Item: Consideration of an appeal of the Planning and Zoning Commission denial of a Conditional Use Permif for the expansion of A$M Consolidated High School. Appeal is in the. name of Tom Eyeington of TPM forCSISD. i;96-803) Item Summary: On March 21, 1996, the P&Z in affect denied a Conditional Use Permit for the expansion and renovation of A8~M Consolidated High School. The motion to approve the request was defeated by a .,tie vote of 3 to 3. There was significant opposition'. by he area residents to the expansion. The opposition is due primarily to concerns for traffic, parking, and drainage. The request is for extensive renovations and additions to the high school site. There will be several overlapping phases... Renovations and conversions of the .existing classrooms, gym, library, auditorium, and vocational wing are. scheduled to begin in May of this year and conclude during the summer of 1998. The final phase, which includes removal of the temporary buildings, a visitor parking lot, and the- landscaping, are to begin in January of 1898 and conclude in ,August of that year. Due to the fact that the landscaping is not scheduled o be installed until 1998, the. applicant has requested that the landscaping be reviewed at a later date.. Staff has no problem with this request and the .applicant has agreed to meet the landscape.. requirements that are in place at the. time the landscape plan is formally submitted for review. However, Staff recommends that a landscape. plan be submitted for the portions of the site that will be needed for screening and buffering. The PRC reviewed the site plan ort March 6, 1996. There were several minor commenfs related to missing items that still .needed to be met. The main issues that remained were covered in a meeting between CSISD representatives, City staff and neighborhood residents, See attached memo from Tom Brymer. The proposal includes a_request for a sidewalk variance, a driveway variance, and the Streetscape standards forthe guard rail around the detention pond. ~, - ~`' The detention pond that is currently shown on the site plan at the intersection of Nueces and FM 2818 is to be .reconfigured. At this point, we do not know if the pond will be visible to the surrounding area. The school is :proposing to construct approximately 390 parking spaces on site in an effort to relieve the parking on Nueces. However, the area residents have a concern with traffic on that street coming from the new parking. . Financial Summary: n/a Staff Recommendation: Staff recommends approval with the following: 1. That all information required by ordinance be added to the site plan (easement locations, dimensions, etc.) 2. That there be a sidewalkalong the east aide of Welsh and on Nueces but not on the west side of Welsh `' 3. That the driveway variance be granted 4. If the .pond is visible to any of the surrounding streets, Staff recommends that it be screened or designed to meet Streetscape standards. 5. That parking lot lighting fixtures be of a type to minimize impacts on the adjacent residential area. 6. That the drainage .detention facilities be constructed as part of the. initial. phase of construction. 7. That CSISD will not permit parking on Nueces St. after completion of the new parking lot. 8. That CSISD .will .monitor the use of the .parking lot and drives and will take action as necessary to prevent hazards or negative impacts from after.-hours use of the new lot and drives. 9. That CSISD will submit landscape plans. as needed to screen or buffer portions of the phases where such screening or buffering would be appropriate.. The Conditional Use Permit process gives the Council discretion to approve a permit with any additional conditions. that- would '.mitigate any negative impacts to the neighborhood. (96 701) A Project Review Committee meeting was held Wednesday, March 6, 1996 to discuss the above mentioned conditional use permit request. P&Z Representative Smith moved to recommend approval. of the proposed site plan with the following conditions. The following is a list of ordinance requirements identified by the Project Review Committee. This list does not relieve the applicant of total compliance with all current ordinance requirements. CONDITIONS OF APPROVAL:` Ordinance Requirements: Site Plan Related.• Correct the scale-to reflect finch = 1:00 feet on sheet .one. The. proposed detention .facility located at the corner of Nueces Drive and F.M. 281.8 must be contained on site. PRC Report A&M Consolidated Case. #96-701 Page 2 of 3 Ordinance Reduirements (cont.):. Site Plan Related: Show how the drainage pipe will be extended through to the headwall in the proposed detention facility near the tennis courts along Welsh Avenue.. Show where .the proposed "5' x 3' Precast Box Downstream Section° detail on sheet 1 of 4 is located on site... _ The guard rail around the detention facility along F.M. 2818 must meet Streetscape criteria. Show the "typical" dimensions. (Especially for the parking lot next to the iVlarching Band field.) Calculate the interior island requirement. and show what is proposed. Remove .the topography information and floor plan from the site plan so that it is more legible. _ Clarify what is existing that will be removed and remain. (The shading is unclear.) Show the proposed phasing of the project. _ Show the dumpster locations. Note the number of handicap parking spaces. Show the proposed sidewalks along both sides of Welsh and one side of Nueces as per the Sidewalk Master Plan. The width of sidewalks must be 6' if directly behind the curb or 4' if offset by 6' behind the curb. The Commission can consider a variance to the sidewalk. requirements or consider the phasing of sidewalks. Show the proposed parking layout and numbers near the tennis courts along Welsh Avenue_ Show radii for all curves within the site. Show where the fire departmentsprinkler connections will be located. _ A portion of the proposed kitchen area is not adequately protected by a fire hydrant. An additional fire hydrant can be added or a "lay .down" curb will be .used along the "Bus Drop Offl' for emergency vehicle access. _ The alignment of the entrance drive along Nueces Drive near the marching band field must be aligned with the existing Guadalupe street or a variance must be requested. _ Show the required fire lanes throughout the site. Show the easements for all water lines to include the fire hydrants. _ Distinguish the sanitary sewer lines as public or private. City Engineer Laza seconded the motion. to recommend approval of the site plan with the above mentioned conditions which passed unopposed. MEETING ON THURSDAY, MARCH 21, 1996. THE MEETING WILL BE HELD IN THE COUNCIL ROOM OF THE .COLLEGE STATION CITY HALL "LOCATED AT 1101 TEXAS AVENUE SOUTH. APPEAL PROCESS: An applicant may appeal the decision of the Project Review Committee to the .Planning and Zoning Commission within five days after the -PRC Committee meeting.. Failure to appear the PRC action shall constitute a contractual acceptance of all conditions imposed, and a waiver and surrender of all complaints, defects, or.potential invalidity, whether under state or :federal law. An applicant appealing the decision. of the PRC shall file ten copies of the final site plan as approved by the PRC, showing all changes and requirements imposed by the PRC,.. and accompanied by a written explanation of those items being appealed. Commissioner Hall opened the public hearing. Applicant Paul Clarke approached the Commission and stated that the past and current land use plans reflect apartments for the subject property. The existing C-1 zoning is not in compliance with the Comprehensive Plan. Mr. Clarke presented a topography map of the area and stated that once the Wolf Pen Creek property is dedicated, there is no room left for the construction of a road along the bowling alley property. Commissioner Hall closed the public. hearing. Commissioner Gribou moved to recommend approval of the rezoning request for 2.26. acres located along the eastern section of Colgate and Eastmark Drive, lots 13R and 14R; block B of Eastmark Phase II from C-1 General Commercial to WPC Wolf Pen Creek Corridor. Commissioner Lightfoot seconded the motion which passed un®pposed (5 - 0); Commissioner Lane was not present during .the consideration of this agenda item. AGENDA ITEM N0. 3: Public hearing to consider a conditional use permit. request to allow additions and renovations to the existing A&M Consolidated High School located at 701 F.M. 2818 at the Welsh Avenue intersection. (96-701) Senior Planner Kuenzel presented the staff report and explained that the request is for extensive renovations and. additions to the high school site. There will be .several overlapping phases. Renovations and conversions of the existing classrooms, gym, library, auditorium and vocational wing will begin in May of this year and conclude during the summer of 1998. Site improvements such as the addition of several hundred new parking spaces, new tennis courts, and utilities. will begin,next month and conclude in August of this year. The 'final phase, which .includes removal of the temporary buildings, a .visitor ..parking lot, and the landscaping will begin in January of 1..998 and conclude in August of that year. Due to the fact .that the landscaping is not scheduled to be installed until 1998, the applicant has requested that the landscaping be reviewed at a later date.. Staff has. no problem with. this request and the applicant has agreed to meet the landscape requirements that are in place at the time the landscape plan is' formally submitted for. review. The Commission has the option of reviewing the plat at that time or directing staff to ensure compliance with the applicable ordinance requirements. The Project Review .Committee reviewed the site plan on March 6 1996. There were several minor comments related to missing items that 'still need to be met. The main issues that need to be discussed at the Commission level relate to a request for a sidewalk variance, driveway variance 'and Streetscape standards for the guard rail around the detention pond. The school has budgeted for.the improvements that are listed. above, but were not aware of the sidewalk requirements. at the time the cost estimates were prepared. The school is requesting' a variance to the requirement. Staff has consistently required sidewalks on similar sites, and is therefore recommending that there be sidewalks installed. However, staff is also aware of the fact that the sidewalk requirement would' not be required in areas of the site where no expansions are proposed. Therefore we would recommend that there be a sidewalk on at least one side of Welsh along the entire frontage of the school, and that the sidewalk on the west side of Welsh be.waived.. The Commission also has the authority to allow the sidewalk to be installed in a later phase some time before August of 1998. The driveway that is located on the far north side of Nueces technically ,does not meet the Driveway Access Ordinance. The minimum distance. for the off-set between the driveway and Madera Circle is ,125', the actual distance. is 60'. However, staff has no problem with this. request due to the relatively low speed limit on Nueces and because the off-set of the street in relation'to the driveway may decrease additional traffic on the cul-de-sac. P & Z Mirrt~tes March ?1, 1996 Page 2 of 7 Senior Planner Kuenzel stated that the detention pond that is currently shown on the site plan at the intersection of Nueces and F.M.. 2818 is to be reconfigured. If the pond is visible to any of the surrounding streets, staff recommends that it be screened or designed to meet Streetscape standards. Staff recommended approval of the request with Project Review Committee conditions, the change in the sidewalk locations and the driveway variance. Senior Planner Kuenzel stated that she. has received several calls from the surrounding homeowners concerned with the location of the parking lot. The homeowners would prefer to see the parking lot is a different area due to .the close proximity of the existing homes. There was also a concern expressed by one of the homeowners about. an existing span of trees along Nueces that should be preserved. Commissioner Hall opened the public hearing. Representative of CSISD, Lisa Cantrell approached the Commission and offered to answer any questions pertaining to the renovations of the existing high school. site. The District is looking into the possibility of placing a sidewalk along the west side of Welsh. as far as Nueces. From the new. parking along Nueces to Welsh is not a well traveled path and if a sidewalk is .required, may encourage parking along Nueces. The District would prefer to have the students on site. It will be three years before the landscaping will be installed and the screening. of the. proposed parking lot will be addressed at that time. Commissioner. Gribou questioned the possibility of a larger buffer along Nueces or shifting the parking lot towards the center of the complex rather'than adjacent to the existing residences. Ms. Cantrell explained that one. reason for'the parking lot design is close proximity to the school. The District is looking. into the possibility of controlled access parking for the students. The further away the parking lot is from the school, the students may begin to parking along the street. There is also a public sanitary .sewer and gas line including, a playing field along Welsh that makes it less expensive to leave the parking lot in its proposed configuration. Tom Eyeington of Total Project Mangers and. representative of CSISD informed the Commission that about two .weeks ago, he met with the City and Highway Department and it was agreed that once the parking lot is built, parking will be eliminated along the Access Road. The City agreed to monitor the no parking area; .however, the. State does not want to give. up the existing road. Once the entire project is complete, the issue will be readdressed to .determine what will become of the existing road. The large parking lot along Nueces will further. deteriorate. the adjacent single family neighborhood and lower property values. Suggested relocating some. of the parking and doing. away with some of the playing fields. The parking lot should be reduced in size and not have any entrances on to Nueces. The parking lot should be located closer to Welsh where most"of the activities occur. The playing fields could be extended along Nueces to help buffer the parking-lot from the existing residences. The site should be redesigned to take into account the concerns of the residents. (2) The traffic caused by the proposed parking lot. Nueces is a narrow residential. street and was not designed to carry the traffic that will be created by a large parking lot. (3) The trash caused bythe proposed parking lot. The District does not take care of the vacant land now much less once the parking lot is constructed. The residents of the area currently pick up trash from the school site along Nueces that will only increase once the parking lot is constructed:. (3) Lighting of the proposed parking lot. The large amount of lighting required for the parking lot will negatively effect the adjacent residences. (4) Drainage of the entire area. There is an existing problem with drainage in the neighborhood that should be addressed prior to allowing any more construction on the school site. In the past several years, there has been a great deal of flooding in the surrounding. area. (5) Deferment. of the landscape plan. The entire landscape plan may not be required at this time; however, the residents should at least have something that shows the school's intentions with regard to buffering and screening. Commissioner Hall closed the public hearing. Commissioner Gribou moved to table the conditional use permit request to allow CSISD time to work with the surrounding neighbors to see if they can come to an agreement and until such time that the concerned groups have had. a chance. to discuss the issues. Commissioner Garner seconded the motion which failed {2 - 3 - I); Commissioners Smith, Lane and Lightfoot voted in opposition to the emotion and Commissioner Hall abstained from voting.. Commissioner Lane moved to grant the conditional use permit with staff recommendations. Commissioner Lightfoot seconded the motion. Commissioner Gribou stated that he felt that the neighbor's concerns should be addressed in some fashion prior to granting the conditional use permit. Currently, CSISD does not take very good care of their grounds and it is a problem for the surrounding residents. The Commission should make sure that there is something that will guarantee good landscaping and grounds keeping. and address the neighbor's concerns. Commissioner Hall stated that he thinks it is important for the residents to feel more comfortable with the proposal. More discussion needs to occur to see what can be worked out including drainage, and sidewalks along Welsh. P & Z Minutes March 21, 1996 Page 4 of 7 r Commissioner Lightfoot stated that a lot of study has been given in the design of the site. The drainage concerns have been addressed by the District. As far as security and the proximity of the parking lot, in order for the school to monitor the parking lot, it should be closer to the building. The motion to approve the conditional" use permit failed (3 - 3); Commissioners Garner, Gribou and Hall voted in oppositionto the motion. AGENDA ITEM N0. 4: Public hearing to consider a conditional use permit request to allow an Emergency Room addition to the existing Brazos Valley Ir'Iedical Center located at 1604 Rock PrairieRoad in the Belmont Phase II Subdivision. (96-702) Senior Planner Kuenzel presented the staff .report and informed the Commission that the request involved the expansion of the existing emergency room into an 11,470 square foot Emergency Surgery addition, The project also involves the relocation of fifteen existing parking spaces, the relocation of the existing helicopter. pad and the reconfiguration of .the Emergency Entrance. driveway and fire lane. The original;conditional Lise permit and site plan was approved by the Commission on October 17, 1985 for 258 parking spaces serving the 76,503 square foot hospital. Anothersite plan for the 44,624 square foot medical office was later approved fur 179 parking spaces, resulting in a total of 437 required parking spaces for both the hospital and the medical office building. Currently, 569 parking spaces are provided for the whole complex, exceeding the parking requirement by 132. parking spaces. The current .Zoning Ordinance allows for hospital parking to be determined by the Commission. Neither the file documents nor-meeting minutes specify what parking methodology .was used at the time of the original conditional .use/site plan approval. Hov~~ever, staff feels that the parking necessary for the 11,470 square foot trauma center expansion--is comparable to the current medicaUdental clinic (<20,000 s.f.) requirement, of one parking space per 200 square feet. Using these numbers, the trauma center expansion would need. approximately 58 parking spaces, which is well under the current 132 additional parking spaces. Staff recommended .approval of the conditional use permit with the conditions listed in the Project Review Committee report. Commissioner Hall opened the public hearing. Seeing no one present. to speak in favor of or in opposition to the'request, he closed the public hearing. Commissioner Lightfoot moved to grant a conditional use permit to allow an expansion. of the hospital for a new emergency surgery department at 1604 Rock Prairie Road, tract A., block 3 of Belmont Place Section II with staff recommendations. Commissioner Gribou seconded the motion which passed unopposed (6 - 0). AGENDA ITEM NO. S: Public hearing to consider a final plat of lots 6 and 7, block 1 of the Foxfire Phase One Subdivision to relocate an interior lot line. (96-202) Graduate. Civil Engineer Homeyer presented the staff report and stated that the property is being replatted'in order to relocate an interior. lot line between lots 6 and 7. This replat does not create an additional lot, but changes the lot configuration. Staff recommended approval of the final plat as presented. Commissioner Hall opened the public hearing. Representative SUBJECT: Temporary .Classroom .Buildings - A&M .Consolidated High School; five additional temporary classroom buildings to be located within the existing asphalt surfaced staff parking lot along Welsh Street adjacent to the west side of the high school building at 701: F.M. 2818. (96-701) A Project Review Committee meeting was held Wednesday, April 30, 1997 to discuss the above mentioned site plan. Mr. Savage.. explained that the additional classroom buildings are needed to facilitate the additions and renovations :of the existing high 'school. All temporary classroom buildings will be removed upon the completion of the project in June of 1999. P&Z Representative Gribou moved to:allow the five additional temporary classroom buildings with the condition that the removal of all: temporary classroom buildings throughout the site coincide with the completion of the project. City Planner Kee seconded the motion which passed unopposed (3 - 0). COORDINATE THE REMOVAL OF THE BUII,DINGS AND THE COMPLETION OF THE PROJECT WITH DEVELOPMENT COORDINATOR SHIRLEY VOLK AT (409) 764-3570. Regular 4/25/96 Page 4 variance with the condition that notes be placed on the official plat to notify future lot owners of four lots which .may. not be developed. Councilwoman Crouch moved approval of the preliminary plat. Councilman Fox seconded the motion which carried unanimously, 7-0. (4d) Appeal of Planning and Zoning Commission denial of conditional use permit for .expansion of A8~M Consolidated High School (96-203). Sabine Kuenzel described the zones surrounding the site of A&M Consolidated High School and the phase implementation of the expansion project. She presented several slides depicting the expansion .and the impact on neighborhoods.. Planning and Zoning Commission heard evidence related to the conditional use permit and the board subsequently reached a tie vote, which resulted in denial of the permit. The School opted to bring forth the appeal to City Council. Many concerns were expressed by residents on the topics of increased drainage and site layout (parking 1ot). Kuenzel .noted thatthe school made changes to the site plan since concerns were raised by residents at the Planning and Zoning Commission meeting. Staff also hosted meetings with neighborhoods to provide further information. CSISD has requested two variances: 1) location of the driveway into the parking area on Nueces; and 2) sidewalks along Welsh and Nueces. Staff recommended approval of the following conditions: 1) sidewalk be placed completely on Nueces and east of Welsh, but not on the west side of Welsh '' 2) driveway variance 3) screening of detention pond on southwest corner 4) parking lot lighting directed away from residential areas 5) drainage detention pond be constructed as part of the initial phase of construction 6) CSISD monitor use of parking lot and drives and will take action as necessary to prevent hazards or negative impacts from after hours use of new parking lots and drives 7) future protection of parking lot, if needed 8) landscape plan presented to council for 90 ft. no build area 9); miscellaneous information 10) all information as required by ordinance ,a. Regular 4/25/96 Mayor Ringer opened the public hearing. Page 5 Tom Eyeington addressed the council in support of the permit. He remarked that the conditions established by staff are acceptable. Mr. Baugh of 1903 Nueces addressed the Council. He supported the expansion project; however, he expressed concerns about the size of parking lot and the traffic generated for 588 parking spaces. He suggested parking be moved to Welsh Ave. Henry Schmidt of 2005 Nueces addressed concerns related to the landscape birms and the maintenance expense for school district. He also noted the traffic hazard that will be incurred by the tall birm, as well as drainage problems. Mr. Schmidt requested that the no parking signs be placed on the side of street next to school property, rather than residential property. Chris Bailey of 1205 Guadalupe, addressed the issue of flooding at corner of Guadalupe and Langford. Assistant City Manager Brymer indicated that the drainage project of Bee Creek and Texas Avenue culvert expansion project might have an improvement on the situations in this particular area. On the other hand, improvements upstream (Police Station and Arboretum) will not accomplish too much for this neighborhood until the improvements are made directly in thee. area. The drainage project he has noted will begin approximately 12-24 months. Nelda Norman of 2003 Nueces addressed concerns of drainage and traffic. She noted that the parking lot shall be located across from her home. This will have a detrimental affect to the property values as well as enhance traffic problems. Mayor Ringer closed the public hearing. Councilwoman Crouch moved approval of the conditional use pemit with the conditions outlined by staff and that the "no parking signs" on Nueces be erected on the west side of the. school property. Councilman Mariott seconded the motion. Motion carried unanimously, 7-0. Sabine explained that the sidewalk master plan indicates a sidewalk on both sides of Welsh along frontage. It also shows a sidewalk on one side of Nueces. School requested a variance that a sidewalk not be placed along west side of Nueces and west side of Welsh. ~:> < ..'1R Regular 4/25/96 Page 6 City Engineer Kent Laza explained that the sidewalk along Nueces is required by the city's thoroughfare plan. Staffs recommendation was to grant variance for sidewalk and only require sidewalk on Nueces from Welsh to frontage road, and a sidewalk in front of athletic area on east side of Welsh, not on west side of Welsh, and grant variance for drive entrance to parking lot. Councilman Hickson moved to accept staffs recommendation. Councilman Kennady seconded the motion. Motion carried, 7-0. (4-e) Approve budget transfer between departments. resulting from reorganization of city departments as proposed by city manager. Councilman Mariott moved approval of the newly reorganized city structure. Councilman Fox seconded which carried unanimously, 7-0. (4-f) Appoint Texas A&M student to Northgate Revitalization Board. Councilman Kennady made a motion to appoint Andrew Pavlinski, as a representative from A&M, to the membership of Northgate Revitalization Board. Motion seconded by Councilman Mariott. On January 11, 1996 council approved the installation of an 800 MHz radio system. During planning of this system, city staff and city's consultants recommended the city and TAMU provide radio back up with their respective radio systems.
