HomeMy WebLinkAboutStaff Report I li" STAFF REPORT REQUEST: Appeal to Section 3(K)(2)(d) of the Code of Ordinance's Driveway Access Location and Design Policy stating for comer tracts, driveway access shall be taken from the lesser of the two streets. APPLICANT: Sherman Click of Click Homes, Inc., P.O. Box 10261, College Station, Texas 77842 LOCATION: Lot 1, Block 2, Elm Crest Subdivision, 3216 Sunflower Trail ZONING AND LAND USE: Subject Tract: R-I, Single Family Home North: R-l, Single Family Homes East: R-I, Single Family Homes South: R.,.I,R-5 and C-N, Rock Prairie Elementary School, City Park, and Neighborhood Business West: R-I, Single Family Homes STAFF COMMENTS: The applicant is in the process of building a house on a comer lot in the Elm Crest Subdivision. The home is fronting on Sunflower Trail and the garage is facing Mint Avenue. The applicant's original driveway design accessed onto Sunflower Trail, the lesser street at 28 feet in width. Staff reviewed and approved this driveway location as part of the building plans. The applicant is requesting a variance to relocate the driveway access to Mint Avenue, a 39 foot wide collector street. The applicant stated that he has a buyer for the home if the driveway access would be relocated to Mint Avenue (at,request of potential buyer). The Elm Crest Subdivision Plat states that no lot shall have direct access to Welsl;1 Avenue. In addition to the City Ordinance specifically stating that driveway access on comer tracts shall!be taken from the lesser street, the Final Plat ofthe Edelweiss Estates Phase 10-A states that no lot shall have direct access to Mint Avenue. STAFF RECOMMENDATION: Staff recommends denial of the request due to the following reasons: 1. It is not in compliance with the driveway ordinance. 2. ConsistencylFaimess. Staff has denied previous request for access to Mint Avenue. 3. Setting a Precedent. If the variance is approved, it sets a precedent for similar appeals that could come before the Commission for driveway access relocations.
