Memorandum Date: May 13, 1996 To: Veronica Morgan Assistant City Engineer From: Mark Youngjohn CD Grant Analyst Re: Alex Dosani Sidewalk Project Welsh & Holleman HUD_regulations controlling the use of Community Development Block Grant funds in relation to commercial development make it infeasible for the City of College Station Community bevelopment Office to provide Mr. Dosani any financial support in building sidewalks around the storehe proposes at Welsh and Holleman. This is because once CD donates money to a private developer's project HUD considers the project governunent- subsidized..economic development and then wants reports on what types of jobs are being created, who is working them, how much they are being paid, etc. Also, because the project cost would be financed with federal money, the Davis Bacon. and Copeland Anti- .Kickback Acts would be in effect, mandating considerable headaches during the bidding of the work. These are reporting burdens not worth the $4,000 or so'Mr. Dosani'is requesting:- However, .the Community Development Office can use a portion of its block. grant to .construct public facilities, such as streets, water mains, bridges and, indeed, sidewalks. So, while we an•e not able to provide Mr. Dosani money to build sidewalks, we might be able to provide him the.: actual sidewalks. If Mr. Dosani would like for unto construct his sidewalks for him he will need to provide the Community Development Office with a schematic and specs describing where he wants the sidewalks, how he wants them built, and when he wants them built. We will then review the .plans and respond with a formal. response of whether or not we will be able provide them. I gave it to Mark yesterday and he will be calling you today. It looks like we can fund it, however, I want to do it as an infrastructure project and not tie it to .their project. Representative SUBJECT: Parking Lot Plan -Convenience Store; proposed renovation of an existing convenience store located. on an 0.353 acre tract on the southeast corner of the Holleman. and Welsh'intersection. (96-404) A Project Review Committee meeting was held Wednesday, March 13, 1996 to :discuss the above mentioned parking lot plan.. Assistant City. Engineer Morgan moved to approve the site plan with the following :ordinance requirements comments. The following is a list of ordinance requirements identified by the Project Review Committee.. This list does not relieve the applicant of total. compliance with all current ordinance .requirements. Ordinance Requirements: The City does not have a standard for installing brick pavers but we do have some options which are less expensive and would aesthetically serve the same .purpose. Stamped and dyed concrete is less expensive and easier to maintain. Relocate the existing stop sign further away from the sidewalk .ramp. _ The dumpster needs to be an eight yard container and the .screening needs to be an eight foot tall fence with a gate enclosure. _ A drainage report is not required based on the. assumption that .the applicant is not changing. the .drainage flow patterns. A drainage development permit will be required prior to site work; however, the $..100 application fee will. not be required. Provide erosion control details with the construction documents. _ Fire lanes. are not required. Remove any reference to. fire lanes throughout the site. _ Provide curb, pavement, ramp and sidewalk details. (These details can be included in the construction documents.) PRC Report Case #96-404 Page 2 of 2 Ordinance Requirements (cont.): Provide driveway apron details and make sure there is no large slope in the driveway so that it can't meet ADA requirements. (Maximuml/4"' / 1' slope:) The existing sanitary sewer and water service taps can be reused; however, a new .meter will probably be required.: Submit water: and sanitary sewer demands. The measurement from the curb. line to the sign should measure 15' to the closest part of the sign for an 8' tall sign. Submit a letter requesting participation from the City's Community Development department for the sidewalks to be located along Welsh and Holleman. Comments/Concerns: G.T.E. will' go underground to the: building. and follow the electrical service. The developer is=required to place-one 1 PVC pipe from the outside building termination to the power pole on the southwest property ine. Stub the conduit up 4' at the outside building termination and 6" at the base of the power .pole. The termination should be within 20' of .power;. if not, n 8' x 5/8" ground rod must be placed at the base of the termination. Coordinate details with G.T.E. Representative Laverne Akira. at (409). 821- 4723. _ Underground service is required. Submit an electrical service request form agreeing to pay for 20% of the cost of electrical service. The developer is responsible to install all conduit per City design and requirements including the transformers pad and junction box. Additional easements will be required to serve the property that may be dedicated with the final plat. Submit service voltage, electric load data (total KW) and the location of the outside disconnect. Kee seconded the motion. to approve the site plan with .the .above. mentioned comments which passed unopposed (2 = 0). SUBMIT 4 COMPLETE SETS OF CONSTRUCTION DOCUMENTS WITH THE. REVISED SITE PLAN ATTACHEp TO CONTINUE WITH PHASE II OF THE BUILDING PERMIT PROCESS. COORDINATE FUTURE SUBMITTALS WITH DEVELOPMENT COORDINATOR SHIRLEY VOLK AT (409) 7643570. APPEAL PROCESS: An applicant :may appeal the: decision of the Project Review Committee to the Planning and Zoning Commission within five days after the PRC Committee meeting. Failure to appeal the PRC action shall constitute a contractual acceptance of all conditions imposed, and a waiver and surrender of all complaints,. defects, or potential invalidity, whether under state or federal law, An applicant appealing the decision of the PRC shall file ten copies of the final site plan as approved by the PRC, showing all changes and. requirements imposed by the PRC, and accompanied by a written explanation of those items being appealed. Until saidcopies are on file, no further development' approval shall occur, and no further action by the Commission shall take place. An applicant may appeal only certain aspects of site plan review, and in the absence of discretionary review by the Commission,. or review pursuant to a petition, all other aspects of the_ste plan shall be final. Any notice of appeal shall. state with particularity the aspects .which are to be appealed.
