May 7, 1997 Ms Carla McGregor _ Brinker International 6820 LBJ Freeway Dallas, TX 75240-6515 Dear Ms. McGregor: am writing in response to your letter to Shirley Volk of :April 29, .1997, in which you discussed the. cactus sign that is proposed for the On The Border restaurant. Technically, thesign does not meet the City's Zoning Ordinance as it relates to attached signs because such.. signs are required to _be parallel to the face of the building and may not extend more than one foot beyond the area to which the sign is attached. .However, the City Staff has discussed the circumstances that lead to Brinker's expectation that the cactus sign would be permitted. There was some miscommunication that .occurred earlier when I discussed the sign with your sign company. In the interest of fairness, I am prepared to release a permit f®r the sign if it meets Building .Code requirements.. Review under those restrictions will be conducted when the application is submitted. If you have. any questions regarding this matter,:.please. do not hesitate to give me a call. Thank you. Enclosed is a blueprint for your review with a proposed new Red Lobster pylon sign to be located at this: Red Lobster location. Please note that,. L .set. the -sign back 50 feet from the curb in order to obtain .proposed square footage and height for the. new pylon sign. Based upon Table 1, under notes item 4, 2 used the formula o:E the square of 1/6 the. distance in feet from the base of the `sign to the curb or pavement edge of the frontage street, whichever is greater ie; 50 1/6 = 8.33 x 10 = 83 square feet. Our proposed sign has 80 square feet. The height was established using Table l also, less than 50 feet .but more than 45 feet, reference allowable height for freestanding signs. Please check my calculations to see if I'm correct. I'll. contact you Thursday .morning to discuss. Sinc rely, William H. Macrum WHM/pp 3201 Cherry Ridge Drive Suite C-301 San Antonio, Texas 78230. Tract E is Computer Access. Tract G is a parking and access reserve. Tract D is still available for development. All 5 tracts are considered a single building plot regarding signage. _ The City allows only one freestanding sign per building plot. If the Red Lobster sign is removed, the entire site will be allowed 100 square feet of sign areq,on a single freestanding sign. If the new Red Lobster sign is 100 square feet, Tract. D will not be allowed any freestanding. signage. Any dealings between owners of all 5 tracts for signage will become private matters - there is no recourse under our City ordinances to require sharing of sign areas. r, SUQM(T APPLICATION AND Tf{lS LIST CE{C•CKED-OFF W[TH IG FOLDED COPIES OF S[TE PLAN FOR REVIEW n~iNIMUM REQLIIREME ~T~~ OC n~ts~ ~~ ~ ROpOSALS ALL CITl ORD INCLCi~ING atlT NOT L[h~iiTED TO Ti~E i40LL W[NG: t .
