We received the approved construction .plans that were originally approved in 1998. In performing a cursory review of the new mylars and comparing them to the approved plans, we noticed an omission on the new mylars. The City's engineering representative, Paul Kaspar, who originally approved the construction plans is no longer employed by the City. New engineering staff members are not comfortable stamping a new set of plans without additional information and/or review. Because we are not able to approve the n_ew mylars without a complete, new review of the plans you have the following options: (1) Seal the mylars that were originally approved by the City in 1998. You could seal those mylars previously approved & stamped by the .City in addition to the original engineer. of record. The City will honor those originally approved mylars with a valid engineer's seal. (2) Submit a sealed letter stating that you have reviewed the new mylars and compared them to the originally approved plans in 1998. If you choose this option, you must verify that no changes were made to the new mylars and that they are identical to the previously approved mylars. You will be responsible for any errors or omissions on the new mylars. (3) Submit 3 sets of plans along with the appropriate applications & fees to be reviewed by staff. This will require a new comprehensive review by staff. Overview When a proposed development .desires to deviate from the typical requirements that College Station has adopted, a development agreement is negotiated in which the city agrees to relax certain requirements in exchange for some other tangible benefit from the developer. It .has never been the city's. policy to consider the added tax value of the property as the benefit it receives in the negotiation. Instead, the staff looks for radeoffs in other areas .such as parks,. street construction,- utility upgrades or other such improvements in exchange: for the requirements being relaxed. When possible, the city staff tries to make an exchange of equal or greater value than that being given up. Developers are generally expected to provide all necessary street, drainage, utility, and other improvements necessary for their development. These improvements'-are determined through engineering studies of the surrounding area. and the effects of the proposed development.. It is not thee.. city's policy to subsidize development in any way except to provide oversize participation to' elements of the infi°astructure so that future development in the vicinity will have access to adequate services. Roadway Improvements In the case of the Melrose Apartments, the developer, Intergroup, Inc. proposes to build between 462 and 666- apartment units on a tract of land between Holleman, Jones- Butler, and Luther Streets with primary access onto Luther Street. Both Jones-Butler and Luther Streets are unimproved, gravel roads at this time. The city's current thoroughfare plan calls for Southwest Parkway to extend through the center of this property as a minor arterial (56 ft. street,' 80 ft. ROVE' and for Jones-Butler to be upgraded to a collector. street. (3 8 $. street, 60 ft. ROVE. Luther Street is also shown as being improved to a collector street standard on the thoroughfare plan. In the. proposed thoroughfare plan now.. being considered by the city, Southwest. Parkway' and .Jones-Butler have switched their street classifications such that Southwest Parkway is shown as a collector and Jones-Butler is a Honor arterial that will extend through to George Bush Drive at some point in the future. Southwest Parkway Abandonment Intergroup has requested that the p,prtion of Southwest Parkway that. will extend through their property be abandoned to enhatince resident security. They propose to ,, construct a cul-de-sac at the end of the existing portion of street and have a secondary access point from their development onto it, Their traffic study indicates this will provide adequate traffic distribution when combined with the primary access onto Luther Street and other roadway improvements. The city staff concurs with that assessment as a beginning point for negotiation on the surrounding streets. In their proposal, Intergroup implies that the internal street system and the ,proposed cul-de-sac ``will utilize any cost savings derived from the abandonment of Southwest Parkway." It is the staff s position that the internal streets system is necessary with or without. the extension of Southwest Parkway, and that its cost is not pertinent to these negotiations.. The city does not receive any benefit from this aspect of the proposal and we expect .other compensation in its place. Luther Street Improvements On page 28 of the Traffic Impact Analysis Addendum prepared by VVFIlVI Transportation Engineering. Consultants, Inc. for Intergroup, the following statement is made: "Based on analysis of existing and projected conditions and in order to provide the safest and most effective movement into and .out ®f the site, the following recommendations were developed." The study then goes onto recommend that Luther Street be upgraded to a paved two lane collector with 60 ft. of right-of-way. Yet in their proposal, Intergroup .only offers to pay for one lane of a 27 ft. wide residential street. Since Luther is currently an unimproved, :gravel roadway it is the staffs position that the developer be required to upgrade Luther to collector standards as recommended. by their traffic study. The extent of these improvements is negotiable.. The staffs position is that the developer is required to improve Luther from their accesspoint to the next improved street which is Marion Pugh Drive. Otherwise, traffic generated from the Melrose Apartments would be forced onto an unimproved surface between the edge of its site and Marion Pugh. The portion of Luther. adjacent to the development but west of the. access point is approximately 2300 .feet. Since this would not be a primary route for most traffic into and away from the city, yet'it is on the thoroughfare plan for future improvement, the staff sees this as a negotiable item in the development agreement for the abandonment of Southwest Parkway. Rough estimates indicate: the cost of this portion of Luther Street to be approximately $495,000. The Southwest Parkway extension through the site would be approximately 1200 ft. long and would cost approximately one®half as much as the Luther frontage, or about $248,000. That means'the city would see abenefit of approximately $248,000. Jones Butler Improvements The Traffic Impact Analysis Addendum also recommends that "Jones-Butler Road should be upgraded to a paved five lane minor arterial with 80 feet of right-of-way in conjunction with site development as required by the City of College Station." Through discussions with the traffic engineer, the staffhas determined that the reason .for this is that this arterial is necessary to provide appropriate traffic dispersion onto the other thoroughfares around this development. As with Luther Street, the staffs position is that these improvements should be made up to the point. that Jones-Butler meets the next improved, paved surface which is at the Holleman intersection. It is the. city's policy that developers must bear the cost of extending streets on the thoroughfare plan through their property. The city only participates with oversize funding when traffic studies conclude that any extra width is not necessary to support the development but merely for the benefit of future traffic. movement through the area. In this case, the traffic study indicates a need for the minor arterial to "provide the safest and most effective movement into and :out of the site". Despite this statement in their own traffic study, Intergroup. in only offering to pay for one-half of a 27 ft. street that fronts onto their property.. The staff s position is that the full cost of improvements to Tones- Butler should be borne by the developer. Wastewater Improvements It is the city's policy to require developers to extend water and wastewater utilities through-their sites so that the next adjoining property has access to the system without disturbing improvements such as buildings, parking lots, .landscaping, etc. In this case, sewer service to the Melrose Apartments is provided from the south side of the development. Since there are at least two outparcel lots encompassed by this development, sewer service to the lots would. be effectively cut off if .sewer lines. and. easements are not provide through the site.. Therefore, it is the staff s position hat these extensions should be the responsibility of the developer. Water Improvements As with streets, developers are required to pay for .the necessary water systems to serve their site. This includes off site extensions that are necessary to tie into an adequately:. sized. water. main. In this case, the size of line needed to serve the Melrose Apartments is a 12" line. The Intergroup proposal states that an 8" line is sufficient, but estimates later in the report refer to 12" lines serving the development. If this is indeed the case, the staff agrees that: increasing the size to a 16" line~is an acceptable oversize participation project. This oversizing only applies to the main trunkline through the project and does not include the branches needed-for fire hydrants. and service lines. It is not clear from the proposal what this. oversize cost would be. The estimates are computed assuming: all lines within the development (12" and 8") would be upgraded to 16" .lines. Also, it does not give the cost of looping a 12" line to and from the site to provide adequate circulation. The stafFs estimate places the oversize cost at approximately $52,000.: This figure is over the dotal budget allowed for oversizing water lines for FY 96-97. Therefore,'the developer will be required to fund the additional cost of this line with some arrangement for the city to reimburse him over a period of time. A Summary Most of the infrastructure improvements noted above are directly attributable to the. development being proposed. With the exception of the oversize participation to the waterline and the Luther Street improvements adjacent to the site, there is little other room for,negotiation. When the staff made the "requests" noted in the Intergroup 0proposal, they were presented as minimum requirements to treat this development in the same manner as others are treated. To assume those minimum requirements are a starting .position from which the developer can begin negotiating downward is not fair.. It places the~city in the awkward. position ®f potentially requiring less of this developer than we do others. The incentive this developer gives the city to negotiate these :items is the increased tax revenue from the completed site. As stated earlier, .this has never been a negotiating point for the staff to consider. There are many apartment complexes in College Station. And even though this one will include many upscale features others do not offer here,. every tenant that moves into it does so at the expense. of some other apartment complex or rental unit in the city thusdecreasing their value. .While the staff wishes to assist Intergroup in bringing the Melrose Apartments to College Station, it is note their desire to do so at the expense of the taxpayers. Therefore, the above noted items are the staffs minimum requirements for negotiations on this development agreement. The proposed 30' City of Bryan electrical easement along Jones-Butler has been moved inside the property along the proposed 40' right-of--way. 6. 4" backflow preventers have been added to all 4" fire lines to the buildings. 7. Station City Council recently removed the requirement of the developer to obtain off-site drainage easements.. In brief, this means that Integroup will not be responsible for obtaining the off-site drainage easement that was previously required far a development permit. However, this change in policy does not preclude the developer from dedicating drainage easements on his property. To respond to'your question about all weather surfaces for fire protection,. I must begin by stating that the. City does not currently have a definition that. would apply to this item. At the present time, the only requirement that the City has is that it be a gravel surface adequate to support emergency vehicles. The Engineering Department is proposing to amend the Zoning Ordinance to define a temporary all weather surface as a one (1) course seal coat on four (4) inches of crushed limestone base. This temporary surface' would need to be removed and ultimately replaced with the permanent pavement structure before a Certificate of Occupancy could be issued. Tony Hawley said that the largest meter we would want to use on a project like this would be either a 4 or 6 inch compound meter. He said that the low flow would be inaccurate on larger meters. The 4 inch meter is rated at 500 gal/min and the 6 inch is rated at 1000 gallmin. John also requested the option of entering. into a maintenance .agreement in order to cover the .fire hydrants on-site. He said that they wanted this. in order to not create. a spaghetti bowl of easements within the site... Within the Code of Ordinances, Chapter 6, Page 6-5 it states that"Public fire hydrants of the City of College Station standard design shall be installed as part of the .water distribution system for subdivisions and/or site developments". John sent a fax regarding the. designation of a .primary channel within the drainage manual. I stated that the circled area was considered part of the secondary system. He also asked why Walden Pond was not required to create a drainage easement across their property when it was platted. He referenced the drainage easement section .within the Code of :Ordinances where it .requires such dedication. l read it and determined that it says "may be required°. With that wording and a change in personnel and/or .policy, it may have not been required at that time. Under the current policy, off-site drainage easements are required. Staff Recommendations Section 1. The traffic impact study is being modified by Mike McInturff per our conversation with Ed Hard on June 5, 1996 in regards to the City's recommended parameters. Upon completion of the TIA, we would like to pursue the elimination of a Southwest Parkway extension. We are in agreement on the upgrade of Jones-Butler to minor arterial status. 2. In regards to the specific construction of Southwest Parkway, please refer to response 1. 3. We plan to take access to Luther Street. Therefore, we will develop Luther Street to collector :standards and dedicate additional right-of--way to enlarge Luther to a minimum of a 60' right-of-way width on a cost participation basis. 4. The developer understands that they are responsible for improvements to Jones- Butler along. the frontage of their property to minor arterial standards on a cost participation basis. Ordinance Requirements Section 1. The entire Ray A. Walker property located along Luther Street is included in the preliminary plat and will be included in the final plat when it is submitted. ;~ Ms. Sabine Kuenzel June 11, 1996 Page 2 2. Off-site drainage easements are indicated on the preliminary plat downstream to the primary channel or right-of--way. 3. These items will be included in our oversized participation request. 5. The proposed 16-inch and 12-inch water lines will be located within the right-of- way of Luther Street from .Jones-Butler to the west end of the property.. 6. At this time, a fee for parkland dedication in the amount of $103,950 will be paid in lieu of land dedication. 7. The boundary reference andnotes for the 24 foot landscape reserve setback have been removed from the preliminary plat. 8. A point of beginning has been indicated for the basis of the boundary bearings. 9. The right-of--way widths on Jones-Butler, Southwest Parkway and Luther Street have been added to the preliminary plat. 10. The reference to the current date of the flood insurance rate map will be added to note 5 as soon as it is available from the City of College Station. Comments and Concerns Section 1. Oct.16,1998 From: Nanette Manhart After experiencing great difficulty and a lengthy wait in getting in the security gate, Joaquin and Idrove/walked the site of Phase I. 'In general, the site looked good, very clean ,good groundcover in most locations, and the newly installed trees/shrubs were well installed. Of concern is the number of apparently .dead large existing trees -16 by our count. They probably don't need the points anyway, but we need to check in the Spring to see if they have survived and how that affects their point count. The items that need addressed are as follows: 1. The Detention pond did not appear to be hydro-mulched. Melvin has indicated that it was. I suspect the rains have washed all the seed into the bottom. Have asked Melvin to check it as the. sides and top areas must be stabilized with perennial grass. 2. The area in front of the building to .the northwest of the detention pond does not appear to be seeded/sodded. The islands and areas surrounding. the parking lot adjacent to there and Phase II do not have visible grass cover. Again the rain may have washed it away and it will have to be re-seeded in order to finalize the landscaping. ~. Of note and concern is the large pile of dirt in the area of Phase II as it could contribute to creating a very muddy area due to run off. This may, howerer be addressed by a different ordinance/development agreement requirement. And hence will not be addressed here. 4. Streetscape plantings along Jones-Butler. appear to be a few plants short of the requirement with no groundcover/grass under the newly installed and existing plants. The installation of the additional Streetscape trees can wait until the Phase II project, which has a large number of Streetscape points required along Luther. BUT the area of the Streetscape requirements along Jones-Butler will need to seeded/sodded or covered with groundcover. These apparently are the origional approved mylars which have been re-sealed by another engineer registered to practice in Texas. These are acceptable. Apparently the origional approved plan set contained 56 pages and maybe 60 pages (we have one set of bluelines that has 60 pages). As a minimun I feel the Developer needs to apply for a new Development Permit and submit three complete sets of blueline drawings that have the proper professional seals and City approval stamps. They will also need to submit a new EPA N.O.L. and any appropiate fees. I strongly suggest a pre-construction meeting prior to any on-site construction activity. May 2, 1997 Re: Melrose Apartments Sewer Capacities Steve, After looking at the revised flows provided by John Freidman, we have determined two specific factors affecting service. 1. The existing downstream system is currently considered as .impacted, and existing capacity problems have been noted for some time in the area between the High School and the Police Station. The computer model runs for wet weather events actually anticipates an overflow of the system near the Police Station in the present loading. The existing pipes begin to seal and undergo .pressure flow near the High School, which then exceeds TNRCC design parameters. The peak flow provided by the developer's engineers is approximately 23% of the current flow in the line in wet weather conditions, so we may expect a significant impact on the line. There are two choices avai able for the elimination of this problem,. reduction of inflow from the Southside area:, or Installationof a parallel sewer main to relieve the existing lines. Because both of these options are extremely involved, and with the understanding that a development agreement is being negotiated, I suggest that this issue be considered of a .meeting between development services and public utilities staff to coordinate what should be done,. when,. by whom, and how it vdrill be addressed in the development agreement. 2. The small diameter local lines adjacent to the development are limited in capacity, thus only a part of the proposed flows may enter in those locations. The remainder. of the flow should be directed to the 15 inch collection main which runs south :and east of the property. i r t Based on the proposed masterplan flow generation numbers, the existing 8 inch line adjacent to the site has roughly 260 gpm (peak) available to the intersection of Jones-Butler and Holleman Drive. Between this intersection and .the junction with the 15 inch main,. there are 5 reaches of sewer line that we do not have sufficient data. to determine the available capacity. Should the developers wish to use this means. of handling a part of the expected flow, we would need to survey the existing lines and then complete the capacity calculations.
