As we discussed during the predevelopment meeting on Monday, March 18,' 1996, the developer would be responsible for the construction of Southwest Parkway'. West .and Jones-Butler Road through the property being developed..However, at that time we were unable to indicate what classifications thesetwo streets would have other than what was shown on `the Thoroughfare and Transportation Improvement Plan approved by the City Council. Since that meeting, we have determined that Jones-Butler can become the minor arterial and Southwest Parkway the collector. With either classification, city staff will recommend to the Council-that both streets be extended to Luther Street in order to provide fora better transportation system. As for the costs incurred to construct Luther Street, we propose at the present time for-:.the right-of--way to be dedicated as part of .this plat with assessments made to abutting;. property owners when .the. City constructs the street. The required right-of--way for a Luther is sixty (60) feet and should concur with the Woodway West -Phase I.Plat; If the development requires access to Luther, then the developer will be responsible for the construction necessary.to provide a street section capable of carrying the increased traffic In addition,. access.will not be allowed to Luther unless the street meets current City standards. The' construction and dedication of right-of-way for,Jones-Butler is the responsibility;of Mohawk Ltd. due _ ~~ -to these parcels being out. of the .same original .parent tract. Integroup property will not be required as it is shown to intersect with a street which ties back into Southwest Parkway off this property, but on properly labeled "Reserve Tract" on the Final Plat of Lots 1-5 Parkway View Addition. The "Reserve Tract" contains 4.36 acres and was owned by Arapaho, Ltd. at the time the plat was filed in the fall of 1995. PRELMNARY AND FINAL PLAT (Replace with the following:) The preliminary plat can be processed concurrently with the zoning application. Both the preliminary plat and the final.. plaf must go before the Planning and Zoning Commission and the City Council. Every effort should be made to clear up .review comments before the Planning & Zoning Commission, but in the event that cannot be achieved, staff will work with the applicant as much as possible to address any problems. Changes to infrastructure construction documents do not have to be made prior to being considered at these public meetings, but rather, must be made and the documents approved for construction prior to filing the final plat for record with the County. (STAFF REPORT DUE TO JANE ON TUESDAY) at our last project coordination meeting (5/28/96) i mentioned that this project was coming and that i recognized that we have sewer problems in the area. i tred'to explain to everyone at the table (jeff koska, brett, kathryn anthony, tony mchalsky) the new policy regarding rezonings, existing zoning and existing infrastructure concerns., (1) i explained that if the proposed development would meet the existing zoning restrictions that any infrastructure problems we may have or that may be created by this development would be ours to accept and fix. in other words, we are shifting the financial responsibility for existing/newly created infrastructure problems to the`Cty. and (2) i explained that-if the proposed development would NOT meet the existing zoning restrictions and would be requesting rezonings at a significantly greater intensity, then the development would have to accept and fix any existing or newly created infrastructure problems as a condition of the zoning. well, jeff looked QUITE SURPRISED'!!!!!! ( i think this is an understatement) and i have heard that Bi11 Riley is NOT HAPPY with this new policy. He is concerned that he does not have the. funding available to fix the existing infrastructure problems in case #1 stated above.. I understand that Bill has a cip budget. that he is working on and hat we are trying to stay within a certain spending limit per. year. If Bill cannot or chooses not to repriortize his cp dollars to fix these type problems (driven by new development) then he is absolutely correct. in that we will be creating health and safety problems, these problems potentially being big enough to be a basis for denying water and sewer taps to buildings. we cannot have both. we cannot keep the existing cip priority list and this new policy supporting development.. if this rezoning does not significantly affect the sewer discharge that would be generated from the area, my .feelings (based on policy i've been directed to follow) are to support the rezoning and give kept the time frame in which to get the sewer corrections made. If-he can't get them made in time, we would have to place a condition on the ,zoning that we enter into a development agreement to have them. front the money and possibly do the construction and we would. pay them back.. { here is going to have `to be a development agreement anyway'on the southwest parkway extensioh). in regard to our existing infrastructure (utilities. and streets), the requested zoning will impact much more than the existing zoning because they are requesting R-5. Sabine is_trying to decide whether to recommend an R-4 instead of the R-5, which would accomodate their development, but only with a height variance. she would rather support the requested R-5, but only if the utility concerns can be worked out (as the street questions have already). in this particular case, the Christine lane sewer upgrade that is currently budgeted, should accomodate this development,. so this may not all be coming to a head quite yet. but we anticipate that it will very soon, especially with the bush library attracting development on the west side of wellborn. I'll start with the as-builts and-work from there. 2) I told him of my finding of the downstream section, and of the need for this department to reach an understanding with the other .department as to what will be done to prevent and potential spillage in the existing line, and the timing involved so Melrose will not be held up. He is asking questions based upon an approved site plan (though they want to revise it now) .and I am uncomfortable addressing these questions since I have been out of development review so long, so I simply referred him back to you. In the future, I would prefer to respond to you regarding capacity questions and let you discuss the options with the developers so I don't get caught in telling them something that is not correct. Proposed Water. Service (Replace entire paragraph as follows:) Mr. Steve Homeyer indicated that the existing water .lines should be adequate to serve the proposed development if the proposed water line for the site is connected to the 18" water line in Marion Pugh. We discussed two options to upgrade the`system ifnecessary One option is to increase the size of the existing line locatedin the Southwest Parkway'right- of-way; either by paralleling with a 12" line or replacing with a 16" line. The second .option is to extend a 16" line from the end of the existing 8" line on Southwest Parkway W. The 16" line would need to connect in one of two ways: The first possibility would be to connect the line back into the 6" line in Woodway Drive. The second, and most preferable. possibility, is to extend a 16" linefrom this site along the Luther Streetright-of- way and tie into an existing 18" line located in Marion-Pugh. The waterlines necessary to serve this project are the responsibility of the developer, with any size over that required to serve. this.. project eligible far a request. f®r oversize participation by the. Proposed Wastewater Service eplace the. 4th sentence as followsa While tapping. into the 8" line parallel to Woodsman Drive was discussed, we indicated that the City prefers a connection to the 15"' line located near the Raymond Gretzky property adjacent to F.M, 2818 for a project of this size. We could allow for a connection to the 8" line for a small portion of your project, but the capacity of that line cannot be exceeded. [-force of Texas A&M Qniversity Electric Availability (Correct sentence #2 as follows:) The developer would pay 20% of all expenses incurred due to the new development (i.e., transformers, etc.), plus 100% of the cost of transformer pads, conduit and conduit installation. TRANSPORTATION Luther Street (Replace the .entire paragraph as follows:) This road is scheduled to be upgraded to a collector street based on the thoroughfare plan. However, a time frame for this project has not been discussed or developed by the City. The City would. propose at the present time for the right-of: way to be dedicated as part of this plat with assessments made to abutting property :owners when the City constructs the street. The required right-of--way for Luther is 60 feet, and should concur with the Woodway West - Phase I Plat, If the development. requires access to Luther, then the developer will be-responsible~for the construction necessary to provide a street section capable of carrying the increased traffic. In addition, .access will not be allowed to Luther unless the street meets current City standards. Jones Butler (Replace the entire paragraph as follows:) The construction and dedication of right-of way for Jones-Butler is the responsibility of Mohawk Ltd. due to these parcels being out of the same. original parent tract. This street will require 80 feet of right-of-way when constructed. Any width beyond that required to .serve this project is eligible for a'request for oversize participation by the City. As with Luther, access will be denied to Tones-Butler ifthe-street section does not meet current City standards. Southwest Parkway (Add the following:) Until the `adopted Thoroughfare Plan is changed, the staffwould recommend the continuation of Southwest Parkway through this property to Luther as proposed. Woodway (Replace with the following:) Theextension of Woodway Drive into the Integroup property will not be required as it is shown to intersect with. a street which ties back into Southwest Parkway`offthis property, but on property labeled,"Reserve Tract" on the Final Plat of Lots 1~5 Parkway View Addition. The "Reserve Tract" contains 4.36 acres and was owned by Arapaho, Ltd.. at the time the plat was filed in the fall of 1995.' i w PRELIMINARY AND .FINAL PLAT (Replace with the following:) The preliminary plat. can be processed concurrently with the zoning application. Both the preliminary plat and the final plat. must go before the Planning and Zoning Commission and the City Council Every effort should be made"to clear up review comments before .the Planning & Zoning Commission, but in the event that cannot be achieved, staff will work with the applicant as much as possible to address any problems.
