance was amended to remove C-1 uses from the M 2 zone. No. 1638) does not specifically define or list gymnastics schools. When a specific use is not listed, as often happens with the multitude of uses that exist, the Planning staff. has the responsibility for determining the use that most closely parallels the unlisted one. Section 13 of the.Zoning Ordinance provides for such interpretations. In :this case, the determination was made that a gymnastics studio is similar to those uses listed as "business, music, dance or commercial schools". These uses listed. together arepermitted in the A-P Administrative Professional district. All A- P uses are permitted in C-1. All C-l uses are permitted in C-2. All G2 uses with the exception of C-1 uses are allowed in the M-2 district.. This is why the. gymnastics studio is not a permitted use by right in the M-2 district. I have therefore placed it in the category of "business, music, dance, or commercial schools" as listed in Section 7.12 of the Zoning Ordinance. The only other use listed in the Zoning Ordinance that in my opinion. is similar to a gymnastics school is a "health studio". A health studio is listed under. C-1 and therefore allowed in the C-2 as well. As stated before, C-1 uses are excluded from the M-2 district and therefore health studios are not permitted in M-2.' The Planning & .Zoning Commission considered the gymnastics school use alone when they.: considered whether it should be permitted in the'. M-2 district. Their decision was not made based on the interpretation that it had been classified with the business, music, dance and commercial schools. In fact at least two commissioners fated they felt it did not belong in with these other uses, buf the vote was still that it did not belong in the M-2 district. At this point the following options have been identified for you. i. You may appeal;the interpretation to the'Zoning Board of Adjustment (ZBA) that a gymnastics school is not a music ' and dance school. If the ZBA agrees, you .will still. have to show the Board that a gymnastics school should be classified under one: of the C=2 uses that is listed in section 7.14. The Board could consider this as well but it seems unlikely that the Board will find the gymnastics school similar to any of those uses. I have provided a list of these for your consideration. 2. You may argue that other C-T uses have been allowed in the M-2 zoned areas of Graham Road At best this will have us look into those matters for possible -code enforcement, but will .not affect our position. 3. You have already presented'the case to the .Planning & Zoning Commission that the M-2 district is appropriate'for agymnastcs school. This has been answered by the Commission that it is. not. 4. You may argue that. C-1 uses should be allowed in .all. M-2 districts. This has not been supported historically by staff but would get the question before the P&Z and City Council in the form of an ordinance amendment. Staff would only proceed with an amendment if directed by Council. to do so. 5, You may suggest that the ordinance should be amended to allow gymnastics schools in M-2. We could support this. if we get some supporting evidence that gyms .are compatible with. industrial uses.. Again this would take an ordinance amendment through Council. I have begun to do research in this direction and so far have not found anything in support of this argument. I do intend to follow through with any leads, however, and look forward to accepting any evidence that you may have. If you are in need of further clarification, please let me know..
