It's my opinion that the decision for access points to this tract has already been made: We addressed access points from the onset at the platting level becausethis was such a critical corner intersection. The location we ended up getting was not the desired location but a compromise. Its my understanding that as part of the negotiation for the purchase of the library site, an agreement was made to move the access on 2818 approx. 75-100 feet west of where it is shown ou the plat. I don't: latow anything more about this - I'm sure someone could fill me in. Now, Pm hearing that there needs to be a replat for this and that it may treed to go to P&Z for a driveway variance: It seems: to me that a staff level discretionary decision was made on this in the property negotiation and that its tao late to go to P&Z for a variance.. When Council approved the plat, it was with the conditon and understanding that. the driveways would be at the access easements shown on the plat. In other words Council has already considered the location of access to this property. Remember that the appealing. body to the driveway ordinance is the P&Z, not Cotuicil. If we were to allow Hanson to go for a variance on this, he would be appealing to P&Z a previously rendered Council decision, not a staff level decision. »> Sabina Kuettzel 01/29/96 05:32pm »> on the existing plat it shows several joint access easements that meet the driveway ordinance. that plat was approved several months before the most recent rezoning. according to elrey, the replat will relocate one of the easements closer to the 2818/welsh intersection. if that drive does not meet the ordinance then it will either have to go to pnz for a variance or it may be within in the range of discretion for a staff level variance as defined in the ordinance. it's my understanding that the drive that ray hansen wants is going to grossly violate the driveway ordinance. the pnz could grant a variance to that ordinance bttt we would not support it due to the concerns expressed by the school district during the rezoning hearings and due to staffs assurance that traffic safety has been addressed tluough the previous plat. »> Cathy Locke 0.1/29/96 0409prn »> ', which. plat? Shirley, Sabine, and I met with. Ralph Hanson earlier today about his request. Essentially, he asked to be allowed a second driveway access onto his. site from 2818. He did not question the need for or location of the shared access that is in the agreement we have with the original property owners. However; he believes another access point into his site from 2818 would be beneficial to his proposed business. This request is no different than many other similar requests that we handle oil a regular basis. We told Mr. Hanson that atiotlter driveway access off 2818 does. not meet our standards, and. if he submitted a formal variance request to P&Z it would very likely be denied. While he did trot like our answer, he appeared to accept it and indicated he did not plan to pursue a varience request. The replat of the entire site. is being performed by Urban Design Group. All of the easements addressed in the agreement with McDowell and Woods will be included with no changes. We will do our best;to get this completed quickly so that it does not adversely affect Mr. Hanson or the library development. The issue of deed restrictions tics itot yet been resolved. I have checked with the staff in Dev. Services and no one has taken this on as a project yet. Since this is not something that this city does on a regular basis, we do notknow who should initiate the cask of developing these deed restrictions or what they should say. I will visit with Elrey more about this later today. I apologize for the confusion that this matter has caused: It was really a very simple request made by a local developer attempting to improve his business envirottrrtent. Access is taken from Welsh Street through a 28 foot wide access. easement. College Station has the obligation toxeplat. McDowell and Woods have contributed $10,000 to the construction of the drive. They have the option of doing the work themselves. There will also be a joint access easement from F.M, 2818. Take a ook at the agreement. If you need anything else, please feel free to contact me. No one with the Plamung dept has contacted me on this matter. I don't know who is dealing with the buyer or even who the buyer is. I would expect that the. planner in charge would request proposed deed restrictions that could be reviewed by one of the attonreys. Ray Hansen, the purchaser of the :corner property, came in today, and I gave him a copy of the agreement and explained to the best of my ability wlrat I think the agreement says about the location of the driveway.- He is very unhappy about the restriction to having to share the driveway along FM 2818 which will be so far away from his gas. pumps (as he is proposing to design the layout of the property). He has asked if there is someway. to get that changed. I pulled the old plat and explained that at the time the. property was replatted to the configuration .shown on the plat, the location. of driveway access was made'by P&2 and Council where they were considering the plat.. I additionally explained that apparently thatlocation is being moved closer to the intersection with the agreement, and adjoins leis property, whereas before it was apx.100 feet to the east of that lot. He said he flrought the restriction on location isunnecessary because of the location of the traffic signal. I told him at the time of platting I wondered about that since it was. approximately 375 feet from the intersection, but. that staff had taken consideration of the location to P&Z. He said he thinks the City shouldbe more considerate of new businesses which will help the, tax base, etc:... I told him that I didn't know what, if anything, can be done to change the location since it was an agreement reached between the previous property owner and the City, but that I would ask artd get back with him as,soon as I hear anything. It looks like they failed to tell this to the new owner. I will get in the aniddle of this and find our what is going on: There is a signed agreement between the city and McDowell/Woods about these access points. I am sorry about the concerns that Mr. Hansen has but it appears that it may be between Hansen and McDowell/Woods...: Keep you posted... Rosernary Bryan, TX 77802 RE: Proposed Site .Plan. for 700. FM2818 Dear Mr. Hansen: We received the site. plan Mr. Hammons submitted on 3/6 and have begun the staff review of that plan. One of the first things we noticed during. our review is that while Mr. Hammons refers to sheet C-1 for site grading, drainage and earthwork which includes stormwater detention,. that. sheet was not submitted, therefore, we are not able to determine if what is being proposed will actually"work" as proposed. Another note refers to sheet C-2 for details of the proposed raised divider in Welsh. That sheet also was not included. in the submittal, and we are not able to determine if what is .being proposed will "work", or even if there is room in the street fore the structure.. Also, the overlay district requires that part of the ubmittal to be reviewed are elevations of .the praposal, along .with color samples of everything proposed on the site.. If you will refer to Section 8.19 of the zoning ordinance, a listing of all the requirements of the overlay district are included. The 2 civil sheets and the overlay district. submittal regulations are required to make the submittal. complete, with enough information to make a thorough review of the plan. The staff reviewed as much as possible with the information provided., and would like to point out the following problems we fiave identified to date.. These items appear in no specific order of importance. 1. The off-street parking requirements have been figured at 1 space per 200 square feet. It appears to staff that the'proposal is. fora "small shopping center'° as defined in the zoning ordinance,. and as such, requires 1 space per 150 square feet, fora total of 57 required spaces. The site plan submitted does have exactly 57 spaces which includes the spaces at the pumps. ~r ., 2. The complete frontage along FM2818 must be screened if there is parking in front of the building according to the requirements. of the overlay district. 3. The non.-canopy trees along FM2818 must be .crepe myrtles. 4. All proposed landscaping must be identified by species, including scientific names. 5. The proposed driveway- along Welsh, closest to the intersection, if allowed must restrict traffic to right-turn in and right-turn out. ~ Please submit details of this driveway. (We acknowledge that we stated that the design of this driveway was, an "either/or" situation, with the. possibilities being a median in Welsh. or the ..right-in, right-out configuration. Until we see your proposal for the median, a determination cannot be made for this driveway.) 6. Water & sewer demands`have not been included. 7. The "future car-wash" location does not meet the required 15 foot setback. 8. The curb along the "joint access easement" from Welsh .into the property should be extended to better delineate the opening into this site, as well as to direct traffic into the car wash. 9. Is .the fire. hydrant existing or proposed? Take care to keep landscaping away from the hydrant. 10. Please. show the fire lane locations on the site plan. 11. The "shared access easement" from FM2818 only extends a short distance into'_the property, and from .that point south your property must be developed with all driveways and parking spaces on your lot, with curbing along your property line. 'This will cause a re-design of that part of the site plan. 12. Please include a note on the site plan which. lists Section 8.K.3. of the zoning ordinance regarding storage and display. We are looking forward to working with. you on the development of your site, but would urge you to make an appointment for you and your site design. people to come in and meet with all of the development review staff so any problems and questions can be addressed in person. ®ur regular predevelopment review meetings are held on Monday afternoons and Tuesday mornings, so please call r ~~ c ~~ at least a week in advance so we can schedule a meeting: which will be convenient for all :parties. 1 Yours very truly, Shirley J. Another note refers to sheet C-2 for details of the proposed. raised divider in Welsh.. That sheet also was not included in the submittal,. and we are notable to determine if what is being .proposed will "work", or even. if there is room in .the street for the structure. Also, the overlay district requires that part of the submittal to be reviewed are elevations of the proposal, along with color samples of everything proposed on the site. If you will refer to Section 8.19 of the zoning ordinance, a listing of all the requirements of the overlay district are included. The 2 civil sheets and the overlay district submittal regulations .are required to make the submittal .complete, with enough. information to make a thorough review. of the..plan. The staff reviewed as much as possible with the information provided, and would like to point out the following problems we have identified to date. These items appear in no specific order of importance. 1. The off-street parking requirements have been figured at 1 space per 200 square feet. It appears to staff that the proposal. is fora "small shopping center" as defined in the zoning ordinance, and as such,_requires 1 space .per 150 square feet, for a total of 57 required spaces. The site -plan submitted does have exactly 57 spaces which includes the spaces at the pumps. 2. The complete frontage along FM2818 must be screened if there is parking in front of the building according to the requirements of the overlay district. 3. The non-canopy trees along FM2818 must be crepe myrtles. 4. All proposed landscaping. must be identified by species, including scientific names. 5. The :proposed .driveway .along Welsh, closest to the intersection, if allowed must restrict traffic to right-turn in and right-turn out. Please submit details of this driveway. (We acknowledge. that we-stated that the design of this driveway was an "either/or" situation, with the possibilities being a median in Welsh or the right-in, right-out configuration. Unti we see your proposal for the median, a determination cannot. be made for this driveway.) 6. Water & sewer demands have not been included. 7. The "future car-wash'' location does not meet the required 15 foot setback. 8. The curb along .the "joint access easement" from Welsh into the property should be extended to better delineate the opening into this site,: as well as to direct traffic into the car wash. 9. Is the fire hydrant existing or proposed? Take care to keep landscaping away from the hydrant. 10. Please show the fire lane locations on the site plan. 11. The "shared .access easement" #rom FM2818 only .extends a short distance into the property,. and from that point south. your .property must be developed with alf driveways and parking spaces on your lot, with curbing along your .property line. This will cause a re-design of that. part of the site plan. 12. Please include a note on the site plan ..which lists Section 8.K.3. of the zoning ordinance regarding storage and display. My explanation is that the. zoning ordinance defines a shopping center as ":..three or more stores, shops, or commercial enterprises, and which has shazed parking facilities or access." When asked the reason why the Exxon station (also Mr. Hansen's) at Rock Prairie and Tex Ave was not: defined as a mall shoppng center since it has 3 commercial ente~prises,.I answered that had we known at the time that 3 sepazate businesses were being planned in the one building, we would have considered it, too, as a small shopping center, but since they didn't tell us that, and since it was shown as one store that they asked if they could$ave a small sandwich shop in, it was considered as a C-store with'.a sandwich shop, orsomething which would only require 1 parking space per 250 square feet instead of 1 parking space per 150 square feet (small. shopping center). We don't have any real plans for a.sign - only conceptual showing height, size - mostly to determine if it will interfere with any utilities in the easement. Kent & Steve have o.k.'d puttii}g the sign in the easement. Now they have to turn in plans. The developer/owner is responsible for providing and placing two 4" PVC pipe with pull string from the outside building :termination to a proposed manhole in the 20' utility easement along Welsh Street. The conduit shall ell up 4' at the outside building location and be capped and ell_up 6" at the manhole and be capped. The outside termination at the building shall be within 20' of power and no closer than 36". If termination if now within 20' of power, a 8' x 5/8" copper ground rod must be provided and placed.. GTE will have one termination, that .termination is on the outside of the convemence store; therefore, .provisions should be made for the lease spaces to access that termination. The conduit shall have no .sharp bends, a 17" x 22" pull box may be required, which is provided and placed by the developer. The .existing GTE manhole is located in the 20' utility .easement along Welsh Street, with the platting of the 29' joint access. easement, the manhole is in the. center of the drive. The manhole will have to be relocated farther south in the 20' utility easement. Cost of the relocation and the party ofparties responsible for payment of the relocation have not been determined. Until said copies are on file, no further development: approval shall occur, and no further- action by the Commission shall take place.
