Ordinance Requirements: _ An additional drainage report for the site is required prior to development of the site. The site. plan is being approved without review of this drainage. report.. If the report changes the site plan substantially, a revised site plan must be submitted for further review by the Project Review Committee. Detention may be required if the Emerald Park Plaza drainage report does not indicate. a detention pond is not necessary. _ Note the size of the proposed water service line to the building and the type of connection to the existing 8" water line. (Note the material used for the existing 8" water line.) _ Sidewalks -Are they to be .constructed with the final plat or site plan and which side of the street will they be constructed? _ The proposed dumpster may have to be gated to adequately screen it from all rights-of- way. (96-411) A Project Review Committee meeting was held Wednesday, May 15, 1996 to discuss the above mentioned parking lot plan, Planning & Zoning Commission .Chairman Hawthorne moved to approve the: site plan with the following discretionary.. items, ordinance requirements and comments. The following is a- list of discreationary items and ordinance requirements identified by the Project Review Committee. This .list does not relieve. the applicant of total compliance with all current ordinance requirements. CONDITIONS OF APPROVAL Discretionary Items; Construction access: must be restricted to the location of the proposed Gemstone only. Ordinance Requirements: Since the drainage report for the entire subdivision is being reviewed with the site plan, the site plan submitted. is being approved without final review of the report. If the. report changes the site plan substantially, a revised site plan must be submitted for further review by the Project Review Committee. The developer installs all conduit per city design and requirements: including the transformer pad and junction box pads. (A junction .box .will be located. on Gemstone near the northeast corner of th eproperty. Submit service voltage, service main size and electrical .load date (total kW}. A temporary blanket easement on the .property wilt be needed prior to installation.. APPEAL PROCESS: An applicant may appeal the decision of the Project Review Committee to the Planning and Zoning Commission within five days after the PRC Committee meeting. Failure to appeal the PRC action shall constitute a contractual acceptance of all conditions imposed, and a waiver and surrender of all. complaints, defects, orpotential invalidity, .whether under state or federal law. An applicant appealing the decision of the PRC shall file ten copies of the final site plan as approved by the PRC, showing all changes and reduirements imposed by the PRC, and accompanied by a written explanation of those items being appealed: Until said copies are on;file, no further development approval shall occur, and no further action by the Commission shall take. place:. An.applicant may appeal only certain aspects of site plan review, and: in the absence of discretionary review by the Commission, or review pursuant to a .petition, all other aspects of the .site plan shall be final. Any notice of appeal shall state with particularity the aspects which. are to be appealed.
