I did go drive by the site and look carefully from both directions. The dumpster is very visible from University Dr. This is why the originally approved site plan required a screen fence. It is important to our Council and community that these type of items be screened from public view. Therefore, you will need to be sure. this is taken care of. The fence will have to extend all the way out to fully screen the container. The Blockbuster employees will have to step into the circulation aisle only for a few short steps. This particular aisle does not carry a lot of traffic as it is where service vehicles take access. I see no danger or inconvenience to those trying to use the container. It is the way it was originally designed when the site plan was submitted to the City. I appreciate your cooperation in this matter and would like to see it resolved at your earliest convenience and at least before the 15th of December. By working with an architect, a contractor and the Village Shopping Center owners to try to complete your site, including cleaning up adjacent property, and to repair the pavement and curbing on the driveway along the eastern boundary of your property. and designate it as a fire lane, you have addressed the health and safety concerns and have made the site look complete. . There is still one small item which needs to be addressed. The screening fence to help enhance the visual impact along Universitybrive has not yet been installed, and it must be done. It will be necessary to only install a section of fencing along the northern side of the dumpster area to accomplish the required screening in that area. Contact was made with the architect who was your representative on the completion of the project, but he informed usthat he was no longer affiliated with this project and we should make contact with the owners for completion. Once again, we thank you and the Village Shopping Center owners for your cooperation and quick response to the City's concerns, but must remind you that until the fence is re-installed which will signify completion of the project begun several years ago, no additional permits will be issued for this site. !n addition, there is still the possibility of the necessity of filing daily charges in Municipal Court if this situation'continues over a prolonged period of time. The plans were submitted by John Clarke and approved with certain specific'conditions. I have enclosed a copy of that report for your information. Two conditions of approval were that the dimensions of the proposed dumpster pad be supplied and that' the drive o the east of this building and the existing Blockbuster building be repaired so that there would be sufficient curbing. and width to meet fire lane requirements.... Plans were submitted for: review, and on 7/5/96 comments were faxed to the applicant for the building permit. Those comments included a requirement that the dumpster pad be a minimum dimension of 12 ft. x 12 $. The building permit was issued, but when the builder applied for the Certificate of Occupancy on the portion of the building that houses the Little Caesars Pizza restaurant, a condition on that Certificate of Occupancy was that the dumpster pad and screening must be completed and the site cleaned.: up by November 15,1996:and/or before any additional building permits would be issued on this sites' While the screening fence has been installed around a dumpster pad, the pad itself is still of a size and. configuration which renders it unusable by our sanitation personnel The. curbing and driving surface of the drive have not been .repaired, and. the fire lanes have not been marked: Telephone contact with Mr. John R. Clarke has not. produced. desired `results and the = contractor has not fulfilled his obligations over the past months. It is imperative that this situation be remedied and the site brought. into compliance with zoning and site plan Hame of Texas. Shirley, there is no dp required for the expansion. of the above project. When BB originally was developed, the drainage calculations took the entire site into consideration. All they turned in was a site plan attached to building plans. I have logged them in across the hall, but if it's not a complete submission there's no sense in waiting 5 days to tell them! If you'll recall,. Kent, you were going to get with V to see if drainage had been figured for the whole shopping center when if was. built. Then I find notes V made to herself about numbers of files in the archives, but then I don't find anything else! I did give Tim Woods a DP application which I told him I believe he can fill out himself since the site is (according to the. site plan) out of the 100 year flood plain. Also, I didn't tell him he would have to pay $300 -because everything is internal -nothing in the ROW -and no fire hydrant is involved. Also, this is an old project, and was certainly bid before the decisionwas made to begin charging everyone. Then he would like Planning to take a look to see if the fence needs to be replaced. If it does, he will do it; if it doesn't, everyone will be better off because it won't deteriorate! Will you see to it that the dumpster is put in the right place next week, please. Thanks. Also, I told him the fire lane needs to be painted since the curbs have been repaired 'or replaced. I pointed out that we still will not be issuing a permit for the other lease space beside Lil Caesar's until the adjacent property is cleaned up, regraded and reseeded. APPEAL PROCESS: An applicant may appeal the decision of the Project Review Committee to the: Planning and Zoning Commission within five days after. the PRC Committee meeting. Failure to appeal the PRC action hall constitute a contractual acceptance of -all .conditions imposed, and a waiver and surrender of all complaints, defects, or potential invalidity, whether under state or federal law. An applicant appealing the decision of the PRC shall file ten copies of the final site. plan as approved by the PRC, howing all changes and requirements imposed by the PRC, and accompanied by a written explanation of those items being appealed. Until said copies are on file, no fixrther development approval shall occur, and no fixrther action by the Commission shall take place. An applicant may appeal only certain aspects of site plan review, and in the absence of discretionary review by the Commi sion, or review pursuant to a petition, all other aspects of the site plan shall be final.
