I realize that there were some errors in the information submitted and that our original "approval" was based on inacurate data, BUT I also understand that moving the driveway to increase the separation from the intersection and the U-turn lane adds a significant cost for crossing the drainage channel. I also understand that Kent has no problems with the proposed location. as planned (and last time I looked the. City Engineer has the authority and responsibility to deal with this). Based on the above, I have advised Hansen and Swaboda that we will do the following in order to keep the drive at the requested location: 1. Work with them in a variance application, or, 2. Work with them in modifying the u-turnlane curbs, barriers, etc, subject to TxDOT approval (I made no commihnents to $$$ for modifications, stating only that maybe we pay'for it, maybe they pay for it, maybe we share costs), or if 1 or2 above cannot be accomplished; 3. We accept the proposed location (I based this 3rd alternative on my understanding that Kent had no problems with this concept). I will askthat they make every effort to accomplish 1 and 2 above before we result to the last alternative. Time is of the essence in this project as it is one of the three sites under consideration by Merrill Lynch. I have given them assurances that they can proceed with their plans to develop with the drive as proposed. Jane and Kent- Please see to it that the planning and engineering gang work to accomplish # 1 or 2 before we have. to resort to #3. Shirley- Please put a copy of this note into the project file. Subject: Dev Review- Merrill-Lynch -Reply -Reply -Reply I spoke with Allen Swoboda today about this. attd told him he could actually turn in everything (master preliminary plat, final plat, site plan with construction & building documents) at once at the next deadline if he wants to, He indicated he probably could not get everything done by then since that deadline is 2/14, but he would probably be turning in the master preliminary plat then with the final plat following within a week or two, for scheduling 2 weeks after the preliminary plat. As soon as we get anything which: constitutes something that makes all this "public record", we can let the HOA know about it. Steve explained the time problem and I offered our standard "fast track" with: Final plat of first phase to run: concurrently with masterprelim for the whole tract; Site plan, DDP etc. to run concurrently with plats; Building permit submission to take place as soon as site plan approval is completed. Subject: Dev Review- Merrill-Lynch -Reply -Reply -Reply There's been a bit of a change since I sent you mail on this yesterday. Allen Swoboda, Keating & Hansen came in and met with Ed Hard & I today. This time they had a preliminary plat which was more detailed than. those we .looked at before,. and I was able to ascertain that the will need to rezone the small left-over A-O zoned tract where Allen's sales office sets if they want to use it for pernianent otaice development. Allen said he .thought they had done that years ago (pre-1980), but according to the descriptions in the ordinances of that area, that small tract was left out. I gave them copies of the old ordinances. and Debbie Keating will check ahem via computer and compare that to what we have figured out. If hers are "better", we'll use them! Anyway, their plan now is to tum in the rezoning request on 2/14 for 3/7 P&Z acid 3/28 Council. The plats, impact studies, constniction docs, etc. will be turned in on2/28 for 3/21 P&Z and 4/1:1 Council if the Council meeting.. is still applicable. Ed basically agreed to the concept. presented today, Witte an indication that before he gave the final "blessing" on drive & street locations, he would have to have a bit more information, but it appeared to him that it would probably be accept<~ble as shown. As soon as we get anapplication-in here: we will be contacting the HOA there. Using aerial photography and applying these requirements, there appears to be a section of approximately 230 feet in which this roadway could take access to the SH 6 East Frontage Road. In light of the above, the; proposed location of Gemstone will need to be moved north a minimum of 80 fcet to be the proper. distance from Emerald Parkway. It can be moved no further than`250 feet north in order to remain .the proper distance away from the 'entrance rair-p. All things considered, .:staff feels the optimum location for the rt~ailway would be approxunately 80-100 feet north of its proposed location. With this submittal, the developer. is requesting a variance from the Subdivision Ordinance for the requirement of extension of utilities and provision for access to some of the lots within the proposed subdivision. His intent is to obtain legal documents that will tie the. adjacent lots together, such that they can not be soldndividually resulting in a platted lot without utility service or access. The request is for lots 6, 7, 8, and 9 only.. These lots are adjacent to Emerald Forest Phase One. The current adjacent homeowners in Phase One desire to purchase the proposed lots to provide additional buffer to their existing lots.
