Senior Planner Kuenzel presented the staff report andstated that due to the fact that the City Council
has never seen a layout of this property, the case will be considered by Council as well: Staff is seeking
a recommendation from the Commission rather than final approval. The. layout of thin plat is in
accordance with the:. preliminary plans that have been. agreed to by the area homeowners and City Staff.
The applicant is requesting a variance to the subdivision regulations that require all lots to have access
and utilities. The lots that do not- meet these standards for subdivided. lots aze those. noted as
"unbuildable": These 17 Lots will provide -the buffer area between this development and Woodcreek.
Staff recommends .approval of variances for the 17 lots. The property has been recommended for R&D
zoning by the Commission and 'will be considered by the City Council June 27th. Staff anticipates. no
problem with .the rezoning of the property, 'and the plat.. shows compliance .with the. pending zoning.

lot numbers, with a change' in the title block to reflect. the correct acreage and phases, and with the
condition that the property be rezoned before the plat is considered approved.
Owner Bob Bower approached the Commission. and stated. that the architect and engineer for the
project are in the audience and are available to answer any questions.
Commissioner Garner moved to recommend approval of the. preliminary plat for the Technology
Business Pazk with staff recommendations including the Presubmission .Conference. comments and the
requested variance. Commissioner Parker seconded the motion which. passed unopposed (5 - 0).
AGENDA ITEM N0.8: Reconsideration of an amendment to Section 7.15 of the Zoning
Ordinance pertaining to the C-3 Planned. Commercial zoning district to allow small ;restaurants
with sit down dining and without drive-thru windows. (This item was previously tabled at the
July' 18,:1996 meeting.) (96-809)
Commissioner Garner moved to remove the ordinance amendment from the table for further
consideration. Commissioner Massey seconded the motion which passed unopposed (5 - 0).
Senior Planner McCully stated that at the last meeting, the Commission discussed possible minimum
standards which will need to be met in each future case that may occur. In particulaz, the .Commission
was concerned that the addition of some on-premise consumption would open the door to night club
type uses, such as ice houses. The City Has been fairly well preempted by the Texas Alcoholic Beverage
Commission in the regulation of alcohol related businesses. The preemption clauses were adopted by
the State in 1987. Basically, the City cannot impost stricter requirements on premises', that are required
to have. an alcoholic beverage license and not place those same requirements on premises that do not
sell alcohol. This legislation has recently been tested in the. courts and the outcome is simply that we
:cannot treat one establishment differently from another if the only difference. is that one has alcohol and
the other does not. However, there is one thing that the City can do on the alcohol-relatedissue.. A city
can still regulate. and control the location of an establishment that derives. 75% or more of its gross
revenue from the c~-prs~ sale o~ ~Icoholic beverages. The City could change the current nightclub
definition to mirrp~,ltiis sti~ard and ~ clearly prohibit them in a C-3 zoning district.

Item: Preliminary plat of approximately 70 acres consisting of two reserve tracts
and 23 lots for R&D zoning. 17 of the lots are not to be buildable lots. The property is
located in the southeast quadrant of the Sebesta Road and Highway 6 intersection.

Item Summary: The .layout of this. plat is in accordance with the preliminary plans

Financial Summary: Water to the site will have to be extended in accordance
with the utility master plan. The applicant will need to extend a 12" waterline through the
property from Sebesta Road to the most southerly property line. Impact studies have
shown thatthe development could be served by a 10" waterline and they have requested
oversize participation in the difference between the 10" and 12" lines. The City of College
Station does not accept 10" lines within its water distribution system, as this pipe size is
not considered standard and the pipe itself and fittings are difficult to obtain. Given this,
and that the cost differential between a 10" and a 12" is nominal, staff does not
recommend oversize participation.
Staff Recommendation: Approve preliminary plat as presented without oversize
participation.

SUBJECT: Preliminary Plat -Technology Business Park; proposed subdivision totaling 34.3
acres consisting of twenty-three lots (6 M-1 zoned lots and 17 non-buildable lots)
located in the southeast. quadrant of the Sebesta .Road and State Highway 6
intersection. There is a .pending rezoning request for R&D Research and

A Presubmission Conference meeting was held Wednesday, June 5, 1996 to discuss the above
mentioned preliminary plat. The following is a list of ordinance requirements and comments
identified by the Presubmission Conference. This list does not relieve the applican# of total
compliance with all current ordinance requirements.
Ordinance Requirements:
Note the width of .lots 1 and 2 of block 1. (Staff suggested clarifying the "block" lines or
re-number the lots so that it is clear what lots are in blocks 1 and 2.)
The distance between manholes cannot exceed 500'.
_ Provide an easement to .cover the proposed detention pond area which includes off-site
easements from the outfall site to the primary system as defined in the City's Drainage
Ordinance.)
_ A TNRCC variance will not be required for the proposed radial water line since there are
future extension plans; however, the water line must be extended through the subject
property so that it is available to the next. tract. (At this time, 10" water lines are not
accepted within the city limits. The line may have to be upgraded to a 12" line in order to
get the required flows.

.Item Summary: The subject property is Located at the southeast quadrant of
Sebesta Road and State Highway 6 (East Bypass). The layout of this plat is in
accordance with the conceptual plan presented during the .prior rezoning of this
property. The applicant is requesting a variance to the subdivision. regulations that
require all lots to have access and utilities. The 17 lots that do not meet these
standards are noted as "unbuildable" and are being platted to provide a .buffer area
between this development and the Waodcreek Subdivision. Staff recommends
approval of the requested. variance far the 17 lots.
The property was recommended for R&D zoning by the Planning and Zoning
Commission at their last meeting held on June 6, 1996. In addition, the. Planning
and Zoning Commission will consider this preliminary plat at their June 20, 1996
meeting. This preliminary plat as well as the proposed rezoning to R&D will be
considered by Council during the same meeting held on June 27, 1996. Staff
recommends approval of this preliminary :plat with the presubmission conference
corrections relating to the clarification of lot numbers, with _a .change in the title block
to reflect the correct acreage and phases, and with the condition that the property is
rezoned :prior to plat consideration by Council.. In addition to these requirements, the
developer must obtain al( off site drainage easements prior to staff filing the final plat
for record.
