AN ORDINANCE AMENDING ORDINANCE NO. 1638, THE ZONING
ORDINANCE OF THE CITY OF COLLEGE STATION, TEXAS BY AMENDIJVG
SECTIONS 2, 7.1, 7.1 B,-AND 7.9, .CREATING A DEFINITION FOR HUD-CODE
MANUFACTURED HOUSING AND SPECIFYING DISTRICTS FOR THAT USE.
WHEREAS, at a meeting that #ook place on September 26,:1996, the College
Station City Council determined -that there is a need to' define .HUD-code
manufactured housing as mandated by the Texas Manufactured Housing Act,
WHEREAS, it was determined by the City Council of the .City of College Station
that HUD-code manufactured housing must be a permitted use in some zoning
district, and
WHEREAS, it was determined that HUD-code manufactured housing should be a
permitted use in the A-0, A-OX, and R-7 zoning districts;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF .THE CITY
OF COLLEGE`STATION, TEXAS:.
I.
That Section 2 of Ordinance No. -:1638 is hereby amended by inserting the
following definition in the list of definitions to read as follows:
"HUD-CODE MANUFACTURED HOME: A structure. constructed after June 15,
1976, according.: to thee. rules of the. United States Department of Housing and
Urban Development, transportable in one or more sections, which in traveling
.mode, is eight body feet or more in width or 40 body feet or more in'Jength, or,
when erected on site, is 320 or'more square feet, and which is built on a perma-
nent chassis and designed to be used as a dwelling with or without a ..permanent
foundation-when connected to the required utilities, and includes the plumbing,
heating, air-conditioning, and electrical systems."

That Section 7.1 of Ordinance No. 1638 is hereby amended #o read as follows:
"7.1 DISTRICT A-O: AGRICULTURAL - OPEN
A. 'PURPOSE: This district includes lands. within the corporate limits. of the
City which are not ubdivided and are relatively undeveloped. It may also
include those areas mentioned in Section 5 above. This district is designed
to promote orderly, timely, economical growth and.. to recognize current
conditions. It is a reserved area in which the future. growth of the City can
occur.

B. PERMITTED. USES:
Single family dwellings.
Mobile homes
HUD-code manufactured homes
Barn, stable for keeping private animal stock.
Country. club (publicly or privately owned).
Crop production.
Farm.
Truck garden .(including greenhouse for commercial purposes).
Golf course.
Home occupations.
Pasturage.
Poultry production (non-commercial).
Riding. academy (private).

C. CONDITIONAL USES PERMITTED: The following conditional uses may be
allowed in addition to any uses allowed. under Section 8.12:
Telecommunications Towerswhich conform to all setback requirements of
this zoning district, which are within. the reasonable height restrictions set
by the Commission, v/hich do not jeopardize the health, .safety or welfare of
the public by their presence in the proposed location, which are consistent
with the spirit,'.. intent and' objectives of this ordinance, and which do not.
negatively damage,' affect,... or curtail. the surrounding land uses. In making
such determination, the Commission the height; setback from buildings on
adjoining, properties,. the overall construction of the tower, .and possible
screening of the base of the tower.
D. AREA REQUIREMENTS: Refer to Table A at the end of this section.
E. PARKING REQUIREMENTS: Refer to Section 9.
F. SIGN REGULATIONS: Refer to Section 12."
That Section 7.1 B of Ordinance No. 1638 is hereby amended to read as follows:
"7.1 B DISTRICT A-OX: EXISTING RURAL RESIDENTIAL
A. PURPOSE: This district is intended for existing single. family tracts that are
.rural in character and annexed by the City. These are areas that do not
meet many of the City's codes and ordinances and are likely to remain
residential #or the foreseeable future.

B. PERMITTED USES:
All in A-0 plus the following:
Mobile Homes
HUD-code Manufactured Homes
Home Occupations
Catfish Farm
Commercial Horse Stable

That Section 7.9 of Ordinance No. 1638 is hereby amended to read as follows:
°7.9 DISTRICT R-7 MOBILE: HOME
A. PURPOSE: This district contains land which is located, designed and is to
be operated as a site for residential uses for .mobile and.- HUD-code
manufactured homes. in .accordance with the specific requirements of
Ordinance No. 627 (and amendments thereto). and the following District
Regulations:
B. PERMITTED USES: Mobile. and HUD-code manufactured home parks,
developed under. the requirements of Ordinance No. 627 (and amendments
thereto).
C. CONDITIONAL USES PERMITTED: Refer to Ordinance No. 627 (and
amendments thereto).
D. AREA REQUIREMENTS: Refer to Section 9.
Mobile and HUD-code manufactured homes -refer to Ordinance No. 627
(and .amendments thereto)..-
E. .PARKING REQUIREMENTS: Refer to Section 9.

SEVERABILITY: Should any section or provision of this ordinance be declared by
the courts to be unconstitutional or invalid, such decision shall not affect the
validity of the ordinance as a whole or any part thereof other than the part'so
declared to be unconstitutional or invalid.
VI.
This. ordinance. shall :.become effective and be in full force .and- effect from and
after its passage and approval by the City .Council and duly. attested. by the Mayor
and City Secretary.

Whereas, at a meeting that took place on September 26, 1996, the College
Station City Council determined Ghat there is a .need to define HUD-code
manufactured housing as mandated by the Texas Manufactured Housing .Act,
AND
Whereas, it was determined by City Council of the City of College Station that
HUD-code manufactured housing must be a permitted use in some zoning
district, AND
Whereas, it was determined that HUD-code manufactured housing should be a
permitted use in the A-O, A-OX, and R-7 zoning districts.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COLLEGE STATION:
That Section 2 of Ordinance #1638 be amended to read:
HUD-CODE MANUFACTURED HOME: A structure constructed after June
15, 1976, according to the .rules of the United States Department of
Housing and Urban Development, .transportable in one or more sections,
which in traveling mode, is eight body feet or more in width or 40 body feet

That Section 7.1B be amended to read:
7.1B DISTRICT A-OX: EXISTING RURAL RESIDENTIAL
A. PURPOSE: This district is intended for existing single familyy tracts that are rural
in character and annexed by the. City. These are areas that do not meet many of
the City's codes and ordinances and are likely to remain residential for the
foreseeable future.
B. PERMITTED USES:
.All in A-O plus the following:
Mobile Homes
HUD-code Manufactured Homes
Home Occupations
Catfish Farm
Commercial Horse Stable
C. CONDITIONAL USES PERMITTED: Refer to Section 8..12.
D. AREA REQUIREMENTS: 'Refer to Table A at the end of this section.
E. PARKING REQUIREMENTS: Refer to Section 9.
F. SIGN REGULATIONS: Refer to Section 12.

That Section 7.9 be amended to read as follows:
7.9 DISTRICT R-7 MOBILE HOME
A. PURPOSE: This district contains land which is located, designed and is
to be operated as a site for residential uses for mobile and HUD-code
manufactured homes in accordance with the specific requirements of
Ordinance No, 627 .(and amendments thereto) and the following District
Regulations:
B. PERMITTED USES: Mobile and HUD-code manufactured home parks,
developed under the requirements of Ordinance No. 627 (and amendments
thereto).
C. CONDITIONAL USES PERMITTED:. Refer to Ordinance No. 627 (and
amendments thereto).
D. AREA REQUIREMENTS: Refer to Section 9.
Mobile and HUD-code manufactured homes - refer to Ordinance No.
627 (and amendments thereto).
E. PARKING REQUIREMENTS: Refer to Section 9.
Mobile and HUD-code manufactured homes-refer#o Ordinance No.
